September 23, 1975
Minutes of the regular council meeting held in the city municipal building
September 23, 1975.
Meeting called to order at 8:00 p.m. by Mayor Cotant.
Present: Mayor John 0. Cotant, Councilmen Dwain Kinghorn, Jack Menard, Earl
Romriell, Attorney Don Burnett and Clerk Vera Armstrong.
Mayor Cotant asked for corrections or additions, to minutes of meetings
September 9, 10 and 16.
Councilman Kinghorn stated he intended for the request that Hendersons submit
a revised water plan to become a part of his motion on page 259.
Councilman Romriell requested the following be added under General disuussions~
page 253, September 10 minutes, to the last paragraph.--"because of Mr. Parrishes
possible remodeling plans. Otherwise Councilman Romriell stated he felt the
city should honor the easement agreement on city property at ~5~5 Yellowstone Avenue."
Councilman Menard asked the following also be added to the same paragraph, page 253.
"Councilman Menard suggested another possible service hook-up directly west of
Parrish Store which would require an easement from Ross Kelly."
PROPOSED SPEED LIMITS - The city proposes to set speed limits throughout the
city and several residents were present. Most all residents from residential
areas voiced objection to raising the speed limit on West Chubbuck Road and
Hawthorne Road where school childrea are walking to school.
The possibility of a safety patrol was discussed with some residents volunteering
their service.
Dave Higbee, Traffic, Safety and Beautification Committee Chairman explained the
method used in determining the speed limit to be posted on streets. Mr. Higbee
also explained to those present the proposed school crossings to be marked
and the signs that would be installed regulating traffic at these crossings.
Mayor Cotant recommended Chubbuck Road be 25 m~Z[es per hour and requested Mr.
Higbee contact Mr. Layne to organize a safety patrol. Mayor Cotant also asked
police department to notify trucking companies that they must travel slower.
Mr. McCu~dy .informed council the speed limit sign on West Chubbuck Road was
posted after entering city from west. Mayor Cotant informed Mr. McCL~rdy this
had been checked into and would have to be placed where proper.
It was noted that dips and speed checks on the streets are unwise because of
the safety and liability factors.
Counc~]Jnan Kingorn~' urged residents to put in their cL~rb and sidewalks.
Vola Eldredge informed counc~ the Retired Senior Volunteer program might be
able to help put up signs if help is needed.
Co,alee Jenkins requested the public be notified of cotmcil meeting agenda
items.
Council requested clerk notify the ne~ media of agenda items when possible.
Mayor Cotant asked Attorney Burnett if a posted 15 miles per hour is a legal
speed. Attorney Burnett answered that if speed limit posted is determined
by engineer study and by city to be a reasonable speed it can be considered
a legal speed.
SPEEDS WITHIN P~ESIDENTIAL AREAS discussed. Residents mostly voiced recommendation of 15 miles per hour in residential areas.
Officer Rowland informed those present that school children cannot patrol cross-
walks in this district, possibly because of liability factor.
Attorney Burnett stated statutes requires engineering and traffic investigation
prior to establishing speed limits for various streets.
SPEED L]I~ITS - (cont'd) - Dave Higbee said the city traffic committee and >
the police department have not gone out in unmarked cars for this invest-
igation. Attorney Burnett remarked this would be the proper procedure to
take prior to setting speed limits.
Mayor Cotant recommended the streets be posted 15 miles per hou~ in sub-
divisions until study is completed and speeds can be set.
Mrs. Max Merrell stated she felt parents should train and educate their children
to stay out of streets and work towards the development of sidewalks for safety
purposes.
Dennis Leslie said motorists should be more courteous to bicyclists.
Dave Higbee explained the process of the engineering study and told those
present he could use some volunteers to help.
An intensive discussion followed as to possible ways of installing sidewalks,
which would be a great safety factor throughout the city -- especially in the
school zones.
MOBILE HCME DEVELOPMENT - Rex Christenser% 52Q1 Lucky sho~ed council a plan for
the placement of two mobile homes on Lucky Avenue on lot lying just north of
his home and owned by Mr. Christensen. The property is zoned Mobile Home
Residential - R-2T. Co~cil told Mr. Christensen he would need to comply with
the zoning requirements.
Mr. Christensen told council he could not get into the sewer line. Engineer
Jensen has informed the city it is possible for Mr. Christensen to get into
the line. Mayor and council told Mr. Christensen they would get his sewer
service line problem resolved.
PAVING OF STREETS FROM PAVED STREET TO CURB & GUTT~ on West Chubbuck Rd. in front
of Heights Subdivision and in front of Mobile Manor Addition ~1. Engineer Jensen
has informed city Bengal Construction has bid $1800.00 in front of Heights
and $1LO.O0 in front of Mobile Manor Addition ~1. The area to be paved is
approximately six foot wide. Council requested a bid be received from Bannock
Paving Company also~ but the city has agreed to do the paving on these main
streets.
POLICE H~P IN OFFICE - Mayor and council discussed the police department need
for office help. Attorney Burnett suggested the city purchase a dictating
machine for city use.
TRANSFER OF FUNDS - Counc~lman Menard moved the council approve the transfer of
$15t000.00 from ~35.t Sewage Contingent Fund to ~35.6 - Sewer Bond & INterest
F~nd. Councilman Kinghorn seconded motion with all councilmen voting in favor.
WATER QUALITY 208 AGENCY - Mayor and council decided to study this program further
before taking any action.
SUBAREA HEALTH COUNCIL - Mayor and council decided to study this proposal Further
before taking any action.
STAR~ITE CIN~ CONSTRUCTION - Council requested a letter be sent to Richard
Morris requesting a parking lot plan be submitted or construction may be
stopped.
ONEIDA INVESTMENT, INC. vs City of Chubbuck. Attorney Don Burnett informed
mayor and council the court case scheduled for Friday, September ~6, 1975
has been postponed and he .~is hoping the case can be settled out of count.
Councilman Romriell requested a report from engineer on Valenty Sewer pump station follow-up.
Councilman Menard moved an executive meeting be set up for 5:00 p.m. Wednesday,
