COUNCIL MEETING MINUTES
SEPT~]~BER24, 1974
Minutes of the regular meeting of the Mayor and Council held in the City Municipal
Building September 24, 1974.
Present: Mayor John O. Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard, Earl
Romriell and Wayne Taylor. Attbrney Don Burnett and Clerk Vera Armstrong.
Minutes of August 20, September and September 12 meetings approved with the
following addition to September 12 minutes under heading MOBI~E MANOR REZONING;
Councilman Romriell suggested these lots be granted a variance to allow placement
of trailers instead of the rezoning. The matter was discussed with no action.
MANPOWER PROGRAM - Rod Watkins, Association of Idaho Cities explained the Ceta ll,
Comprehensive ~mployment Traing Act Program. The program provides for federal
funds to pay salaries of new employee from entry level through June 30, 1975~
when program ends and then the city picks up all expenses. Funding salaries is
based on per capita basis which wou~d .allow the City of Chubbuck approximately
$4,000.00, however, additional funding will probably be available if necessary.
Mayor Cotant informed Mr. Watkins the council would consider the city's need
and contact him later.
MOB~.EMANOR 1st ADDITION - Max and Kent Parrish representing Land Investment, Inc.
presented the final subdivision plat of Mobile Manor 1st Addition for approval.
Approval of Planning and Zoning commission was acquired by telephone poll.
Councilman Kinghorn moved the city approve Mobile Manor 1st Addition. Council-
man Menard seconded motion with an unanimous vote in favor of motion.
BANNOCK HUMANE SOCIETY - Linda Evans, representing Bannock Humane Society told
Mayor and Council she was present to ask for a donation on their proposed animal
shelter of $10,000.00. Mrs. Evans stated she had talked to Dr. Mutchison
and he had told her he would be unable to care for the animals for Chubbuck much
longer. Mrs. Mans suggested an intra-city licensing program whereby they take
care of the licensing. The new animal shelter will be built on upper level of
Ross Park. Council and Mayor questioned distance this would entail in Chubbuck's
use of the shelter. Mr. Trego was also present and added the location was just
off the interstate which would cut down the travel time.
Mayor Cotant informed Mrs. Evans the council would consider her request.
LEASING PROPERTY EAST OF CITY PROPERTY - Farrell Polle, owner of the property at
136 Hiway Avenue was present. Mr. Poole stated hw would be interested in
leasing the acreage just east of the city building. Mr. Poole told council he
would expect a fence to be installed around the property. Mayor and Council
discussed whether this sould be chain link or solid screen fence.
Mr. Poole suggested a lease price of $75.00 per month with Councilman Taylor
stating he felt $50.00 should be adequate compensation. Mayor and Council
told Mr. Poole that both parties could think the proposal over for consideration
later.
ORDINANCE # 136 - Providing for certain lands in Mobile Manor, Lots 1 thru ll, Block
i and Lot i Block 4 to be rezoned from Residential 2 to Residential -2 Trailer.
Mayor Cotant read ordinance in full. Motion to dispense with rule of reading on
three separate days made by Councilman Menard and seconded by Councilman Taylor.
Roll call vote: Kinghorn, yes; Menard, yes; Romriell, no; Taylor, yes. Councilman
Kinghorn moved to approve Ordinance #136 with Councilman Menard seconding motion.
Roll call vote: Kinghorn, yes, Menard, yes; Romriell, yes; Taylor, yes.
Roduey Parrish again questioned council about the direction to place trailers
on the rezoned lots. Mayor and Council informed Mr. Par~ish the trailers
.would need to set paralell with East Chubbuck Road

POCATELLO INDUSTRIAL PARK ACCESS ROAD.- Mayor and Council discussed the
hazard of the location of the proposed access road to the new Pocal~llo
Industrial Park, southeast o£ Interstate 15 West.
ORDINANCE # 137 - Postsale Ordinance concerning a Bond Series desi~ated
as the "City of Chubbuck, Idaho, Sewer Revenue Bonds, Series October 1,
1972," in the aggregate principal amount of $1,000,000.00, for the pur-
pose o£ defraying wholly or in part the cost o£ acquiring and constructing
a municipal sewerage system for the city; accepting the lowest and best
bid for the purchase of the bonds.
Councilman Romriell moved the adoption of Ordinance //137 - Ordinance
was read in full by Deputy Clerk Dorothy Ward. Motion to dispense with
rule bf reading on three separate days made by Councilman Kinghorn,
Taylor seconded. Roll call vote; Kinghorn, yes; Menard, yes; Romriell,
yes; Taylor, yes. Councilman Menard seconded the motion for adoption
of Ordinance f~-57. Roll call vote; Kinghorn, yes; Menard, yes; Romriell,
yes; Taylor, yes.
It was moved by Councf_lman Taylor, seconded by Councilman Romriell that the
Clerk of the City be ordered to publish ordinance in full and in at least
one issue of the Idaho State Journal. Roll call vote: Kinghorn, yes;
Menard, yes; Romriell, yes, Taylor, yes.
WATER STORAGE TANKS - Councilman Menard suggested the city make a move towards
proposed water storage. Mayor Cotant suggested to council the city plan
for one million gallon storage and try to keep the water improvements
under $200,000.00. Ail councilmen were in accord to ~his proposal by Mayor.
PORTNEUFF~-E~.LI~°J~RY - Doris LYman informed Mayor and Council they were interested
in building their new library in the Chubbuck area. Ms Lyman said they were short
of funds and requested the city's help in installing the sewer and water lines
and perhaps stubbing in the street.
John Valenty~ also representing Portneu£ Free Library told the Mayor and Council
the property was sold to them at a price quite reasonable and they di~n'% know
if Clark would participate on street construction.
Mayor Cotant suggested the city help by doing construction o£ water and sewer
lines and perhaps cutting the street. The council were in agreement and informed
Ms Lyman and Mr. Valenty the city would cooperate to this extent on costs.
SALE OF CITY PROPERTY AT ~ YELLOWSTONE - Attorney Burnett reported on sale of
city property. Property needs to be appraised, there needs to be a sixty (60)
day waiting to File petitions protesting sale iff someone so desires and then
the property put up for invitation for bids. Property should then be sold by
auction to the highest bidder but not lower than the appraised amount. City
has option o£ accepting or rejec.iing all bids.
Attorney Burnett has prepared Ordinance ~138, expressing an intent to sell this
real property owned by the city. Ordinance ~138 was read in full by Attorney
Burnett. Councilman Menard moved to dispense with rule of reading on three sep-
arate days, Kinghorn seconded. Roll call vote: Kinghorn, yes; Menard, yes;
Romriell, yes. Motion to adopt Ordinance #138 made by Councilman Menard as
read and seconded by CouncilmaD Taylor. Roll call vote: Kinghorn, yes;
Menard, yes; Romriell, yes; Taylor, yes.
SPE~,DING TICKET - Mayor Cotant questioned Attorney Burnett of a speeding ticket
being dismissed that was issued by a Chubbuck police officer on private property
in the Circle In Trailer Court. Attorney Burnett said he would research this.

M~VING OF OLDER HOUSE TO EAST CHUBBUCK ROAD - Rodney Parrish asked the council if
the city would approve for moving of ~is house. ~ Mayor Co%ant read the
letter to Mayor and Gonnc~l from the building inspector suggesting a set of
plans, new wiring and plumbing and the required bond. Councilman Menard told
Mr. Parrish a permit can be issued when he complies with plans and required
bond requested by building inspector.
LEGAL CORRESPONDENCE - Attorney Burnett reviewed several copies of correspondence
he has taken care Sf for the city.
AMeNDMEnT TO SUBDIVISION ORDINANCE - Attorney Burnett prepared some proposed
amendments to Subdivision Ordinance. Councilman Romriell suggested the
Planning and Zoning Commission review the proposed amendments at their
next regular meeting.
