HomeMy WebLinkAbout09 10 1974 CM 97 Minutes of the regular meeting of the Mayor and Council held in the city municipal building September 10, 1972. Present: Mayor gohn O. Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard, Earl Romriell and Wayne Taylor. Attorney Don Burnett and Clerk Vera Armstrong. Meeting¥.called to order at 8:00 p.m. by Mayor Cotant. PUB~.IC HEARING IT~: Dan E. and Ellen E. Ktmz have requested a conditional use permit to allow them to constz~zct a four plex tunit at ~21 Whitaker Road. Cottncil discussed the square footage per lot of four plex units and found the lots were adequate if 20 foot is allowed between the two units. Council discussed the curb, gutter and sidewalk requirement recommended by the Planning and Zoning Commission. Councilman Menard stated he wasn't sure curb and gutter should be required at this time. isc ssio After further ~oSunc~man Menard moved the council approve the conditional use permithwith the requirement a four foot sidewalk be installed along Whitaker Rd. Grade will be furnished by the city. Counc~&man Taylor seconded motion with all councilmen voting in favor of motion. $ PUBIC H~ING IT~I~: Kent J. Parrish, President of Mobile Manor, has requested Lots 1 th~u 11, Block 1 and Lot 1 Block 2, Mobile Manor Subdivision be rezoned from Residential 2 to Residential £ Trailer. This request was tabled at last eo~Lncil meeting. Mayor Cotant asked for comments from those present. R. B. Bistline stated he felt no action should be taken until the £ollowing complaints are handled on the present Mobile Manor Subdivision. Mr. Bistline in£ormed council streets are cracked and need repaired, weeds were cut but not removed, therefore more fire hazard now, fire hydrants on private property and suggested the city paint hydrants an illuminous yellow, street signs and stop signs need installed. Mayor Cotant informed Mr. Bistline signs have been ordered and Fire Chief has also suggested painting fire hydrants with light color illuminous paint. Max Parrish presented letters from two realtors stating new attractive mobile homes would not detract and depreciate the immediate area~any more than low cost housing-and would be a great improvement over the existing condition of the property. Rodney Parrish presented two plans for placement of trailers on these lots. Mayor Cotant suggested a gable end structured roof on the mbbile homes and for mobile homes to set paralell to street. Don Barnett remarked the Parrishes have gone to much work to prepare the plans and restrictive covenants for presentation tonight and he really don't know what to recommend. Mr. Burnett also added the residents on north side of Chubbuck Road should have been to this meeting. Max Parrish indicated they were not too pleased to be required to face mobile homes paralell with the street. Cou~cilmanMenard told Mr. Parrish the residents on the north side of Chubbuck Road have given up much and he f~t Mobile Manor, Inc. should also be willing to give up something. Mayor Cotant told the Mobile Manor officers he felt the residents on the north side of Chubbuck Road would accept the mobile homes if the homes would be required to be set with longest dimension of home paralell to Chubbuck Road, have the roof structure with a minimum 2 to 12 inch pitch, with an entrance on front facing Chubbuck road and the mobile home contain at least 1,O00 square feet. Rodney Parrish suggested leaving the width of lots open so lots can be sold according to purchasers desires. Mayor and Council had no objection to this request. Councilman Menard suggested a special meeting be called a£ter restrictive covenants are drawn up so mayor and council can review prior to passing k motion on same. Max Parrish entered the requirements suggested by mayor and council into the restrictive covenants. Council again discussed wait~m~ .zntil a later date to take action on the rezoning request. Cotmcilman Menard moved the proposal be tabled until Thursday evening at 8:00 p.m. Councilman Romriell seconded with all councilmen voting in favor of motion. SIDE. ALES - Dave Higbee, Chairman of Traffic, Safety and Beautification committee suggested leaving a two foot ~rassed area between sidewalks and curb. RELF, hSE OF DEPOSIT IN IDAHO BANK AND TRUST ESCROW - Fred Chase of Blue Ribbon Homes has requested the city release the deposit of $1,000.00 each on the temporary sewer ~ystems in Coztntry Acres ~th Addition and Stuart Park. Councilman Taylor moved the escrow deposit be released. Subject discussed and for lack of second no action was taken. Councilman Romriell requested a report of street inspections and also a notice of the request for inspection be sent to him so that he mig~ht report on inspectiona to Mayor and Council prior to acceptance of streets or etc. MOBILE MANOR ADDZTION ~ 1 - Proposed preliminary plat of Mobile Manor Addition ~1 presented to Mayor and Council by Rodney Parrish. Beverly Bistline, who owns property on the south was present and questioned council and Land Investment~ Inc. of the proposed plan for development of this area which borders her property. Beverly Bistline was interested and concerned with the 7~ to 80 feet of property between the plat and her property. She remarked she did not l~ke to see property idle and going to weeds. Max Parrish said they plan to lease it to someone to farm. Mayor Cotant told Kent Parrish he felt the city should have a utility easement directly south of proposed Whitaker Road to the next adjoining property owned by Beverly Bistline. Attorney Burnett informed Mayor and Council they cotuld condemn the property if it were needed in the future for utilities~ Cozancilman Menard moved the council accept the preliminary plat of Mobile Manor 1st Addition and that a special Plannfimg and Zoning meeting be called at 7:00 p.m. prior to the recessed Thursday meeting of the council and mayor at 8:00 p.m. to review the final plat for acceptance. Councfflman Kinghorn seconded motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, no. CITY CLERKS AND FINANCE OFFICERS CONVOLUTION - Mayor and Council approved for city clerk to attend the convention in McCall, Idaho September 19, 20 and 21. ADDITIONAL CLAIMS - Fred Chase requested approval of a claim for payment of cost of 8" pipe over 6" pipe as approved by council. This pipe was used in construction of water line in Country Acres Addition ~th Addition. Mayor and Conncil will approve ~laim when written claim is presented. J~Y'S ~-W~E. EI.ER $510.00 claim for red lights for volunteer firemen's vehicles was approved. FINANCIAL STAT~I~F~NT for month of August presented to Mayor and Council. CLAIMS FOR MONTH presented to Mayor and Councff~. After discussion of same Councilman Menard moved the council approve the claims. Councilman Romriell seconded with all councilmen approving motion. B~.ACKBOARD -Dave Higbee~ Chairman of Traffic, Sa~fety and Beautification commission request the city purchas~ a ~ foot by six foot blackboard. Mayor and Council approved the purchase as the city also needs one occasionally. vALENTY CLAM against city. Mayor Cotant asked Attorney Burnett his recommendation in regards to the letter of claim sent city. Mr. Barnett said the claim is ambigious and Councilman Menard offered to discuss the claim and letter $o Mr. Valenty. with 101 ROUGH DRAFT ORDINANCES - Mayor requested the councilmen review two proposed ordinances prepared by Attorney Burnett. One declaring weeds a nuisance and the other a "Green River" type ordinance. SEWER EASt~ENT - Councilman Kinghorn informed Mayor and Cooncil the easement granted by James Walton has not been taken care of to his satisfaction. Mayor Cotant stated he would talk to Engineer Jensen about this. S~ER SERVICE LINE - Mayor Cotant inf~v~uncil he had met with Jerry Stuart on claim for Darwin Smith sewer and ha~~ for ~he city to pay only for the additional 15 feet as agreed and approved by the city. WATER VALVE SHUT OFF - Councilman Romriell questioned the council about the city being without water at time of fire and electricity also off. The valve on East Chubbuck Road to the storage tanks was turned off. Councilman Kinghorn said he felt there was a valve that can be purchased which will automatically open when line drains empty beyond the valve. This problem to be followed up on. MOVING OF BUILDING WITHIN CITY. - Rodmey and Kathleen Parrish asked the Mayor and Council for approval of moving an older home onto a lot owned by them on East Chubbuck Road just east of City well ~t. Mr. and Mrm. Parrish were informed they would need to comply with Ordinance #125 on Moving of buildings. Meeting recessed at 11:30 p.m. until ThzLrsday , September 12 at 8:00 p.m. ~/fJohn 0.
