Office Development on Property Located at the SE Corner of
Yellowstone and Burnside
Hawkins Smith submits for Design Review, its proposed site plan for the building
and parking lot located as set forth above. Of concern are the size of the curbs at
Yellowstone and Burnside, at the NE corner of the property where Burnside curves from
eastbound to southbound and the size of the curbs of the SE corner of the property.
The parties represent the site will be used for a retail office supply store. Those present

Attorney Holmes disclosed that he represented James Thilmont, one of the
partners in Property Enterprise, which is the partnership selling the property to Hawkins
Smith. After discussion, the Design Review Committee reached the following decision:
A. The NW corner, Yellowstone and Burnside, shall have a radius of 40 feet.
B. The NE corner, Burnside and Burnside, shall have a radius of 30 feet.
C. At the ~ W corner, the curb on the southside of the entry into the site shall
be placed so that the radius starts further into the parking lot. This may eliminate one
parking space which shall not be a problem with the overall parking.
D. The compact parking spaces on the south side of the property shall be
converted to full size vehicles. While this may result in the parking lot being short a few
spaces of that strictly required of the size of the building, it would be Design Review's
recommendation to the City Council that the), approve a reduced parking requirement.

shall landscape the slope as part of its landscaping requirement and tie it to the City
water system. The City will maintain the landscaping on the slope. Developer and
subsequent owner shall allow the City access across its property for purposes of
maintaining the landscaping on that slope. All other landscaping within the project shall
be maintained by the developer and subsequent owner.
Pursuant to Idaho Code § 67-8001 et set., the Design Review Committee makes
the following findings with respect to the. decision in this action:

A. This Action does not result in a permanent or temporary physical
occupation of private property.
B. This Action does not require the property owner to dedicate a portion
of the property or to grant an easement.
C. This Action does not deprive the owner of the property of all viable
uses of the property.
iD. This Action does not have a significant impact on the landowner's
economic interest.
E. This Action does not deny a fundamental attribute of ownership.
F. This Action does not serve the same purpose that would be served by
directly prohibiting the use or action; nor does the condition imposed substantially
advance such purpose.
