May 27, 1975
Minutes of the regular council meeting of the Mayor and Council held in the city
municipal building May 27, 1975.
Present: Mayor JOhn O. Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard and
Earl Romriell, Clerk Vera Armstrong and Attorney Don Burnett. Wayne Taylor
excused,
Mayor Cotant asked for corrections or additions to May 13 and ~Oth minutes. There
being none Councilman Romriell moved and Councilman Kinghorn seconded motion the
minutes be approved with all councilmen voting in favor.
SEWER SERVICE LINES - Boyd Fullmer, 715 Victor, has requested 2~0.00 for relaying
his sewer line because of depth not being deep enough. Mayor and Council discussed
the city participation on relaying this sewer service line and their determination
was the city would stand 150.00 only on cost of relaying the line.
SEWER PROJECT - Mayor and Council requested the public be made aware that the sewer
project will be terminated July 1st and the city can not be responsible for
changes required on service lines a£ter this date.
WATER B]7.LING - Mayor and Council discussed delinquent city utility bills. After
discussion it was agreed to leave procedure as is. Councilman Kinghorn requested
an up to date list of delinquent accounts on July 1st.
SUBDIVISION PROCEDURES - Engineer Doug Jensen suggested the city determine certain
standards and check points on Subdivision development.and made the following
suggestions.
1. Once or twice a month inspection of subdivision develounents.
2. Agreement on placement of utilities.
3. All utilities to be shown on as constructed drawings, e.g., gas & electric.
Engineer Jensen stated that the consulting engineers should certify that the
project was constructed according to as ~onstructed drawings.
Engineer Jensen told council Forsgren, Perkins and Assoc. would be glad to do
the follow-up of contacting contractor when any inspections by city personnel
prove unsatisfactory.
ENGINEERING SERVICES - Engineer Jensen suggested the city make agreement with city
engineers, Forsgre~, Perkins & Assoc. on a project by project basis with a cost
estimate from the engineer~.
T~ SUBDIVISION - Doyle Chatterton, developer of Turner Subdivision, was present
and reviewed the development of the Turner Subdivision. Engineer Jensen question-
ed Mr. Chatterton as to his sewer line installation to serve the lots £acing
Chubbuck Road which were not installed according to plat. Mr. Chatterton informed
council he was told the hook-ups could not be made from East Chubbuck Road.
Engineer Jensen informed Mr. Chatterton the sewer line as he constructed would
serve the lots but the city would need a legal easement of twenty (20) foot width.
Councilman Menard requested Doyle Chatterton provide easement £or contructed
sewer line and proposed sewer lines if not constructed according to plat to the
Chubbuck City. Also, that Mr. Chatterton show the sewer easements on a revised
plan and that Engineer Jensen be required to approve depth of sewer line to be
constructed to serve the back lots.
MOUNTAIN R~J, PERMIT -Mayor, Council and Engineer Jensen reviewed a permit request
from Mountain Bell. It was suggested the city require the cable to be two foot
from the north property line as the city is planning to install a sixteen (16)
inch water line on the north side of East Chubbuck Road. The city also will
require Mountain Bell to install cable at a depth of thirty (30) inches instead
of the twenty four (2~) requested. Mayor and Council requested Engineer Jensen
to inform Mountain Bell of the above requests and ask them to notify the Chubbuck
City Engineer when installing cable because the city wants to inspect their
cable installations within the city.

ORDINANCE #1~9 - Amending Ordinance #1~5 to correct an error in the legal description
of lauds excluded from the City, Striking from Ordinance ~1~5 the legal description
~.Df all the boundaries of the City of Chubbuck. Ordinance ~1~9 was read in f~ll
by Mayor Cotant.
Councilsan K~nghorn moved to dispense with rule of reading on three separate days.

yes. Councdlman Menard mOVed to adopt Ordinance ~ld9, Councilman Romriell seconded
motion, roll call vote: Kinghorn, yes~ Menard, yes; Romriell, yes.
ORDINANCE #150 - Annexing certain lands to be included within the boundaries and
jurisdictional limits of tbs City of Chubbuck, Idaho and specifying the zoning
classification. Ordinance #150 read in full by Mayor Cotant. The majority of
this property is now owned by Archie Cutler.
Councilman Romriall moved to dispense with rule of reading on three separate days,
Councilman Kinghorn seconded motion. Roll call vote: King, horn, yes; Menard, yes;
Romriell, yes~ Councilman Kinghorn moved to adopt Ordinance #150 with Councilman
Menard seconding motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes.
ORDINANCE ~lS1 - Providing for certain lands and property within the boundaries of
the City of Chubbuck known as Bunce Subdivision be re-zoned and changed from
Agricultrual Transitional (AT) to Residential -1 (R-l); providing for certain
lands and property withiu the boundaries of the Cib~ of Chubbuck known as the
Heights Subdivision to be rezoned and changed from Agricultural Transitional (AT)
to Combined Residential -2 (E-2) excepting therefrom a portion of said lands
and property herein described rezoned and changed from Agricultural Transitional
(AT) to Multiple Residential-3 (R-3). Ordinance #151 was read in f~l by Mayor
Cotant.
Councilman Romriell moved to dispense with rule of reading on three separate days.
Counc~an Menard seconded motion. Roll call vote: Kinghorn, yes$ Menard, yes$
Romriell, no. Councilman Menard moved to adopt Ordinance #lS1 with Councilman
Kinghorn seconding motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell,
no.
ORDINANCE ~152 - Amending Ordinance ~97, Subdivision Ordinance, repealing Chapter 6
in its entirety and enacting in substitution therefore a new Chapter 6 entitled
"Enforcement" and containing ssctions relating to recording of plats, sale of
land in subdivisions. Mayor Cotant read Ordinance in full as first reading.
SEWER SERVICE OUTSIDE CITY L~ITS - Acknowledgment of conditions relating tc provision
of sewer service outside boundaries of city read in full by Mayor Cotant. Acknow-
ledgement of conditions was discussed at length, with council deciding to study
further.
VARIANCE REQUEST - Rodney Clark questioned procedure of variance request on lot in
Neider Addition where he desires to place a duplex. Council agreed to set up a
Planning and Zoningg Commission public hearing on June 19th to handle all public
hearing items.
WATER REVENUE BOND ISSUE - Attorney Burnett was instructed to proceed with legal steps
to set up the necessary motion for a bond election.
WATERLINE IMPRO¥~ENTS - Councilman Menard moved the city direct Engineer Jensen to
call for bids for lO inch water pipe necessary to construct water line from Joy
Street to Heights Subdivision on West Chubbuck Road if materials exceed $5,000.00
Counc~d~man Romriell seconded motion with all councilmen present in favor.
Councilman Romriell moved the claim to SA-SO Inc. in the amount of $271.16 be approved
for payment, Councilman Menard seconded motion with all councilmen voting in favor.
