COUNCIL MEETING MINUTES
October 23`d, 2001
Minutes of a regular meeting held at the Chubbuck City Council Chambers, October 23`d, 2001.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting called to order at 7:32 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to the Regular
Meeting Minutes of October 9', 2001 and Special Meeting Minutes of October 17"',
2001.
Councilman Kearns moved to approve the Regular Meeting Minutes of October 9', 2001
and Special Meeting Minutes of October 17`', 2001 as read, Councilman Quick seconded.
All council members voted in favor of motion.
PUBLIC HEARING - An application by Sharon Knudsen, 2595 Hwy. 39, American Falls, Idaho
for a change of Land Use District to General Commercial, (C -2); Hawthorne Road, north
of I -86 and south of Redman Canal. Property is presently zoned Agricultural, (A). The
Land Use and Development Commission recommends approval.
Mayor Cotant declared the public hearing opened, there being no comment Mayor Cotant
closed the public hearing.
Councilman Quick moved to accept the Land Use and Development Commission's
recommendation to approve the application by Sharon Knudsen for a change of Land Use
District to General Commercial, (C -2); Hawthorne Road, north of I -86 and south of
Redman Canal, Councilman England seconded. All council members voted in favor of
motion.
DAY CARE FACILITY APPLICATION - Michelle Christy, Fun Time Friends, 941 Castle has
applied for a day care facility license to operate a day care facility at her residence at 941
Castle.
All departments checked off on the application.

Councilman England moved to grant Michelle Christy, Fun Time Friends, 941 Castle a
day care facility license to operate a day care facility at her residence at 941 Castle,
Councilman Kearns seconded. All council members voted in favor of motion.
RECOMMENDATIONS FOR GROUNDWATER PROTECTIONS MEASURES RESULTING
FROM THE EPA REGIONAL GEOGRAPHIC INITIATIVE GRANT -
John Welhan was present to discuss the graphic presented and present the following
recommendations:
1. Define critical areas over portions of the aquifer and adjacent areas that are
vulnerable and adopt management guidelines for these areas.
2. Expand ground water monitoring when new land use activities occur in
vulnerable areas.
3. Adopt more protective septic permitting regulations for new developments,
requiring approved septic systems or hook -up to sewer lines for higher density
developments.
4. Require registration/inspection of agricultural users and small - volume
generators of critical materials coordinated with existing state and federal
reviews.
5. Ban or severely limit the use of new injections wells (including dry wells) for
storm water disposal and adopt best management practices which encourage
biofiltration -based practices which encourage biofiltration -based practice.
6. Develop an inter - agency, inter - governmental agreement between Bannock
County, the cities of Chubbuck and Pocatello, and the Shoshone - Bannock Tribes
to cooperatively protect shared water resources under the same rules.
PWD Smart stated the recommendations were developed for this area based on similar
groundwater protections measures found throughout the world. Experience in the
Rathdrum Prairie aquifer in North Idaho and Eastern Spokane area have shown that
protection in three general areas took care of 85% of the problems. Those three areas are
septic systems, storm water, and fuel and chemical spills.
Councilman Kearns expressed concern about existing sewer septic tanks.

PWD Smart said the City still needs to come to a cooperative agreement with other
entities.
Mayor Cotant expressed concern about the areas in the north Bannock County that have
been there so long, they have their own wells and septic tanks, they have had problems in
the past.
John Welhan asked the Council to consider these recommendations, then let him know
the Council is interested in the recommendations presented.
Councilman Quick suggested this be discussed in the next Cities - County Meeting.
Council was in agreement to authorize Mayor Cotant to prepare a letter stating the City
Council is interested on pursuing the recommendation further.
ORDINANCE - Establishing Chapter 9.38 "Public Parks" to provide for the prohibition of
certain activities in parks.
Attorney Holmes read ordinance by title for the second reading.
Council tabled the ordinance until the November 13', 2001 Council Meeting.
ORDINANCE - Adding Chapter 15.54, flood damage prevention ordinance to the Chubbuck
Municipal Code to minimize losses due to flooding.

DESTRUCTION OF POLICE RECORDS REQUEST - Police Department requested the
following records be destroyed:
1. 1999 False alarm billing list.
2. Cris Reports 963451- 963500.
3. Cris Reports 962602 - 962650.
4. Cris Reports 962510- 962600.
5. Cris reports 964201 - 964250.
Councilman England moved to approve Police Department's request to destroy the 1999
False alarm billing list and Cris Reports as presented, Councilman Gunter seconded. All
council members voted in favor of motion.
RESOLUTION #7 -2001 - Agreement for Federal Aid Highway Project STP -7401 (100) - for
construction of Hiline Road, Flandro Drive to East Chubbuck Road..
PWD Smart explained the resolution.
Councilman Kearns moved to adopt Resolution #7 -2001 as read, Councilman England
seconded. All council members voted in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Quick moved to approve computer print -out claims as read, Councilman
Kearns seconded. All council members voted in favor of motion.
At 9:00 p.m., Councilman England moved, Councilman Kearns seconded, with full council
approval to adjourn meeting.
