JUNE 24, 1975
Minutes of the regular meeting of the Mayor and Council held in the city municipal
building June 2~4, 1975.
Present: Mayor John O. Cotant, Jr., Councilmen Dwain Kinghorn~ Jack Menard, Earl
Romriell and Wayne Taylor~ Clerk Vera Armstrong. Attorney Don Burnett excused.
Meeting called to order at 8:00 p.m. by Mayor Cotant.
M~yor Cotant asked for any corrections or additions to June 10 minutes. There
being none the minutes were approved as written.
PUBLIC HEARING IT~4: Edward F. Bohrer is requesting rezoning of property belonging
to him that lies west of Yellowstone 91-191 from the presently zoned Residential-3
Livestock zone to General Commercial (C-3) zone. Planning and Zoning Commission
have recommended granting rezoning request.
Councilman Menard moved the council approve for an ordinance to be drawn up to
change the zone of Mr. Bohrer's property from Residential -3 Livestock to
Commercial General (C-3). Councilman Taylor seconded motion with all councilmen
voting in favor.
PUBLIC HEARING ITEM: F~len E. Kurtz has requested a conditional use of the zoning
regulations to a~ow Mr. and Mrs. Kurtz to erect a sign in front of their new
business building, E1 Cielieto Wedding Chapel and Reception Center, 5147
Whitaker Road. Planning and Zoning Commission have recommended approval of
a g foot by 4 foot quiet, shadowed, fluorescent lighted sign ~ near street
providing the sign is seven foot high and be at least eighty (80) feet from
the nearest residence and also a signature type business name sign to be in-
stalled on building and also lighted.
Councilman Romriell moved the council approve the conditional use permit
request of Mr. and Mrs. Dan Kunz as recommended by the Planning and Zoning
Commission, however to allow the street sign to be sixteen (16) square feet only
and Mr. and Mrs. Kurtz to choose the size and the lights on both signs shall be
required not to shine off the signs. Councilman Menard seconded motion with all
councilmen voting in favor of motion.
PUBLIC HEARING IT~: Rodney Clark, Clark REal Estate, requests a variance of Zoning
ordinance requirements to allow the construction of a duplex on the north one-
half of Lot 12, Block 2 in the Neider 1st Addition, not having the required
front yard and rear yard setback. Planning and Zoning Commission have re-
commended this variance request be denied. A large representation of the Neider
Addition were present to object to variance request.
After a lengthy discuss'ion Councilman Taylor moved the variance request of
Roduey Clank not be granted. Councilman Romriell seconded motion with all
councilmen voting in favor.
STREET ACCESS T~ HEIGHTS SUBDIVISION - Approximately forty residents of the Neider
1st Addition were present to object to the extension of Boyd Street into the
Heights Subdivision. Numerous residents objected to the increased traffic flow
thru the Neider 1st Addition.
Mayor Cotant recommended approval or disapproval be tabled at present so the
council might have the opportunity to talk to Rodney Clark about any proposed
change.
Grant Anderson, Engineer of Heights Subdivision stated that a change at this
time would be costly and the city has more or less approved the final plat
as drawn ·
Rodney Clark attended meeting later in the meeting and told Mayor Cotant and
Council that he would be in f~ll agreement to closing the proposed Boyd Street
and he would provide a sidewalk ~ from Heights Subdivision to Neider 1st
Addition for walk traffic.
SEWER SERVICE LINE - Dee Greene has submitted a claim to the city for an
extension of the sewer service line into the street. The claim amounts to
$2~9.56. The claim states the sewer stub-in was too high to serve residence.
Councilman Romriell suggested this be tabled for further study.
ORDINANCE ~152 - Amending Ordinance //97 of the City of Chubbuck by repe~ling
Chapter 6 thereof in its entirety and enacting a new Chapter 6 entitled
"~nforcement" and containing particular sections relating to recording of
plats, sale of land in subdivisions, locations of structures or improvements,
issuance of permits and provision of municipal services or public improvements.
Ordinance was read in full by Mayor Cotant as third reading.
Councilman Romriell moved council adopt Ordinance ~152. Councilman Kinghorn
seconded motion. Roll call vote: Kinghorn, yes; Menard~ yss; Romriell, yes;
Taylor, yes.
SAFE ~ND SANE FIREWIRKS - Leona Harral asked why the City of Chubbuck is allowing
firecrackers to be sold in the city. Mayor and Council told Mrs. Harral they
were not aware firecrackers were being sold in Chubhuck and the city will
have the police department check this out.
SF~ER SERVICE LINE - Rodney Clark requests permission from city not to be re-
quired to install sewer service line at 1t~ West Chubbuck Road. Mr. Clark
told mayor and council this property is intended to be used commercially within
approximately one year. Mayor and Council informed Rodney Clark the ordinance
requires all residents to hook up to sewer within 60 days of availability and
the city could not make any exceptions.
TRA~V.ER AT END OF BRISCOE STREET - Councilman Romriell requested the Attorney
take action on Earl Ellis for placement of trailer at end of Briscoe Street.
Court action should still be pending on this case.
ABSENCE OF ATTORNEY - Councilman Menard asked Mayor Cotant if Attorney Burnett
would provide an assistant attorney while he is out of town. Mayor Cotant
said he would talk to Attorney Burnett next week on this matter.
Sewer Service LINE - Councilman Menard reported he and Engineer Jensen had inspected
the sewer service problem at Mrs. Cantu's residence at 206 Henry and determined
the city could provide service from Mesquite Street with less problems than
digging into Henry Street.
HEIGHTS SUBDIVISION FINAL PLAT - Grant Anderson and Rodney Clark were present and
discussed the Heights Sbudivision final plat. Rodncy Clark again informed
mayor and oouncil h~ would consent to the closing of extension of Boyd Stree.~
if so desired and would construct a concrete sidewalk thru from Heights Subdivision
to Neider 1st &ddition. Council decided to table action this evening for
further consideration.
PROPOSED TRAl%MR PARK VARIANCE REQUEST - Rodney Parrish questioned council if they
had applied for a sewer easement under the Railroad Right of Way. Council in-
formed Mr. Parrish the city has not made application for an easement. Discussion
followed on proposed trailer park development.
HEIGHTS SUBDIVISION DEVELOPMERT - An extended discussion followed on construction of
sewer lines in Heights Subdivision. CouncJJ~nan Menard told Engineer GRant Annderson
he had seen too large of rock put back in trench. Mayor Cotant requested East
Chubbuck Road be patched and repaired properly. Mr. Anderson told mayor and council
he would see that the Chubbuck Road outs were repaired properly Wednesday morning
and would follow through on rock in trenches.
AIC CONVENTION - Councilman Kinghorn reported on his attendance at the convention
in Idaho Falls the past week. Councilman Kinghorn said Shirl Boyce with State
Planning would meet with the city and explain the new Land Use Planning Act.
