HomeMy WebLinkAbout08 08 2000 CM113 COUNCIL MEETING MINUTES August 8 ", 2000 Minutes of a regular meeting held at the Chubbuck City Council Chambers, August 8`h, 2000. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. INVOCATION was given by Pastor Holder, The Pioneer Bible Baptist Church. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to Special Meeting Minutes of July 25`h, 2000 and Regular Meeting Minutes of July 25`h, 2000. Councilman Kearns moved to approve the Special Meeting Minutes of July 25`h, 2000 and Regular Meeting Minutes of July 25', 2000 as read, Councilman Gunter seconded. All council members present voted in favor of motion. PUBLIC HEARING - An application by Michael and Gwen Baker, 218 W. Chubbuck Road, Chubbuck, Idaho for a change of Land Use District, from Dense Residential, (R -4) to General Commercial, (C -2) for the purpose of parking track/tractors and truck servicing. Mayor Cotant stated the application by Michael and Gwen Baker has been withdrawn. Werner Rosenbaum, 258 W. Chubbuck Road expressed concern that even though the Land Use & Development Commission recommended approval of the application to the Council, the use would never be allowed. Mr. Rosenbaum felt that if City Staff would have told Mr. & Mrs. Baker what the requirements would have been, they would not have requested the zone change. PUBLIC HEARING - ORDINANCE - Creating a new Chapter 18.13 of the Chubbuck Municipal Code, pertaining to personal wireless telecommunication facilities, and including a purpose statement, definitions, compliance with Chapter and non - conforming uses, exemptions, a policy statement, site selection criteria, priority on public property and siting requirements, co- location and design criteria, permit inspection requirements and landscaping requirements, non -use and abandonment provisions, third party review, and remedies, and providing for rescission of the moratorium on certain wireless telecommunication facilities. 115 COUNCIL MEETING MINUTES - (cont.) August 8`", 2000 Mayor Cotant declared the public hearing open, there being no comment, Mayor Cotant closed the public hearing. Attorney Holmes read ordinance by title only for the first reading. Council tabled the ordinance until the August 22"d, 2000 Council Meeting. AMENDED PLAT OF GARDEN PARK SUBDIVISION - Ken Pape, Garden Park Developer explained why the need to amend the plat. PWD Smart recommended approval of amending of the Garden Park Subdivision Plat. Councilman Kearns moved to approve the amended Garden Park Subdivision Plat as presented, Councilman Quick seconded. All council members voted in favor of motion. MYSTIQUE SUBDIVISION FINAL PLAT - Tim Shurtliff, Shurtliff Engineering, 426 W. Lewis stated the Mystique Subdivision, (formerly All Seasons property) is being divided into three lots, the Mystique Restaurant, the existing All Seasons building and a lot behind the All Seasons building. PWD Smart recommended approval of the Mystique Subdivision Final Plat. Councilman Kearns moved to approve the Mystique Subdivision Final Plat as presented, Councilman Gunter seconded. All council members voted in favor of motion. CLAIM - Bannock Paving for West Chubbuck Road Construction Project - Hand check in the amount of $182,513.55. Councilman England moved to approve a hand check claim to Bannock Paving Co. in the amount of $182,513.55, Councilman Kearns seconded. All council members voted in favor of the motion. CLAIM - Computer print -out claims presented to Mayor Cotant and Council. FINANCIAL REPORT for the month of June, 2000 was presented to Mayor Cotant and Council. 117 COUNCIL MEETING MINUTES - (cont.) August 8`'`, 2000 2000 -2001 FISCAL YEAR TENTATIVE BUDGET - City Clerk Ron Conlin presented the 2000 -2001 FY Tentative Budget as follows: General Fund $ 4,083,189. HS &R Fund $ 572,827. Sanitation Fund $ 675,580. Waterworks Fund $ 1,233,752. Sewer Fund $ 980,075. Special Revenue Fund $ 5,000. Central Garage Fund Transfer $ 38,650. $ 7,589,073. Councilman Kearns moved to approve the 2000 -2001 FY Tentative Budget as presented, Councilman Gunter seconded. All council members voted in favor of motion. WEST CHUBBUCK ROAD CONSTRUCTION PROJECT DISCUSSION - Mayor Cotant and Council invited residents on West Chubbuck Road from Hawthorne to Joy Street for a discussion about road construction on W. Chubbuck Rd. and how it will affect them. Craig Lamburdy, Bannock Paving Co. explained Bannock Paving's plan on construction of W. Chubbuck Road from Hawthorne Road to Joy Street. PWD Smart passed out temporary and permanent easements for the residents to review and comment on. Concerns residents expressed the follow concerns: Construction speed limits - Several residents complained about lack of speed limit enforcement in the construction zones. Bannock Paving will talk to their people about the construction zone speed limits. The construction area will be posted and enforced. 2. Residents asked who is coordinating the construction work on private properties. Residents were told Rodney Birch, Rocky Mountain Engineering is the person to contact on questions regarding private property issues. Residents asked if there will be a signal installed at W. Chubbuck and Hawthorne Road. The underground and conduit will be installed, but because of excessive costs the light will not be installed at this time. 119 COUNCIL MEETING MINUTES - (cont.) August 81h, 2000 WEST CHUBBUCK ROAD CONSTRUCTION PROJECT DISCUSSION WITH RESIDENTS - (cont.) 4. Mail box placement discussion - Gang mail boxes can be used if residents want them. PWD Smart stated the City will get discuss with the post office. Mayor Cotant told residents present, if there are any questions call City Offices At 9:12 p.m., Councilman Gunter moved, Councilman Quick secon4ed, with full council approval to adjourn meeting.
