Cotant, Jr., Councilwoman Becky A. Hopkins, Councilmen Dwain A. Kinghorn, LeRoy S. Quick, Engineer Steven M. Smart, City Clerk Vera C. Armstrong. Councilman Earl L. Romriell and Attorney Donald L. Burnett, Jr., excused because of illness. Meeting called to order at 8:00 p.m. by Mayor Cotant. Mayor Cotant asked for corrections or additions to minutes of January 8 and January 15. Councilman Kinghorn moved, Quick seconded with an unanimous vote in favor that minutes of January 8 and January 15 be approved as written. DAY CARE CENTER QUESTION - Mayor Cotant invited Mr. and Mrs. George W. Guardipee to council meeting to inquire of reports city has received concerning operation of a day care center and that auto repairs are being made at their address of 5002 Elizabeth. Mrs. Guardipee told the mayor and council that concerning the day care center, she is only caring for two children. Mr. Guardipee said that in regards to the auto repairs, he only repairs his own vehicles and the vehicles owned by his sons. Mayor Cotant thanked Mr. and Mrs. Guardipee for attending the meeting. WAIVER OF PLATTING REQUIREMENT - McKEE'S FEED AND GARDEN CENTER - William McKee has requested a waiver of the platting requirement in regards to the development of his proposed retail store on Evans Lane. The Land Use and Land Development Commission met Thursday, January 17 and recommended approval of the waiver. Councilman Kinghorn moved, Councilman Quick seconded, to grant the waiver of the platting requirement to William McKee for the development of the McKee's Feed and Garden Center. Voting was unanimous in favor. PRODUCTION DWELLING COURT - Joseph R. Osier presented a plan of his proposed court showing the layout of lots with varying square footage of from 4700 to 5200. The plan has two cul -de -sacs and Mr. Osier informed city that all mobile homes will be double wide with gable roofs. After a thorough review and discussion, Councilman Quick moved to delete conditions #3, 8, and 11 as previously set forth in meeting of December 11, 1979, and to amend conditions #3, 8, and 11 to read as follows: 3) Paralell parking of mobile homes to the street on 36 lots, balance of 38 lots may be placed perpendicular to street as shown on drawing submitted. 8) Comply with General Residential (R -2) requirements in the Land Use Ordinance except as follows; side yards must have a total of fourteen foot with a minimum of five foot on one side, a fifteen (15) foot minimum front yard setback and a fifteen (15) foot minimum rear yard, lots to be a minimum of 5,000 square foot with the exception of seven lots, six of which are approximately 4700 square foot and one of approximately 4841 square foot, approval of forty (40) foot width streets to the entrance of the RV storage and the cul -de -sac streets, cul -de -sac radius to be thirty. (30) foot, all as shown on sketch on file. All units will be single family dwellings. PRODUCTION DWELLING COURT - cont'd 15 11) Developer to buy pipe and materials and install along Hawthorne Road from intersection of Chubbuck Road and Hawthorne to the southern point of developers property, water lire to be 12 inch. Councilman Kinghorn seconded motion, all councilmembers voted in favor. MOUNTAIN PARK SUBDIVISION - Mary Bunce and Mary Beth Alder requested the city install some street lights in the occupied portion of their subdivision. Mayor Cotant said the city would check out and order some lights to be put in operation. Mrs. Alder asked if the city had received the grant for development of Mary's Park. Engineer Smart said the city had applied for a grant on Mary's Park but it was not approved for fiscal 1980 and the city would need to re -apply in May of this year. FIRE PROTECTION BID - Mayor and Council discussed bidding fire protection for the Northern Bannock County Fire District and the Pocatello Valley Fire District. Mayor Cotant asked Engineer Smart to contact Attorney Burnett and prepare a bid to submit to the Bannock County Commissioners by the bid deadline of 1:30 p.m., Wednesday, January 23. Councilman Kinghorn moved to approve a check in the amount of 5% of fire protection bid as bidders security and approve bidding the fire protection of the Northern Bannock County Fire Protection District and the Pocatello Valley Fire Protection District. Councilwoman Hopkins seconded motion with an unanimous vote in favor of motion. PROPOSED AMENDMENTS TO POLICE DEPARTMENT POLICY AND PROCEDURE MANUAL Attorney Burnett has recommended amending Section 1104 of the above mentioned manual. Chief Stone has received some revised sections to the policy from the State Law Enforcement and will submit to Attorney Burnett for city consideration. Mayor and council decided to meet January 29 on this matter. COMPENSATION FOR LAND USE AND LAND DEVELOPMENT COMMISSION - Councilman Quick moved to make compensation to the Land Use and Land Development Commission on a quarterly basis at the rate of $10.00 per month, regularly scheduled meeting attendance required to receive compensation. Councilman Kinghorn seconded motion. All council members voted in favor. BUILDING OFFICIALS SHORT COURSE - Building Inspector has presented a claim for $70.00,for dues to the International Conference of Building Officials @$25.00 and for fee for a short course at Idaho State University @$45.00. Councilman Quick moved to approve claim of $70.00 to pay the building official dues and the short course fee. Councilman Kinghorn seconded motion - R11 c -incil members voted in favor. 17 GENERAL DISCUSSIONS 1. Dinner for fire department volunteers. Mayor Cotant told council the fire department had asked the city to pay for a dinner they would like to have. Council in agreement that city cannot do this, as this falls in the same line as employee Christmas dinner, which the Attorney General opinion ruled against. 2. Waiver of portion of building permit fee - Mayor Cotant informed council that a certain contractor has asked for city to only charge the building permit fee as set in the 1976 building code which was in force when he inquired of building permit fees. Since then the city has adopted the 1979 UBC with the higher fees. Council members present in full agreement that city needs to charge the rate set in the 1979 UBC, 3. Moving of trees to Mary's Park - Mary Bunce and Mary Beth Alder asked council if the city planned to move the evergreen trees that Noel Breneman has said he would donate to the Mary's Park. Mrs. Bunce, Mrs. Alder and city to investigate the cost of moving the trees and also the chances of trees surviving.
