COUNCIL MEETING MINUTES
August 22, 1989
Minutes of a regular meeting held in the city municipal building,
August 22, 1989.
Present: Mayor John 0. Cotant, Jr., Councilmembers Steven M. England, David A. Landon,
Dwain A. Kinghorn, Attorney Thomas J. Holmes and City Clerk Ron C. Conlin. Council-
man Leroy S. Quick and Public forks Director Steven M. Smart was excused.
Meeting was called to order at 7:25 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections to the minutes
of August 8, 1989 and Special Meeting Minutes of August 15, 1989.
Councilman Kinghorn moved to approve the minutes of August 8, 1989 as read. Council-
man Landon seconded. All councilmembers present voted in favor of motion.
Councilman Landon moved to approve the Special Meeting Minutes of August 15, 1989 as
read. Councilman England seconded. All councilmembers present voted in favor of
motion.
LARRY FULLMER, 555 BONANZA was present to complain about an activity at Cotant Park
adjacent his address at 555 Bonanza on August 13th and August 20th.
Mr. Fullmer stated there was an incident August 20, 1989, where people from Idaho
Falls and Blackfoot came to Cotant Park to play soccor. Mr. Fullmer stated when he
returned home, these people were in his yard picking apples off his tree, using his
yard as a restroom facility and broke his fence.
Mr. Fullmer asked the Council to consider installing a 6' wood fence to protect his
property from this type of activities.
These particular soccor players did not have permission to use the fields.
After discussion, Council was in agreement that a 6' wooden fence be installed along
this property at Teton and Ponderosa Rds.
Asst. Police Chief Jerry Rowland said there will be extra patrol in the area; during
soccor activity.
PUBLIC HEARING - 1989 -90 FISCAL YEAR BUDGET.- City Clerk Ron Conlin read through the
public hearing notice.
Mayor Cotant declared the public hearing open.
Mayor Cotant asked for comments from the public, there being none, Mayor Cotant
closed the public hearing.
ORDINANCE #321 - An ordinance of the City of Chubbuck, appropriating the several sums
of money deemed necessary and sufficient to defray all expenses and liabilities
of the City of Chubbuck,for the fiscal year beginning on the 1st. day of October,
1989 and ending on the 30th day of September, 1990, and designating the different
funds to which shall be drawn and paid, and known as the "Annual Appropriation
Ordinance of Fiscal Year 1989 -90" pursuant to the provisions of Section 50 -1003, Idaho
Code: providing for this ordinance to take effect after its passage, approval and

Mayor Cotant read Ordinance #321 in full.
Councilman Landon moved to dispense with the rule of reading Ordinance #321 on
three separate days. Councilman England seconded. Roll Call Vote: Quick, absent;
England, yes; Landon, yes; Kinghorn, yes.
Councilman Kinghorn moved to adopt Ordinance #321 as read. Councilman England second-
ed. Roll Call Vote: Quick, absent; England, yes; Landon, yes; Kinghorn, yes.
RESOLUTION #6 -89 - Be it resolved by Mayor Cotant and Council, to pay the estimated
expenses of said City, that there be levied against all the taxable property of the
said City, the following amounts for Fiscal Year 1989 -90 and that the same be certifier
to the County Auditor of Bannock County.
Mayor Cotant read Resolution #6 -89 in full.
Councilman England moved to adopt Resolution #6 -89 as read. Councilman Landon second-
ed. All councilmembers present voted in favor of motion.
ORDINANCE #322 - Amending Chubbuck Code Section 9.20.090, as amended by Ordinance #307
and #314 to clarify that livestock must still comply with the provisions of the
Land Use Ordinance.
Mayor Cotant read Ordinance #322 in full.

BID - Sealed bids for approximately 385 Tons of 0.1' asphalt pavement overlay was opened
August 16, 1989 at 2:00 p.m. The asphalt pavement overlay is for Parrish Lane.

Councilman Kinghorn moved to direct Mayor Cotant to enter into agreement with
Bannock Paving for approximately 385 tons of 0.1' asphalt pavement overlay for
Parrish Lane.at $28.50 per ton. Councilman Landon seconded. All councilmembers
present voted in favor of motion.

After discussion, Councilman England moved to approve computer print -out and
handcheck claims as read. Councilman Kinghorn seconded. All councilmembers present
voted in favor of motion.
At 8:05 p.m., Councilman Kinghorn moved, Councilman Landon seconded, with full
council approval to adjourn meeting.

In reviewing older City Council Meeting Minutes the City Staff found that the August 22, 1989
minutes had not been signed. When this has happened before, City Staff made a note of the
approval of the unsigned minutes in a subsequent meeting and the recording of that approval in
the subsequent meeting minutes.
When City Staff prepared to do this for the minutes of August 22, 1989 they found a scribners
error in the September 12, 1989 minutes. In the September 12, 1989 minutes, rather than stating
the approval of the previous meeting minutes of August 22, 1989 it says council approved the
minutes of September 12, 1989, which is impossible as the meeting was just taking place.
This explanation is included with the August 22, 1989 minutes as they were not signed but were
approved September 12, 1989.
