CITY COUNCIL
SUPPLEMENTAL FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION
This matter previously came before the Council on November
28, 1989 upon the appeal by Gary Ratliff of the decision of the
Land Use and Development Commission imposing certain conditions
upon a conditional use permit to build a mini storage on real
property located at 201 West Linden. The Council previously
entered Findings of Fact and Conclusions of Law in the decision
as a result of the November 28, 1989 hearing, however, applicant
has requested a reconsideration of certain conditions imposed by
the Council. Such reconsideration is requested on the basis that
applicant received inadequate notice of the proceeding. The
Council, having heard additional testimony from interested
parties on March 13, 1990 and on March 27, 1990 now makes the
following:
SUPPLEMENTAL FINDINGS OF FACT
1. The Findings of Fact previously found are incorporated
by reference in full, unless modified herein.
2. Applicant intends to put a chain link fence around the
entire property.
3 . Applicant will screen between applicant's property and
the residential property of William Slaven.
4 . Applicant does not desire to screen along West Linden
because it will prevent law enforcement officers from observing
the buildings as they pass by.
5. Applicant further does not desire to hide his
commercial property but would like it visible to some extent to
the public.
BASED UPON THE FOREGOING FINDINGS OF FACT, the City Council
enters the following:
SUPPLEMENTAL CONCLUSIONS OF LAW
1. Conclusion of Law No. 9 previously adopted is rescinded
in full.

Modified Decision
The conditional use permit granted by the Council is
reaffirmed subject to modification of paragraph A and paragraph E
to read as follows:
A. A six foot fence measured from the gutter, facing West
Linden and going the full length of applicant's property, said
fence to be located on the south side of the landscaping strip.
B. A backhoe and a trailer may be stored outside on the
property. No other outside storage would be allowed after the
construction of the first two units.
