Minutes of the recessed meeting of August 13 held in the City Municipal Building
August 20, 1974~
Present: Mayor John O. Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard and Earl
Romriall. Attorney Burnett and Clerk Vera Armstrong.
IDAHO DEPARTMENT OF HIGHWAYS - Mayor Cotant read a letter from Idaho Department
of Highways approving the recommendation that a signal light be activated at the
intersection of Chubbuck Read and Yellowstone Avenue at a cost of approximately
$5,000.00 on a 50-50 cost basis with the Idaho Department of Highway.
Councilman Menard moved the city approve the 50 per cent cost of installation
to the city for installation of the functional lights at intersection of
Yellowstone and Chubbuck Rd. Councilman Romriell seconded motion with all
counc~J_men in favor.
LICENSE REQUEST - Mayor Cotant read a request from Charlotte Kennedy. Mrs. Kennedy
requests permission for the buyer of their store, G. Wayne Purrington, to operate
the business on their licenses for a period of 30 days as an employee. The
State has approved this arrangement. Council approved this arrangement for city
licenses also.
EVANS WAT~J~ LINE - Councilman Kinghorn told Mayor and Counci~Gilbert Howell had
contacted him about an additional water hook-up. Council suggested a letter
be sent to Mr. Howell inviting him to the first council meeting in September
to discuss the water problem or question he has.
PU~IC HF~RING ITEM: Kent Parrish of Mobile Manor Inc., has requested Lots 1 thru
l~Block 1 and Lot ~Block ~, Mobile Manor Subdivision be rezoned from Residential
2 Zone to a Residential -2 Trailer Zone.
Attorney Louis Racine, representing home owners on north side of East Chubbuck
Road told council in reviewing council minutes over the past years the council
apparently required a buffer zone of conventional homes be developed along the
south side of East Chubbuck Road as a requirement of approving zoning of the
mobile home residential area. Attorney Racine said he felt it was a matter of
faith with the council to uphold what the council:has requested prior to this
time, especially when the residents still object to area being zoned for
mobile home development.
Attorney Max Parrish stated he felt the stiuation was very different at this
time than it was in 1971. They feel now that the highest and best use of area
at this time is to allow mobile homes, double wide if required, to be developed
on the property. The only alternative is to let the property set, Mr. Parrish
stated.
Attorney Racine read a letter from Wendell Marshall stating the development of
mobile homes on south side of East Chubbuck Road would definitely decrease the
value of their property on the north.
Mayor Cotant asked if double wide mobile homes were approved for area if it could
be enforced. It was discussed and felt that it could be required in restrictive
covenants and therefore be enforced by home owners.
Mayor Cotant asked if perhaps the modular type mobile home would be accepted on lots.
Attorney Burnett said council could take these suggestions under advisement and
further study same, but he don't feel the council could prescribe donditions be
met on these lots that are not required in other Residential -2 Trailer Zone lots.
It was discussed that if Mobile Manor would draw up some restrictive covenants
with particularized restrictions as to mobiles homes or modular homes detailed
out the residents on north of Chubbuck Road might consider allowing trailers.

Attorney Racine suggested councilwait for submission o£ a form of agreement
assuring council and residents there would be enforcement of the submission of
restrictive covenants and possibly ~making the parties on the north side of
East Chubbuck Road a third party beneficiary in restrictive covenant enforcement.
Mayor Cotant asked if those present would agree to table request until the
owners submitted some restrictive agreement and architectural design that
might be acceptable to residents on north side of street and suggested this be
done.
Councilman Menard moved the rezoning request be tabled until the regular council
meeting September 10. Councilman Romriell seconded motion with all councilmen
voting in favor.
STOP SIGNS - Councilman Menard asked when stop signs are going to be installed
at church property land Hiline Road. Mayor said he had talked to Jordon and Traffic
committee and hopefully they coold be installed soon.
MOB~E MANOR ADDITIONal - Max Parrish told council and mayor that as the developers
of Mobile Manor Addition ~a_ they preferred not to have lots 180 foot deep and ~
there£ore prefer not to plat all area zoned Residential -2 Trailers. They
would like to have the lots on south side o£ Chickadee Drive be 100 foot only,
as their experience in present Mobdle Manor proves this depth to be just right.
This will leave approximately 80 feet on the south of the platted Mobile Manor
Additional left undeveloped.
Mayor Cotant told Max and Bart Parrish he felt the 180 foot depth was the lesser
o£ two evi~lSs. The 80 foot left going to weeds would be a bigger problem to the
city. Max Farrish asked council if they sold the 80 feet, would the council approve
the plat. Councilman Romriell said he ~aw no reason why they couldn't.
Mayor and Council requested Max and Bart Parrish to study their plat and circum-
stances for an acceptable solution to platting of }their addition.
Meeting adjourned at 10:45 p.m.
