Minutes of May 30 recessed meeting held in the City Municipal Building June 5, 197~.
Present: Mayor Cotant, Councilmen Kinghorn, Menard and Taylor. Councilman Romriell
excused. Clerk Vera Armstrong, Engineers Doug Jensen and Larry Perkins~ Doug Gadd
sewer cont~&ctor, Bob Young, for~mmnnon sewer project, Jordon Stuart and Joe Brennan.
Mayor Gotant called meeting to order at ~:15 p.m. Attorney Don Burnett also present.
SHNER CONSTRUCTION PROJECT:
Doug Gadd informed council the local strike was affecting the progresslof prbject
at present. Mr. Gadd stated he hoped by working with engiueers and getting more
help on the job they can bring the project to state of completion soon.
Bob Young said they were working on Burley, Quinn and cleaning up easements.
Engineer Perkins suggest preparing a list of work left to be accomplished and making
a list of what they plan to complete first.
Councilman Menard asked if one area couldn't be completely cleaned up and then carry
on to next one. Bob Young answered he seemed to have pressures with priorities in
all directions.
Mayor Cotant told contractor and engineers he felt the critical area are Quinn Road
and Hawthorne Road to Interstate and the Teton easement. Mayor advised Mr. Gadd
and Bob You~to get the people along the Teton easement satisfied by hauling them
black dirt if necessary.
Engineer Perkins stated he feels Oregon Construction employees are not aware of work
to be done and he feels a check list needs to be made of work to be accomplished and
work to this end. Four areas to be covered are: 1. Easements to atean up.
2.. Compaction. 3. Street Repair ~. Miscellaneous repairs. Engineer Perkins also
suggested Oregon work area by area for inspection and completion.
Mayor Cotant suggested working with the home owners on fence and miscellaneous repairs,
perhaps they would agree to make their own repairs at a cost less than Oregon could do
them.
Councilman Taylor questioned the paving of Hawthorne Road before it was ready.
Engineer Jensen stated the engineers had not approved Hawthorne Road to be paved.
Councilman Menard asked Joe Brennan if private contractors have repaired the curbs
they have broken or been informed of them. Mr. Brennan said he is informing
contractors when they break the curbs.
Doug Gadd stated he would put his foremen on priority jobs and do their best to
cleanup the project.
Engineers and contractor agreed to go over the streets and the engineers log and come
to an agreement on what areas need compacted. Engineer Perkins stated he would agree
for the contractor to settle the streets the method they feel best and the engineers
would then ~uspect same for approval.
RETAINAGE
Doug Gadd AAked the city if sons of the retainage of approzimately $70,000.00 could
be released. Mr. Gadd said he felt retainage should only be held on work left to be
completed.
~ngimeer ~erk~ms stated he did not know hew to figure completion percentages. The
city is using the pipe lines but the streets are not completed nor the easements re-
paired to original state.
Engineer Perkins said that Oregon Construction has been paid according to contract for
work that has been done with onl~ the 5% retainage bbeing withheld.
Attorney Burnett told Mr. Gadd he-felt the city were within the contract rights to
hold the retainage.
Mayor told Mr. Gadd he felt that by the city holding retainage,
quarantee the project would be completed sooner.

Attorney Burnett stated it would be necessary that he sign a statement that there
are no claim and litigations and none expected against the project before the bonds
can be sold and delivered and he cannot sign this kaowing claims might be outstanding.
Attorney Burnett also told the council and Mr. Gadd the city does not want any
suits for two reasons; the city losing their good name and jeopordizing the sale of
bonds, which is a necessity.
Engineer Perkins asked Attorney Burnett if city could be in trouble if they released
all retainage and Attorney Burnett answered in the affirmative. Attorney Burnett
said that if litigations come about the results could be awesome and costly to city
and advised mayor and council not to release any retainage money.
Doug Gadd accepted the decision not.to release any retainage fee and pledged to mayor
and council his efforts to complete the project as soon as possible.
