HomeMy WebLinkAbout02 22 1983 CMCOUNCIL MEETING MINUTES February 22, 1983 Minutes of the regular council meeting held in the city municipal building, February 22, 1983. Present: Mayor John 0. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A. Kinghorn, Thomas S. Nield, LeRoy S. Quick, Attorney B. Lynn Winmill, City Clerk Vera C. Armstrong. Public Works Director Steven M. Smart excused from meeting. Meeting called to order at 7:35 p.m. by Mayor Cotant. Inv6cation rendered by Brother Lloyd Monroe of the Church of Jesus Christ of Latter Day Saints. Approval of Minutes: Mayor Cotant asked for corrections or additions to council meeting minutes of February 8 and 15th. Councilman Nield moved to approve minutes of February 8 as written. Councilwoman Hopkins seconded motion. All councilmembers voted in favor of motion. Mayor Cotant asked for corrections or additions to minutes of council meeting February Y5. Councilman Kinghorn moved to approve minutes of February 15 as written. Councilman Quick seconded motion. Vote was unanimous in favor of motion. BUSINESS LICENSE - Dorian B. Bowen, has applied for a business license to sell warehouse tools out of a van at the Roadrunner Travel Shop, 4260 Yellowstone. Mr. Dorian Bowen was present to inform council of the particulars in regard to his application. Councilman Nield moved to approve the business license application of Dorian B. Bowen subject to the attorney's review of the city ordinances, making sure the license approval does not conflict with any existing ordinances. Councilman Quick seconded motion. Vote was unanimous in favor of motion. COCA COLA VENDING MACHINE PROPOSAL - Steve Oyler, representing the Coca Cola Bottling Company of Pocatello, Inc., proposed to place one vending machine for soft drinks for the City of Chubbuck at the Stuart Park during the months of May through September. Councilman Nield asked if Coca Cola Bottling Company would provide a certificate of insurance, naming the City of Chubbuck as an insured. Mr. Oyler said they would. 27 After some discussion, Councilman Nield moved to approve the agreement with Coca Cola Bottling Company of Pocatello, Inc. to place a soft drink vending machine for the City of Chubbuck at the Stuart Park, with the following provisions; 1) price per can to be fifty cents (.50). COCA COLA VENDING MACHINE PROPOSAL cont'd - 29 2) provide city with certificate of insurance constantly kept in force, naming City of Chubbuck as an additional insured, 3) that the city has no responsibility of upkeep, 4)only cans with flip top (outside -in tabs) be used in the machine, 5) city's profit to be sixteen (.16) cents per can, 6) that Coca Cola Bottling Company would not have exclusive rights of disposition of beverages at park. Councilman Kinghorn seconded motion. All councilmembers voted in favor of motion. BEER AND WINE SALES IN RESTAURANTS - Restaurant manager Richard Albee of the Sea Galley Restaurant appeared before the city council request- ing the council to consider allowing the sales of beer and wine in restaurants in Chubbuck on Sunday. Manager of Me -N -Eds Pizza and the Oxbow Inn Restaurants were also present. Mr. Albee told council that it is difficult for him to compete with the restaurants in Pocatello when they cannot serve wine and beer with meals. Manager of Me -N -Eds Pizza also voiced his request to be able to serve beer and wine on Sundays, reporting that his business is not nearly as good on Sundays as other days. Councilamn Quick voiced opinion he would like to go to the citizenry on their feelings. Councilman Nield voiced the same opinion. Councilman Kinghorn told those present that the manager of Me- N -Eds Pizza had asked the council at their last appearance for this same request, if the council had a religous reason for denying the request. Councilman Kinghorn informed all present that he would like to comment that it so happens that the mayor and members of the council are Latter Day Saints and do not believe in drinking alcoholic beverages, however, he wanted the restaurant owners to know that the mayor and council do not believe in forcing their choices on anyone else. Councilman Kinghorn also told of the problems the city had with beer sales on Sunday several years ago. Council discussed regulating the hours and also limiting the sales with meals only. Attorney Winmill offered to research the possibility of regulating the hours and limiting the sales with meals only, if council desired. Mayor Cotant told the restaurant owners the council would take this request under advisement and give it further consideration. APPEALS BOARD - Councilman Hopkins moved to approve the creation of an appeals board for the Uniform Building Code, Uniform Fire Code, "— and Life Safety Code, to compose of the following individuals recommended by Building Inspector Dan Stuart, 1) Bob Mitchell, Pine Ridge Manager, 2) Boyd Fullmer, Insurance Agent, 3) Peter Anderson, Architect, 4) Mike Scott, Contractor, 5) Cary Campbell, Fireman, 6) Monty Egbert, Student Civil Engineering Technicion, but that the actual 31 APPEALS BOARD cont'd - board will be restricted to five individuals, four of whom are taken from the appointed list and the fifth of which will be chosen, if possible, from either the State or adjoining community's inspection bureau responsible for making inspections under the relevant code, with the Mayor making the designation of who sits on which Appeals Boards. Councilman Quick seconded motion. All councilmembers voted in favor of motion. GENERAL DISCUSSIONS: 1) Joint park development with School District. 2) Police Department work. 3) Land Use Development Ordinance, Mayor Cotant announced this would be continued until council meeting March 1.
