Present: Mayor Cotant, Councilmen K~ughorn, MenaTd, Romriell and Taylor. Attorney B~rnett and clerk Vera Armstrong. Meetiug called to order by Mayor Cotaut at 8:07 p.m. Minutes of the meetings of December ll and 18 approved as written. Claims presented to mayor and councilmen. After reviewing Councilman Romriell moved the council approv~aying the bills. Taylor seconded with au unanimous vote in favor. ADMINI~TRATION OF OATHS - City clerk Vera Armstrong administered the oaths of election to re-elected Mayor John 0. Cotant, Jr. and re-elected councilmen Earl L. Romriell and Wayne G. Taylor. Councilman Romriell moved the meeting adjourn sine-die. Kinghorn sseconded with all councilmen in favor. MEETING called to order by re-elected Mayor John 0. Cotant, Jr. BUSINESS FROM FLOOR -SEWER - James Chastain questioned the depth of the sewer line at his property line. He was told he would need to contact Oregon Construction to secure this information. Mr. Chastain also asked if obligation on sewer bond issue could be paid off. Mayor Cotant told Mr. Chastain the bond issu~ was revenue and an amount to pay off the obligation could not be determined. Mr. Green, 197 Stuart, informed council Oregon Construction had left a hole where his service line was installed. Engineer Dave Nelson was present and made note of PUBLIC HEAR2NG ITEM: H. Hal Clarke and Lowell R. Allen were present for council action on the variance request to operate a Mobile Home Sales business using a mobile unit as an office. Mr. Clark objected to the condition that curb and gutter be installed. He stated the requirement was discriminating to them as other businesses had not been required to inst~ll curb, gutter and sidewalk. Mayor and council ir~ormed Mr. Clarke the city had received the grade now from Idaho State Highway and the city had to start requiring curb, gutter and sidewalk at some paint. Mr. Allen stated they would use a new 1974 12 foot x 50 foot trailer with grassed play area, Mayor Cotant remarked that every time the city had varied from zoning ordinance thay had been sorry afterwards and he was against making a variauce. Councilman Menard asked council if they wanted new business in Chubbuck or not. Councdlmen Kinghorn and Taylor stated they felt a mobile office would be acceptable for this type of business. After some discussion Councdlman Taylor moved the Mobile Home Sales Business be required to install curb, gutter and sidewalks on Yellowstone. Kinghorn seconded with an unauimous ~ote in favor of motion. Councilman Taylor moved the variance be allowed on a one year basis with permanent sewer and water hook-up to be installed. Installation of curb and gutter on West Linden to be determined later subject to ditch right-of-way in street. Motion seconded by Menard with Kinghorn, Menard and Taylor voting in favor of variance and Romriell abstaining. SEWER REPORT - Engineer DAve Nelson reviewed progress oS sewer project with mayor and COU-~cil. OTHER SEWER BUSINESS - Engineer Larry Perkins read letter from Doug Gadd, president of Oregon Construction requesting an ext,-ion of time from December 22, 1973 to June. l, 197~. Mr. Gadd also requested the retainage on work performed in area North of Interstate be released and a 10% retalnage on balance of the project plus the performance bond be held by the city until completion and acceptauce. Retainage amounts to $9~,000.00 at this time. Engimeer Perkins suggested the city release all but $50,000.00 of the retainage. Councilman Kinghorn moved the city approve the extension of time until June 1. Taylor seconded with au unanimous vote in favor of motion. 3 Councilman Menard moved the retainage ~ll be held unt~ project completion. A discussion followed as to release of retainage fees. Engineer Perkins stated he could review the 5% retainage fee and have a figure to recommend to city for retaiuage by Friday January llo Councilman Menard rescinded his above motion and moved the city approve for Engineer Perkins to prepare au amount for retainage to be withheld until end of.construction and hold on letter of e~ension e~:b~me until a recessed meeting is held on January 11 at ~:30 p.m. Kinghorn seconded and the motion passed unanimously. Mr. Perkins stated the city should appreciate the fact the contractor is allowing the city to use the system before £inal construction acceptance. Councilman Menard suggested Joe Brennan and Jordon Stuart inspect for any damage done to streets whf~e ~uspecting private sewer line inst~]] ation. PUMP BID - Engineer Perkins informed the mayor and council he had bids ready for a pump to be installed at Well #2. Councilman Taylor made motion city ca] 1 for bids for this new pump for Stuart Well #2. Menard seconded with an unanimous vote in favor of motion. IDAHO METAL F~ISHING CI~IM - Max Parrish asked city and Doug Gadd if any action had been taken by city or Oregon Construction on claim from Idaho Metal Firaishing. Mr. Parrish stated the 60 days had lapsed. Mr. Gadd stated he has turned this matter over to his insurance company and the insurance company wd21 handle same. Councilman Menard moved the claim from Idaho Metal Finishing to the City of Chubbuck be denied. Kinghorn seconded with an unanimous vote in favor of motion. BI-CENTENNIAL COMMISSION - Mayor Cotant appointed Earl L. Romriell as chairman of this commission., I~TERIM APPROPRIATION 0RD~ANCE # 131~ read in f~l ] by Mayor Cotant. Councilman Romriell m~ed the council dispense with z~le' of reading on three sepa~ate days. Taylor seconded. Roll csl~ vote: Kinghorn, yes; Menard, yes; Romriall, yes; Taylor, yes. Kinghorn seconded motion with an unanimous vote in favor of motion., HARGRAVES BILL AT ATTORNEY FOR SEWER - Attorney Burnett stated that as near as he could research~Attorney Hargraves had fulfilled his responsibility as far ash is work was concerned as attorney on the sewer project. Mayor and conncilaagreed to meet with Attorney Hargraves, engineer aud sll parties concerned to resolve claim made by Attorney Hargraves. POLICE POWERS OF MAYOR outside city limits. Attorney Burnett prepared a memorandum on information concerning an ordinance to this effect for study by mayor and councilmen. JUNK CARS ~ Mayor and council discussed the junk cars at Denny's Oil. Council requested meetingwith Denny Jones at recessed meeting to be held Friday afternoon. MOB~V.E MANOR STREETS. Max Parrish asked if city will accept streets in Mobile Manor. Mayor told Mr. Parrish he did not know of auv reason~hev couldn't be~addeoted.
