Present: Mayor Cotant, Councilmen King~aorn, Menard, Romriell and Taylor. Attorney Don Burnstt and Clerk Vera A~mstrong Mayor ea~ed the meeting to order at 8:00 p.m. Mayor Cotant asked for any corrections to minutes of March 12, 19 and 21 meetings. Councilman Romriell made correction of March 19 meeting -from should the eity!/h~.~aish water to the subdividers whenever requested to - should the subdividers jparticipate '~ith water. PUBLIC HEARING IT,S: CONDITIONAL USE PERMIT REQUEST ~? Kent Parrish, Mobile Manor~ Inc. requesting con- ditional use permit to allow them to construct four four-plexes on lots facing Chubbuck Road, zoned Residential -2. Mayor Cotant read three (3) appeals of the Planning and Zoning recommendation to grant bhe permit. Zoning Ordinance requires city council to hold a public hearing on appeals. Councilman Menard moved the council hold the council public hearing April 16th. Taylor seconded with an unanimous vote in favor of motion. VARIANCE REQUEST - M. R. Metcalfe, 226 Adams, has requested a citizens band radio sales and service business in his home. Mr. & Mrs. Dave Migbee, 167 Adams questioned the size of business, the radio output, parking and the extra flow of traffic i~ regards to business. Mr. Metcalfe had called Mayor Cotant and requested this matter be tabled until he could be present, which the council did. VARIANCE REQUEST .~ t~. allow placement of trailer on his ~r~erty. Jerry Tydeman, 156 Hiway Avenue made this variance request. Planning and ~oning recommended the variance be denied. After report from Counc~A~enard ~n Planning and Zoning Commission recommendation Councilman Menard moved the Jerry Tydeman variance request be denied. Roll call vote: Kinghorn, yes; Msnard~ yes; Taylor, yes; Romrietl abstained from voting. REQUEST FOR WATER, STP~ET REQUIEE~ENT - T. M. McDonald representing the 7th Day Adventist Church requests the city allow them to build a church school on the back of property now owned by Les Selders with a thirty foot access street. Mr. McDonald also asked the requirement of water lines to ser~e the area. Mayor and council told Mr. McDonal~ the street would need to be fifty foot wide with curb, gutter and black toppedt waterline would ~eed to be six inch to the necessary distance to a fire hydrant. ORDINANCE~135 - Proposed amendment to zoning ordinance allowing wedding receptions as a conditional use in Residential 2 zones discussed. Mayor and council agreed to hold a public hearing April 16 on amending zoning ordinance to this effect. D~n Kurtz, ~57 Whitaker Road was present questioning councils action on his request ~o build and operate a reception center. Mr. Ku~z was informed the council would be required to hold a public hearing on zoning ordinance am~mdm~n% and this hearing would be April 16. Mr. & Mrs. Lee Lenon and Darwin Smith, realtor, were present to question the operation of a wedding reception center and catering business at the Southern Baptist Church on Adams Drive which the Lenons propose to purchase. Mr. & Mrs. Lenon and Mr. Smith were also informed of public hearing scheduled April 16 and advised to request conditional use per~it with planning and zoning. S~ CHARGE DEPOSIT PROTEST - Jess Aller, 5A2+5 Yellowstone Ave.. verbally protested the sewer deposit charge of $30.00. It was suggested the deposit could be refunded after credit was established or if a clear deed was held by property owner, deposit continued __ 25 not be required. Attorney Burnett favored refmnding the deposit after credit had been established. Mayor Cotant suggested tabling this matter for further study. RESOLUTION#21-74- A resolution approving Chubbuck Road from eastern city limits to the boundary of the west city limits as part of the Federal Aid UrbanTransportation System read in full by Mayor Cotant. Councilman moved Resolution #21-74 be approved. Taylor seconded with an ~nanimous vote in favor of motion. FORMAE CLAIM ON MS CONNIE STONEBURG's DOG from office of Racine, Huntley and Olson read in full by Mayor Cotant. Letter from J. James Miller, animal control officer~? also read by Mayor ~5~ant. Councilman Menard moved the claim be denied. Kinghorn seconded with an unanimous vote in favor of motion. Attorney Burnett offered to write a letter to Mr. Olson explaining claim had been denied because of lack of sufficient evidence to approve claim. ORDINANCE # 134 - Annual Appropriation Ordinance of 1974 r~ad in f~l by Mayor Cotant. A short discussion followed:about budget. Motion to dispense with rule of reading on three different days made by Counci2man Taylor~ seconded by Kinghorn. Roll call ~ote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. Motion to adopt Annue~ Appropriation Ordinance ~154 made by Councilmsm Menard and seconded by Taylor. Roll call vote: Kinghorn, yes; Menard~ yes; Romriell, yes; Taylor,yes. ATTORNEY BURNETT REPORTed he has spent this day with Ed Palmer, attorney with Dawson, Naegel, Sherman and Howard, bonding attorneys of Denver, Colorado on preparation of ordinance on sale of bonds. SPEED LINITS - David Higbee read speed limit recommendations from the Uniform Manual and Traffic control book. Mr. Higbee requests the city replace speed signs with regulatory size and reflectorized and also review all streets for speed limits and sign needs. Comncilman Menard suggested the city appoint a traffic and safety commission of three members. Kinghorn seconded motion with an onanimous vote in favor of motion. COUNCILMAN KINGHORN su'~gested a meeting with engineer and contractor of sewer project. Mayor Cotant stated Doug Gadd wozuld be in Chubbuck Thursday and he had suggested a meeting to Larry Perkins. It was agreed to meet Thursday at 5:00 p.m. Mayor and councJ~ approved ordering a complete set of Idaho Code Boo~s for the city. Meeting recessed until Thursday March 28. Vera C. Armstrong, City clerk
