Minutes of a regular meeting held at the Chubbuck city Council Chambers, January 23`d, 2001.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
INVOCATION was given by Bishop Lenny Purrington, Oh Ward, Tyhee Stake, The Church of
Jesus Christ of Latter -Day Saints.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Chase Sparks.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to minutes of a
regular meeting of January 9`h, 2001.
Councilman Kearns moved to approve regular meeting minutes of January 9 "`, 2001 with
a couple of spelling errors corrected, Councilman Quick seconded. All council members
present voted in favor of motion.
ORDINANCE #537 - De- annexing certain lands presently included within the boundaries and
jurisdictional limits of the City of Chubbuck, which should have been included in
Ordinance #483; directing the Chubbuck City Clerk to comply with the filing
requirements contained in Idaho Code Section 63 -2215.
Mayor Cotant read Ordinance #537 in full for the first and final reading.
Councilman England moved to dispense with the rule requiring an ordinance to be read
on three separate days, Councilman Kearns seconded. Roll Call Vote: Quick, yes;
England, yes; Gunter, yes; Kearns, yes.
Councilman Gunter moved to adopt Ordinance #537 as read, Councilman Quick
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes.

ORDINANCE #538 - Expressing an intent to sell, convey or exchange real property owned by
the City; authorizing a sale for cash or terms of said parcels by public auction to the
highest bidders for amounts equaling or exceeding the appraisals; reserving to the City
the right to reject any or all bids on any parcel; prohibiting such sale from occurring until
sixty days have expired from the date of passage of this ordinance and public hearing has
been held during that period; providing that proceeds from sales shall be used to
discharge City indebtedness or for public improvements; providing that if the property is
not sold at public auction, the same may be exchanged for other property without further
notice or auction.
Attorney Holmes read Ordinance 4538 in full for the first and final reading.
Councilman Quick moved to dispense with the rule requiring Ordinance #538 to be read
on three separate days, Councilman England seconded. Roll Call Vote: Quick, yes;
England, yes; Gunter, yes; Kearns, yes.
Councilman Kearns moved to adopt Ordinance #538 as read, Councilman Gunter
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes.
ORDINANCE #539 - Providing for change of Land Use District with respect to certain lands
within the boundaries of the City of Chubbuck from Limited Residential, (R -2) to
Limited Commercial, (C -1); declaring that the City Council finds that such change in
Land Use District is compatible with the Land Use Pattern prescribed by the City's
Comprehensive Plan - Ron Dykeman - East. Chubbuck Road.
Councilman England read Ordinance #539 in full for the first and final reading.
Councilman Kearns moved to dispense with the rule requiring Ordinance #539 to be read
on three separate days, Councilman England seconded. Roll Call Vote: Quick, yes;
England, yes; Gunter, yes; Kearns, yes.
Councilman Kearns moved to adopt Ordinance #539 as read, Councilman Gunter
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes.
FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION - Application of Ron
Dykeman for a change in Land Use District for the real property.
^" Councilman Quick moved to approve the Findings of Fact, Conclusions of Law and
Decision as read, Councilman Kearns seconded. All council members voted in favor of
motion.

ORDINANCE #540 - Providing for change of Land Use District with respect to certain lands
within the boundaries of the City of Chubbuck from Agricultural, (A) to General
Commercial, (C -2); declaring that the City Council finds that such change in Land Use
Pattern prescribed by the City's Comprehensive Plan - Knudsen/Home Depot property.
Attorney Holmes read Ordinance #540 in full for the first and final reading.
Councilman Gunter moved to dispense with the rule requiring Ordinance #540 to be read
on three separate days, Councilman Quick seconded. Roll Call Vote: Quick, yes;
England, yes; Gunter, yes; Kearns, yes.
Councilman England moved to adopt Ordinance #540 as read, Councilman Kearns
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes.
FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION - For a change in Land Use
District for the Knudsen/Home Depot property.
Councilman Kearns moved to approve the Findings of Fact, Conclusions of Law and
Decision for the Knudsen/Home Depot zone change, Councilman England seconded. All
council members voted in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Quick moved to approve computer print -out claims as presented,
Councilman Gunter seconded. All council members voted in favor of motion.
GENERAL DISCUSSION -
1. Councilman England suggested the City consider naming a landmark or something to
recognize former Police Chief Arnold Stone. Council agreed.
2. Chief of Police stated the Police Department is taking donation for Arnold Stone's
Family. Cindy Neuman is collecting the monies donated.
At 7:59 p.m., Councilman England moved, Councilman Gunter seconded, with full council
approval to adjourn meeting.
