Minutes of the regular meeting of the mayor and council held in the city municipal
May iL, 197~.
Present: Mayor Cotant, Councilmen Kinghorn, Menard and Taylor. Attorney Burnett
and clerk Vera Armstrong. Council Romriell excused.
Mayor Cotant asked for approval of minutes of April 23 meeting, there being no
corrections or additions the minutes were approved as written.
EVANS WATER LINE - Councilman Kinghorn reviewed the proposed water line construction
for Evans Lane. Mayor Cotant asked those present, Mrs. Brown, Mr. & Mrs. Francis
and Mr. & Mrs. Hitchcock if they could live with costs presm%ed them last year.
Mr. and Mrs. Francis answered yes~ Mrs Brown stated they could not afford the cost
at this time. Mr. and Mrs. Hitchcock said it would be costly but would try.
The cost of installing the water line from Yellowstone Avenue or from Burley
Drive was considered. Mayor told residents the council would contact Mr. and
Mrs. Connelly, check the costs out further and contact them before any construction
begins.
DOGS - Animal control officer Miller informed council he has been unable to catch a
few dogs without using tranquilizer gun. Mayor told Mr. M~2~ler in some cases he
would need to use the gun and to enforce the ordinance.
S~ER DEPOSIT AND HOOK-UP CHARGE - Mayor and council reviewed ordinance requirement
of sub-dividers paying a $200.00 sewer tap fee for each tap into a city main sewer
line. Mayor and council discussed these fees and stated they will review and
possibly take action next meeting.
SE~ER DEPOSITS - Mayor and council discussed the required $30.00 deposit ~-~,]
for residents receiving sewer but not on the city water line. Mayor and council
said they felt if residents had established credit the deposit could be waived.
INSURANCE COVERAGE - Dale Kruse, ~epresentative of citYS~ insurance coverage~ re-
viewed the collision insurance coverage on city vehicles. Councilmen are to consider
the $100.00 and $500.00 deductible costs and inform Mr. Kruse of their desires.
VOLUNT~,ER FIP~N INSURANCE COVERAGE - WITH REDLIGHTS ON PRIVATE VEHICLES - Mr.
Kruse stated personal injury coverage to volunteer firemen when on a fire call
will be covered by workmans compensation. The city policy would afford some
liability when the firemen are providing a service to the city but not as the
primary insurance. Dale Kruse informed firemen they should have coverage with
their own insurance firms and their coverage should not be limited because of
red lights only on vehicles. After further discussing installing red lights
on the vehicles Attorney Burnett made the following proposal: Since the city appears
to be covered by liability insurance that in response to request of volunteer
firemen to install red lights on their private vehicles the city approves the
request of firemen to install red lights on vehicles with the understanding the
volunteer firemen provide insurance to their own vehicles and to caution each
individual to make certain he is covered for his own liability and bodily injury
insurance. A copy of these minutes to go to each volunteer fireman. Councilman
Menard moved the city approve the attorneys proposal. Taylor seconded motion
with anunanimous vote in favor.
LIABILITY INSURANCE COVERAGE - Mr. Kruse explained to mayor and councilmen the
reason the city policy did not cover the Idaho Metal Finishing claim. Basically,
if there is no physical damage there is no coverage on consequentual claims.
FIP~E STATION BUILDING - Mayor and council discussed with firemen present the need
of an addition to fire station building. Councilman Menard suggested meeting
at fire station before making a decision to buy additional property or to build
onto present building.
RENTAL ON BACKHOE - Council suggested the mayor propose to pay "The Lot" one-half
months current rental on the backhoe rented from them which was actually nine
days of usage. It was also suggested the attorney write the letter to "The Lot"
offering to pay this amount.
LETTER ON SE~ERMANHOLE CHARGE Councilman Menard requested Attorney Burnett
write LaMar Armstrong regard~ug the amount he owes the city for special manhole
ordered to serve his acreage north of Chubbuck Road.
MOBILE HOME SALES WAT~2~ HOOK-UP - Mob~e Home Trailer Sales ~455 Yellowstone is
obtaining their water from the first house on West Burnside. Mayor and council
approved the city enforce the ordinance requiring each business or property with
separate title to have a separate water hook-up.
PLANNING AND ZONING COMMISSION - Mayor and council discussed re-appointing three
planning and zoning members. Terms expire June 1 for Ed Reese, Larry Rawlins
and Rodney Parrish. Mayor and council w~l talk with these men and make
appointments next meeting.
AUDIT - Mayor Cotant read municipal audit letter of understanding from Ken V. Carter
Co. for year 1973. Codncilman Kinghorn moved the council approve for the mayor
to sign contract. Menard seconded with an unanimous vote in favor of motion.
Councilman Menard requested building permits state the zone the property is in.
Councilman Kinghorn moved the council approve the bLlls. T~lor seconded with
sll councilmen voting in favor of motion.
