Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard, Earl Romriell, Wayne Taylor, Attorney Don Burnett, Clerk Vera Armstrong and Engineer Klane Forsgren. Councilman Menard moved the November 11 meeting be adjourned. Councilman Taylor seconded motion with unanimous vote in favor. Mayor Cotant asked for corrections or additions to November 5 and 11 minutes. There being none, Councilman Romriell moved and Councilman Taylor seconded motion the minutes be approved as written. Meeting called to order at 8:05 p.m. CITY PARK PROJECT - Glen Kinlock, Dean Wood and Justin Lowder representing the Lions Club informed mayor and council they were very desirous of going ahead on the development of a city park at location of city property on East Chubbuck Road where Well ~i is located. Mr. Kinlock asked the city to participate in the furnishing of materials and the Lions Club would participate 100% in the labor. Councilman Romriell suggested the Attorney draw up an agreement. Attorney Burnett informed council if city would be purchasing the materials, there should be no need for an agreement or contract. Mayor and council told Mr. Kinlock the plan looked real good and asked Mr. Kinlock to present a cost estimate on materials. Councilman Romriell told the Lions Club representatives the council is in favor of this project and there should be no reason why they can't plan to proceed. Engineer Forsgren said he felt the street situation should be considered in the park area, e.g. possible widening of Hiline Road. STREET SPEED LIMITS - Mayor and council discussed proposed speed limits within the city. Very few residents were present to discuss the proposed speed limits. However, those present from residential areas seemed to favor low speed limits. Attorney Burnett informed those present the city is required to have a traffic and engineering study on base speeds and if the city deviated radically without good cause the court could hold the city speed limits invalid. Attorney Burnett added it would be helpful to set the speed limits reasonably because of court action follow-up. Dave Higbee, Traffic, Safety committee Chairman, explained the traffic study that has been taken and the meaning of survey. Mr. Higbee recommended school zones at 20 m.p.h, also library and park areas at 20 m.p.h. After a general discussion Councilman Romriell moved the city leave the speed limits on East and West Chubbuck Road and Hawthorne Road at 25 m.p.h. The motion died for lack of a second. Councilman Taylor moved the speed limit on Chubbuck Road ~es~ to Hawthorne Road be posted at 30 m.p.h., Chubbuck Road west to city limits 25 m.p.h, with school zones being posted 20 m.p.h., Hawthorne Road south of Chubbuck Road at 35 m.p.h., Hawthorne Road north posted 25 m.p.h, except school zone~.being posted at 20 m.p.h. from 7:00 a.m. to 7:00 p.m. Councilman Kinghorn seconded motion. Roll call vote: Kinghorn, yes; Menard, no; Romriell, no; Taylor, yes. ~ote being tied, Mayor Cotant voted no and the motion did not pass. Councilman Kinghorn told Dave Higbee that Murray Layne would like to serve on a safety school zone committee. INVESTIGATIVE WORK - Don Burnett introduced Lynn Cameron and Mr. Cameron re- ported on the following. l) Denny Jones Case - Lynn Cameron reported on his investigative work and informed mayor and council they have hired an appraiser to find out if the present use of Denny's property has de-valued the surrounding property. 2) Louise Mingo Sewer Line - Mr. Cameron reported easement provides 25 ft. of sewer line be installed by the city. The city is aware of this agreement and this line has been installed. 3) Earl Ellis Trailer placement - and junk cars - Mr. Cameron reported he has visited with residents surrounding this property and he now wants to study the zoning. ~)Arnold Stuart Trailer placement - Mr. Cameron said he has taken pictures and is studying this case. Attorney Burnett added enough information should be available within a couple weeks to take some legal action against Earl Ellis ~nd Arnold Stuart. HILINE CANAL EAsemENT - Mr. Cameron informed mayor and council the canal easement consists of 120 ft. west from center of canal and 100 ft. east from center of canal. The canal information created a question as to plans of proposed city park lying directly east of canal~ if the city could build as planned. HILINE ROAD - Mr. Cameron reported he had not been able to find any easement on Hiline Road, but that it was recorded as a State Highway at one time. MOBILE MANt)R ADDITION ~/2 - Jim Voeller presented a preliminary plat on Mobile Manor Addition #2. Mayor and council informed Mr. Voeller the preliminary plat would be required to be reviewed by the Planning and Zoning Commission prior to council review. BEER, WINE AND LIQUOR LICENSE REVEWALS - Mayor and council discussed renewal of licenses. Councilman Taylor moved to approve the renewal of beer, wine and liquor licenses. Councilman Kinghorn seconded motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, no; Taylor, yes. Councilman Romriell suggested the Circle K attend the next city council meeting. Also, the Police Chief be present or provide a written report on beer license being taken from Circle K. TRANS~'~ OF FUNDS - City clerk asked council to approve transfer of $7,000.00 from g90-Other Governmental P~rposes to ~lg-Other General Government. Also, transfer $3,000.00 from gg0-Other Governmental Purposes to 423-Fire Control Fund. Councilman Taylor moved council approve transfer of these funds. Councilman Kinghorn seconded motion with an unanimous vote in favor of motion. INVESTMENT OF SEWAGE RESERVE FUND - Clerk Vera Armstrong request council approval of '~investing $20,000.00 from Sewer Reserve Fund. Councilman Kinghorn moved to approve the investment of $20, 000.00 out of the Sewer Reserve fund. Council- man Taylor seconded motion with an unanimous vote in favor. MOVING OF BUILDINGS - Mayor and council discussed moving of older houses into city and the possibility of holding a public hearing on these requests. Councilman Romriell did not approve of the public hearing proposal. Councilman Menard suggested the city make a policy decision of having Planning and Zoning review application. No action taken. PROPOSED ORDINANCE PROVIDING FOR ADOPTION of current edition o£ Uniform Building Code and requiring permits for placement of mobile homes in the city was discussed. Attorney Burnett told council he felt the council should make a policy decision on how broadly the city wants to enter into these inspection requirements. A general discussion of proposed ordinance followed with no action being taken. BANNOCK CAB~,E TV OR TELEPRinTER CA~E TV - Attorney Burnett will meet with Councfilman Menard on study of Bannock Cable TV franchise. COUNCIL MEETING FOLLO~-UPS : POLE LINE ROAD AND HAWTHORNE ROAD descriptions - Attorney Burnett needs descriptions for annexation of these ~treets. DAN KUNZ PROPERTY - Attorney also needs description of Dan Kurtz property for a waterline easement. FIRE REPORTS - Councilman Romriell again requested fire department reports be turned iu each month. PROPERTY FOR WATER TANK - Mayor Cotant reported he had talked to Mr. Harry Hart on possibility of purchasing additional property for city to place the one million gallon water tank. Mr. Hart asked for information of when Chubbuck annexed his ground. Mayor Cotant will talk to Mr. Hart on this item again. LOCAL FISCAL CONTROL ACT - Councilman Romriell moved the city prepare a resolution opposing the Local Fiscal Control Act ~of 1976 which has been endorsed by the Association of Idaho Cities and is beiug presented to the 1976 Idaho Legislative Session.
