Council Meeting Minutes
September 10, 2013
7:00 p.m.
Minutes of a regular Council Meeting held at the City Council Chambers, September 10, 2013
Present: Mayor Steven England, Council Members: Josh Ellis, Kevin England, Brent Marshall,
Kermit Morrison, Attorney Thomas Holmes, Deputy City Clerk Eric Jablonski. Absent: Public
Works Director Steve Smart, City Clerk Rich Morgan
The meeting was called to order at 7:00pm by Mayor Steven England.
The Pledge of Allegiance to the Flag was led by Mayor Steven England.
The Invocation was given by Bishop Jasson Mathews of the Chubbuck 12' Ward of the Church
of Jesus Christ of Latter -day Saints.
Mayor England and Chief King presented service awards to members of the Chubbuck
Fire Department.
Approval of Minutes. Council Member England moved to approve the regular meeting minutes
of August 27, 2013 as presented. Council Member Morrison seconded. Roll call vote: Ellis -yes,
England -yes, Marshall -yes, Morrison -yes.

Mayor England proclaimed September 2013 as National Recovery Month.
Mayor England proclaimed September 17 through September 23, 2013 Constitution Week.
Public Hearing on the intergovernmental transfer of one six year old Belgian Malinois K9
unit and associated equipment. Mayor England declared the public hearing open. There being
no comment Mayor England declared the public hearing closed.
Approval of the contract for the intergovernmental transfer between Pocatello and
Chubbuck. Council Member England moved to approve the intergovernmental transfer contract.
Council Member Marshall seconded. Roll Call Vote: Ellis -yes, England -yes, Marshall -yes,
Morrison -yes.
Ordinance #723 - Consider a proposed ordinance amending 18.08.040A to permit childcare
centers in industrial areas rather than conditionally permitting them. Currently a day care
center wanting to locate in an industrial area would go through the conditional permit process.
This change would have all day care centers going through the regular business licensing process.
Council Member Morrison moved to waive the rule the ordinance be read in full. Council
Member Marshall seconded. Roll Call Vote: Ellis -yes, England -yes, Marshall -yes, Morrison -
yes. Council Member England moved to adopt Ordinance #723. Council Member Ellis
seconded. Roll Call Vote: Ellis -yes, England -yes, Marshall -yes, Morrison -yes.

Ordinance #724 - Consider a proposed ordinance amending 8.24.066 changing the nuisance
violation to require posting or notice on the property only prior to mitigation. This will
require posting on the property only when the City is going to actually mitigate. Council
Member England moved to waive the rule the ordinance be read on three separate occasions one
being in full. Council Member Morrison seconded. Roll Call Vote : Ellis -yes, England -yes,
Marshall -yes, Morrison -yes. Council Member Marshall moved to adopt Ordinance #724.
Council Member England seconded. Roll Call Vote: Ellis -yes, England -yes, Marshall -yes,
Morrison -yes.
Resolution #2013 -06 increasing the delinquent fee for utility services. This resolution will
increase the delinquent fee from $10 to $50 for any delinquency after the first offense. Council
Member England moved to adopt Resolution #2013 -06. Council Member Ellis seconded. Roll
Call Vote: Ellis -yes, England -yes, Marshall -yes, Morrison -yes.
Computer print out claims for September 10, 2013 were presented to the Mayor and Council.
Council Member Morrison moved to approve the claims as published. Council Member England
seconded. Roll Call Vote: Ellis -yes, England -yes, Marshall -yes, Morrison -yes.
At 7:47pm Council Member Marshall moved to adjourn. Council Member Ellis seconded and
the full Council approved.
