Present: Mayor John O. Cotant, Jr., Counc21men Dwain Kinghorn, Jack Menard and Emrl R~iell. Attorney Don Bmmett and Clerk Vera A~rtstrong. ~Meeting c~l~ed to order at 8:00 p. m. by Mayor Cotant. PUBLIC HEARING ±TEM: Rezoniug request of Kent J. Parrish, President of Mobile Attorney Burnett read Lu f~ll the Articles of Restrictive Covenants prepared by o Max Parrish and Mobile Manor officers. Mayor, Council and the Mobf_le Manor officers felt it would be unwise to extend ~ the distance that residents would become part of the restrictive covenant ~ enforcement group. l~s. Moore also mentioned they felt the roof pitch was quite low. Mayor and Council told Mrs. Moore they f~lt the 2 to 12 pitch was quite acceptable for .im°o~'e--'~ homes. Mauor, Inc., for lots 1 thru 11, Block 1 and Lot I Block 4, Mobile Manor Subdivision which was tabled at September l0 council meeting was again discussed. Mrs. Verda Moore has taken a copy of the Articles of Restrictive CovenanSs)to her Attorney's office for review. Attorney Racine was out of town but counsel in Mr. RacineSs office recon~nended to have the years extended that the Articles of Restrictive Covensnts would be effective beyond 1992. Other recommendations were to have residents on East Chubbuck Road, other than directly across from Lots, become part of those able to modify, repeal or change any of theRestrictive Covenants. Attorney Burnett requested the residents on north side of East Chubbuck Road, or directly across the street be named as third party beneficiary. Attorney Burnett also suggested the time of effectiveness of the Restrictive Covenants whichwf]] terminate in 1992, be extended by 5 year intervals indefinitely by a majority vote of lot owners or home owners directly across th~ street. A ~ong 4iscussion followed as to whether a decision should be made this evening. Mrs. Moore requested time for them to contact Attorney Racine. Counc~m~. Menard moved the council direct Attorney Burnett to draw up an ordinance to rezone Lots 1 thru ll, Block 1 mad Lot 1 Block ~ Mobile Manor Subdi~sion from Residential 2 to Residential 2-Trs~] er Zone. Councilman Romriell seconded motion. Ail Councilmen voting in favor of motion. WATER PIPECLAIM: Fred Chase of Blue Ribbon Homes has requested a payment of his cost of installing eight inch pipe instead of s~x inch pipe in Country Acres ~th Addition. Blue Ribbon Homes presented claim in amount of $2,015.6~. Councilman Romre~l] moved the city approve claim to pay Blue Ribbon Homes the additional cost of installing eiEht inch pipe as requested by city in Country Acres ~th Addition. Counc~lmanMenard seconded with an unanimous vote in favor of motion. INSTAT3.ATION OF POWER LINE: Idaho Power Company has requested concurrence of a conditionsl use to sllow the installation of a power liue from the Terry S~bstatim:, located at the intersection of BuckskiuRoad and Interstate Highway 15, and is proposed to run through Chubbuck, comiug into Chubbuck Road at Jack Menard~s house, running west to Whitaker Road and north on Whitaker to Siphon Road to the Siphon Substation. 105 Councilman Kinghorn suggested the line go north from Jack Menards to Siphon Road and then west to Siphon Substation, thus missing the two prime residential areas on East Chubbuck Road and Whitaker Road. Mayor Cotant said he would contact Mr. Spafford and request Idaho Power Company go directly north to Siphon Road and then continue west on Siphon Road as their plan shows. SUBDIVISION ORD]i~ANCE: Attorney Burnett told council he felt the Subdi~-ision ordinance may need to be amended to give council more enforeement power. WATER HOOK-UP: Bart Parrish requested city insts]] some water hook-up in Mobile Manor Addition #1. Mayor and Council informed Mr. Parrish he conld apply for the water hook-ups and they would be made. CITY PROPERTY AT 4545 YELLOWSTONE: Mayor and Council discussed putting this property up for sale. Councilman RomrieL1 moved the property at 4545 Yellowstone be sold and the necessary steps be taken to put the property up for bid. Concilman Menard seconded motionwith all councilmen voting in favor of motion. IDAHO CODE BOOKS: Attorney Don Burnett questioned council about acquiring ~he Idaho Code books for the city, especially the ~olice Department. City Clerk has ordered these. Attorney B~rnett was given approval to call about order and if not available to secure the books from another source. BURNED OUT TRAWgRS: Attorney Ikurnett informed council he has talked about an agreement to be prepared with the Parrishes and Mayor Cotant about moving trailers onto Residential 2- Trailer property for repairs. It was suggested that no ~ignmificant outside dsmage be ~isible and possibly not over 25% interior dsmage. Attorney Burnett ~ld:. he would draw up the stipulation. IDAHO METAL FINISHING CLAIM: Councilman Romriell asked Attorney B~rnett what had happened to the Idaho Metsl Finishing Claim. Attorney Burnett informed council that it is still pending. LAMAR ARMSTRONG MANHOLE CHARGES: Attorney Burnett reported the Armstrong complaint has been prepared and will be filed. HANDY SERVICE TRA]~ER: Attorney Burnett also reported Mr. Henry had agreed to move his trailer as soon as he finds an available trailer space. Meeting recessed at 9:40 P.M. V~era C.
