September 10, 1975
Minutes of the recessed~meeting of $.eptember 9 held in the city m~uicipal
building September 10, 1975.
Present: Mayor John O. Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard~ Earl
Romriell, Wayne Taylor, Attorney Don Burnett and Clerk Vera Armstrong. Building
Inspector Ralph Nelson also present.
Meeting called to order by Mayor Cotant at 7:05 p.m.
INTERAG~CY AGRE~M~T FOR FIRE PROTECTION SERVICES - Council agreed for Mayor
Cotant to signa the Interagency Agreement with Bannock County for fire protection
in the northern part of the county in accordance with marked map attached to
agreement.
ILLEGAL PARKED TRAILERS - Mayor, Council, Rslph Nelson and Attorney Burnett dis-
cussed the problem of trailers being parked illegal in the city.
ARNOLD STUART PROPERTY - Mayor and council discussed the placement of a
trailer on property at 5115 Yellowstone owned by Arnold Stuart. Attorney Burnett
sked for information and pictures to provide him with the necessary information
roceed with some action on this case.
~LLIS PROPERTY - Attorney Burnett also asked for what information that could
be provided on placement of trailer on Earl Ellis property. Council requested
Attorney Burnett to research what legal action had been taken towards Earl Ellis
for placement of trailer on his property.
CLAIM REPORT - Dennis Price is operating a dental lab at ~SAj+ Yellowstone and
he has an oven in his business that requires a constant circulation of water
to cool the oven or it will burn up. Mr. Price informed mayor and council
his oven stopped operating and he called Uniteck, the supplier, and a Mr.
Page told him it was the result of no water that the unit burned up. Mr. Price
informed mayor and council the water was turned off without sufficient notice on
Thursday, September 4.
Attorney Burnett advised city clerk to send a letter to the city insurance
carrier, Kruse Insurance Company~ advising a claim would be forthcoming.
TRAILER ORDINANCE AND F. ONING ORDINANCE REQUIR]~IENTS - Attorney Don B~urnett has
studied Zoning Ordinance ~98 and Trailer Ordinance #107 as to the allowed zones
for trailer or mobile home park development. Attorney Burnett explained to
mayor and council the trailer ordinancs ~fl07 provides for trailer development
in Industrial Light and Commercial Highway Zones, since the city does ~not
have an Industrial Light and Commercial Highway zones the Trailer Ordinance
~fl07 is not valid as it attempts to modify Ordinance ~98 as to permitted zones
for trailer development because the city does not have zones so named.
Therefor, mayor and coucil were informed by Attorney Burnett the city was
legal in granting a variance for development of mobile home parks from the
various zones in Zoning Ordinance //98. Attorney Burnett also advised mayor
and council the city had enforcemmnt powers necessary to control development
of mobile home parks developed under the variance granting procedure and
provisions of Zoning Ordinance ~98.
GENERAL DISCUSSIONS - Councilman Romriell informed council that Jordon Stuart was
quite upset because a permit had been. issued to Mountain Bell to install buried
telephone bable on top of water line on Siphon Road.
Councilman Romriell reported to council he and Councilman Kinghorn had reviewed
the sewer line problem at the Parrish Company store this evening and it would be'~ -.
at onslderable expense that Rodney Parrlsh mnstalled sewer line to Parr~sh Drive. ~.
Mr. Romriell reported he suggested Rodney Parrish pay his sewer charges and perhaps
the decision of where hook-up is made could be settled at a later date~ ~.'~-~J--__

WATER REVENUE BOND ELECTION - Mayor and council asked Attorney Don Burnett to
prepare necessary legal steps so a special water bond election can be held
the same day as the general city election on November &4 Attorney Burnett
said the complete plans and specifications of project would need to be
prepared and be on fi~e before he could write up the election notice.
SALE OF CITY PROPERTY AT ~5~5 Yellowstone - Mayor and council discussed selling
the property at ~5~5 Yellowstone. The city needs additionst ground but question
if needed at this particular location.
Councilman Menard moved the council have the property appraised again so the
city can advertise for bids. Councilman Romriell seconded motion wi%h all
councilmen voting in favor.
