Minutes of the regular meeting of the Mayor and Council held in the city municipal
building July 8, 1975.
Present: Mayor John O. Cotant, Jr., Councilmen Dwain Kinghorn, Earl Romriell, Jack
Menard and Wayne Taylor. Acting Attorney Martin Ward and Clerk Vera Armstrong.
Meeting called to order at 8:00 p.m. by Mayor Cotant.
Mayor Cotant asked for corrections or additions to June 2A minutes. Councilman
Romriell requested the following addition - Rodney Clark stated he is paying for
a first class job and that is what he expects fro~-~ the contractor on ~construetion
in Heights Subdivision. There being no other corrections or additions the minutes
were approved as written.
PUBLIC HEARING ITt~4: Robert N. Grimes, General manager of Highland Homes is request-
ing a variance to use a Boise Cascade home as an office for their proposed
business location at ~5~1 Yellowstone.
The council noted curb, gutter and sidewalk would be required along Yellowstone.
Councilman Kinghorn moved the variance be granted for a one year period only.
Councilman Taylor seconded motion with an unanimous vote in favor of motion.
PU~IC HEARING IT~: Ralph J. Henderson is requesting a variance of zoning to
allow the development of a Mobile Home park on the property which lies west of
Hiline Road and south of the present Mobile Manor Addition ~1.
Mayor Cotant read P & Z minutes as to their recommendations. Mayor Cotant asked
for any comments. Max Parrish said he understood the 85 foot owned by Land
Investment, Inc. had been approved for trailer development through the Seaton
variance request. Mayor and Council said.Mr. Hendersons request was a new
variance request and Mr. Seatons variance request was not followed through,
therefor there is no variance granted Mr. Seaton and Mr ~. Smith~.
R. Jay Henderson explained their proposed development wottld basically be the
same]~plan as previously submitted with standard ~0 foot wide street i~th curb,
gutter and sidewalk, deleting the green areas in center of streets and increas-
ing the lot size to ~0 fee%~ wide. Mr. Henderson said they preferred to change
design of storage areas to one storage area and one play area.
Mayor Cotant asked if any agreement had been reached on the development of the
85 foot strip owned by Land Investments, Inc. which lies between Mobile Manor
Addition ~1 and the proposed Mobile Home park development. Mr. Henderson told
mayor and council they have discussed sharing the cost of street which would
serve property owned by Land Investment, Inc. but no agreement has been reached.
Councilman Taylor said he preferred the Hendersons submit a plan as they propose
to develop park before granting variance.
Martin Ward Advised mayor and council to wait for definite plans for the proposed
park before granting of variance.
HEIGHTS SUBDIVISION FINAL PLAT - Mayor Cotant questioned councils feeling as to
approval of Heights Subdivision final plat. Councilman Taylor reminded council
that Mayor Cotant had promised residents of Neider 1st Addition the council would
not make a decision before notifying them, especially if the decision lends
towards favoring the street. Counc~3gnen Menard, Taylor and Kinghorn voiced their
feeling the street should be required. Councilman Romrielt proposed requiring
the street be constructed and then barricade off to vehicle traffic at the
present time. Matter was tabled until July 22 for a decision, to allow
residents protesting the access street to be present.

HEIGHTS SURDIUISION CONSTRUCTION OF SIN~ LINES - Grant Anderson, engineer with
Hamilton and Voeller, told council Joe Brennan had approved PVC pipe for sewer
service lines.
Councilman Menard asked Mr. Anderson if PVC was: specified in construction specs.
Mr. Anderson answered no.
Engineer Jensen stated that Pocatello approved PUC pipe for sewer service lines
with the use of six (6) inches of sand below mud twelve (12) inches of sand
above approximately two months ago.
Mayor Cotant stated he felt the city could approve the use of PFC if the pipe
is embedded six(6) inches below and twelve (12) inches above the pipe with sand
and every service line inspected and each service line be nmmbered and an in-
spection on each line initialed.
Acting Attorney Martin Ward reviewed the Subdivision Ordinance and read from
ordinance whereby council could waive requirements if council secured substantial
objectives that other product used would be of equal to other product specified
in standard specifications.
Mayor Cotant said if council approved use of PVC pipe the city would require
contractors to comply with manufactures specifications of embedding materials.
Grant Anderson asked council if the manufacturers or Johns-Mansville would
guarantee the pipe as constructed for a certain period of time -- perhaps
three years.
Rodney Clark suggested a cash hold back to guarantee the PVC pipe will perform.
Rodney Clark and Engineer Jensen suggested the matter be tabled until manufacturer
is contacted for guarantee and warranty of pipe. After further review Engineer
Jensen read from technical data of PUC pipe that due to varying conditions under
which the product is used or installed the company offers no warranty, express
or implied.
After much further discussion Councilman Menard moved the council make exception
to ordinance as to PVC pipe use in Heights Subdivision. That there are 180
service lines installed and need not be dug up. The balance of service lines not
installed will be embedded in reject sand with city engineer specifying how much
embedment under and over pipe. A bond of $30,000.00 shall be required for a term
of five years covering the installation of all PVC service lines. Councilman
Taylor seconded motion. Roll call vote: Kinghorn, yes$ Menard, yes; Romriall, no;
Taylor, yes.
It was noted the above conditions wi]] be required for consideration of councils
later acceptance of streets. It was also agreed a cash deposit would be acceptable.
MOBILE MANOR ESTATES - Mayor Cotant informed Max, Kent, Rodney and Bart Parrish it
had come the citys, attention that the lots facing Hiline Road do not have .the
required square footage as required in Residential - 2Tzone. Kent-'~Parrish said
they would check this out.
PROPOSED BUILDING OF MULTIPLE UNITS in the 5000 block of Hawthorne Road. Kent, Max,
Rodney and Bart Parrish represented the Diversified Investment GroUp, Inc. in
discussion of the proposed development at this location. Diversified Investment
Group, Inc. proposes to build four plex units on this property.
Max Parrish stated they had purchased a building permit for multiple dwellings
in 1971. Attorney Ward advised council to disregard the 1971 permit.
In reviewing the zoning map there was controversy as to where the dividing line
was between Residential 2 and Residential -3 zone. Attorney Martin Ward advised
council to table the matter at this time so he might research the legality of
splitting the zone on one piece of property.
Max Parrish asked if it is determined the majority of the property is in R-3 zone
will the city issue the building permits for four plex units and does the city
have a valid reason to refuse issuing the permit. (cont'd)

Attorney Martin Ward advised councdl to deny request for building permit
for two weeks which is a reasonable time for consideration and study by counsel
and mayor and council.
Parrishes said the building inspector told them he would arrest them if they
did any work on the job.
Attorney Ward' suggested building inspector get engineer to scale property out
to fiud out how the map determines the zone of the property.
Councilman Taylor moved the request for a building permit be denied for two
weeks for further study. Councilman Kinghorn seconded motion with an unanimous
vgte in favor.
ACCEPTANCE OF PORTION OF PONDEROSA STREET -Blue Ribbon Homes has requested that
portion of Ponderosa Street bounded by Lots 21,22,~ 23 and 2~ Block 13, and
Lots 12, 13, 1/~ and a portion of Lot ll~ Block 12, Country Acres 4th Addition
Councilman Kinghorn moved the portiontof Ponderosa as requested be accepted
and approved as city street. Councilman Menard seconded motion with all
councilmen voting in favor.
MOUNTAIN BkJ.T. PERMIT to install service to Bunce Subdivision reviewed by mayor and council. Council approved for Mayor Cotant to sign and approve permit.
MOUNTAIN ~f.T. P~{MIT for terminal location at Scott and Hawthorne reviewed by
Mayor and Council. Mayor and Council did not approve of the terminal being
located in the sidewalk area and suggested Mountain Dell provide another location,
perhaps in the utility easement. Engineer Jensen to contact Mountain Dell on
this proposed change.
IDAHO P~w-ER PE~IT REQUEST to install underground power line across Siphon Road
to serve Paradise Acres Subdivision~ buried line to be twelve feet deep. Council
approved for Mayor Cotant to sign the permit request.
FINANCIAL STAT~/~ENT presented to Mayor and Council for month of June.
CLA]2~S FOR JULY presented to Mayor and Council. Councilman Romriell moved the claims
be paid. Councilman Kinghorn seconded motion ~ith an unanimous vote in favor.
Councilman Menard presented~a claim to Pocatello Masonry for balance of masonry
job at Fire Station. Councilman Taylor moved to approve claim. Councilman
Menard seconded motion with all councilmen in favor.
FIRE STATION TH~OSTAT - Council requests the Fire Department keep the thermostat
at 45° throughout the winter months.
It was moved by Councilman Menard and Seconded by Councilman Taylor the meeting
be adjourned at 12:00 p.m.
