HomeMy WebLinkAbout10 23 1984 CM1.17 COUNCIL MEETING MINUTES October 23, 1984 Minutes of regular council meeting held in the city municipal building, October 23, 1984. Present: Mayor John 0. Cotant, Jr., Councilmembers Leroy S. Quick, Thomas S. Nield, Steven M. England, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Councilwoman Becky A. Hopkins was excused. Meeting called to order at 7:30 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the minutes of October 9, 1984. Councilman Nield moved to approve the minutes of October 9, 1984 as written. Councilman England seconded. All councilmembers present voted in favor of the motion. GROUP W FRANCHISE AGREEMENT - Mr. Dean Jones, Group W Cable's Pocatello manager was present to anwser any questions Mayor Cotant and Council might have. Attorney Winmill was asked at the October 9 council meeting, to review the Group W Cable Franchise Ordinance and present his comments at the October 23 council meeting. Attorney Winmill presented his comments on the following; Access Channels, Cable Commission, Description of Basic Services, Rate Regulation, Extention of Services, Compliance with Technical Standards, Performance Evaluation, Use of Public Ways, Rate of Compensation, Censorship, Annual Report, Door to Door Solicitation, Grounds for Termination and Penalties. After considerable discussion about the above comments it was decided that Attorney Winmill would meet with Dean Jones and redraft the Group W Franchise Ordinance and present at the November 13, 1984 council meeting. PUBLIC HEARING RECORDER - Mr. Dale West, Yost Office Supplies was present to demonstrate a Lanier III recording system. Mr. West quoted $2,421.90 for the Lanier Advocate III and $715.50 for the Lanier Transcriber. After discussion it was decided to direct City Clerk Ron Conlin to call various judges in the area that have purchased the system, if the -report -is good, -go ahead and purchase the Lanier Advocate III recording system. ORDINANCE #259 - An ordinance of the City of Chubbuck, Idaho, providing for change of land use district with respect to certain lands within the boundaries of the City of Chubbuck located in the SW 4, Section 2, Township 6 south, Range 34 E.B.M., from Agricultural (A) to limited Residential (R-1). Mayor Cotant read Ordinance #259 in full. Discussion about legal discription. After discussion Councilman Quick moved to dispense with the rule of reading the ordinance on three seperate occassions. Councilman Nield seconded. Roll Call Vote: Quick, yes; Nield, yes; England, yes; Hopkins, Absent. Councilman Quick moved to adopt Ordinance #259 as read. Councilman England seconded. Roll Call Vote: Quick, yes; Nield, yes; England, yes; Hopkins, Absent. 119 PROCLAMATION - FAMILY WEEK - Mayor Cotant proclaimed the week of November 18-24, 1984 as Family Week. Mayor Cotant read the proclamation in full. Councilman England moved to proclaim the week of November 18-24, 1984 as Family Week. Councilman Nield seconded. All councilmembers present voted in favor of motion. ORDINANCE #260 - An ordinance of the City of Chubbuck, Idaho, amending Ordinance #60. to provide that all garbage wastes collected by the City shall be placed in approved paper ico,�n,tainers or in approved mechanically dump containE Councilman Nield read Ordinance #260 in full. Councilman Quick made motion to dispense with the rule of reading the ordinance on three seperate occassions. Councilman Nield seconded. Roll Call Vote: Quick, yes; Nield, yes; England, yes; Hopkins, absent. Councilman England made motion to adopt Ordinance #260 as read. Councilman Quick seconded. GENERAL DISCUSSION 1) Taxi Cab Ordinance - It was decided to move to November 13 council meeting agenda. 2) Security Officer Ordinance - It was decided to move to November 13 council meeting agenda. 3) Capital Improvement Ordinance - It was decided to move to November 13 council meeting agenda. 4) Engineer Smart gave a report on man hours the City has recieved from the Work Release Program. Engineer Smart stated the City has recieved over 50 man hours. 5) Discussion about delivery of sanitation bags quarterly. 6) Discussion about 4 hand held radios and 1 VHF radio that was budgeted for the Fire Department. 7) Attorney Fees. HANDCHECK CLAIMS - Handcheck Claims were presented to Mayor Cotant and Council. After discussion Councilman Nield moved to approve claims as read. Councilman England seconded. All councilmembers present voted in favor of motion. At 10:15 p.m., Councilman England moved, Councilman Quick seconded, with full council approval to adjourn meeting. John 0.
