Cotant, Councilmen Dwain Kinghorn, Jack Menard, Earl Romriell and Wayne Taylor. Attorney Don Burnett and Clerk Vera Armstrong. Councilman Kinghorn moved the March llth and 18th meeting be adjourned. Councilman Taylor secondod w/th all councilmen in favor. Meeting called to order by Mayor Cotant at 8:00 p.m. Mayor Cotant asked for corrections or additions to March ll and March 18 minutes. Councilman Romriall roquested the word "high" be added to doscription of screeniug fence required in the action ta. ken at March ll meeting in regards to Dorman Fenners variance request. Councilman Romriell also asked the minutes state that Councilman Romriell said "Other considerations may have been given had Dr. Paniagua-Diaz been present at meeting." This addition to March ll minutes. Councilman Romriell asked clerk to insert "Romriell" as councilman making motion to adopt Resolution #3-75 in March ll minutes. City Clerk told council George Shiozawa had called and asked that his request for the installation of a backflow valve be added to March ll minutes. Clerk was directed to make addition to March ll minutes. Councilman Romriell moved the minutes of March ll and 18 meetings be approved as corrected. Councilman Kinghorn seconded motion with an unanimous vote in favor of motion WAT~ LINE IMPROV~TS - Dan and Ellen Kunz were present to discuss the possibdlity of an easement for a future city water line west from Whitaker Road. Mr. and Mrs. Kunz are constructing a street to the parking area of their proposed re- ception center, which they will be paving, and asked city council if the city would like an easement for a future water line. Mayor and Council told Mr. and Mrs. Kunz the city would like an easement for a future water line. City will have engineer survey the area. Councilman Romriell moved the city have the engineer survey the area for easement description and Attorney Burnett prepare the easement and that the consideration be $1.00 cash plus other good and valuable consideration. Councilman Menard seconded motion with all councilmen voting in favor or motion. Attorney Burnett requested the previously read Ordinance be numbered ~1~6 instead Councilman Kinghorn moved Ordiuance annexing certain lands to the City of Chubbuck which is the ordinance annexing "Paradise Acres Subdivision" be renumbered ~1~6 instead of ~l&5. Councilman Taylor seconded motion with ell councilmen voting in favor of motion. ORDINANCE # 1~5 - Excluding certian lands from the City of Chubbuck. Mayor Cotant read exclusion Ordinance #155 in full. Councilman Taylor moved the council dispense with rule of reading ordinance on three separate days. Councilman Menard seconded motion. Roll call vote: Kinghorn, yes; Mena~d , yes; Romriell, yes; Taylor, yes. Councilman Kinghorn moved the councdl adopt Ordinance #1&5. Motion seconded by Councilman Taylor. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. ANNEXATION ORDINANCE #l&6 - annexi6~ "Paradise Acres Subdivision". This ordinance was read in full at March 18 meeting. Councilman Romriell moved the council dispense with rule of reading ordinance on three separate days. Councilman Kinghorn seconded motion. Roll call vete: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. ANNEXATION ORDINANCE ~i46 -cont'd- Councilman Menard moved to adopt Ordinance ~1~6. Motion seconded by Councdlman Taylor. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes, Taylor, yes. ANNUAL APPROPRIATION ORDINANCE #1~7 - appropriating the several sums of money deemed necessary and sufficient to defray all the expenses and liabilities of the City of Chubbuck for the fiscal year beginning on the 1st day of Jan- uary, 1975 and endiug on the 31st day of December, 1975~ read in full by ~' Mayor Cotant. Councilman Taylor moved to dispense with rules of reading ordinance on three separate days. Councilman Kiughorn seconded motion. Roll call vote: Kinghorn, yes;.Menard, yes; Romriell, yes; Taylor, yes. Councilman Romriell moved to adopt Ordinance #147. Councilman Taylor seconded '~ motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes.'' ANNEXATION OF STREETS - Councilman Menard suggested the city annex the north half ~ of Quiun Road from Pole Line Road west to Hawthorne Road, the east half of Hawthorne Road from Quinn Road north to Interstate 15 West. Also the north end of Pole Line Road from Quinn Road to Yellowstone Highway. This portion of Pole Line Road supposedly is now in Pocatello city limits but the City of Chubb~ck borders the east and west side of street. This portion of Pole Line Road may need to be excluded from Pocatello limits prior to Chubbuck annexing same. Mayor Cotant requested Engineer Jensen prepare descriptions of these streets or portions of streets so the city attorney can prepare annexation ordinance. ORDINANCE ~148 - Prohibiting peddling or peddlers read im full as the first reading. Councilman Romriell questioned not allowing use of loud speakers in the ordinance. Attorney Burnett said he could alter the language to allow certain sound devises when the city ~llow the use and it be noted on license. Councilman Romriell moved the attorney alter ordinance as suggested. Councilman Taylor seconded motion w~ith all councilmen voting in favoD. A discussion followed as to what type of business or salesman would require a license. BUSINESS LICENSE APPLICATION - Gary Long has applied for a business license to do mobile home skirting from his pick-up truck. Council tabled discussion until more study is given to the peddler or "green river" type ordinance read. PATROLMAN SALARY - Councilman M~nard informed council he had talked to Chief of Police on salary pay schedule and Chief Stone has requested some salary changes for the present. Mayor and council determined the city has made the salary increases and salaries will remain as they are. CABLE TV FRANCHISE - Councilman Romriell said he felt the cable TV franchise ~ should be increased to more than $100.00 per year. Attorney Burnett to study ordinanc e. WATERLINE ]MPROV~TS - Attorney Burnett reported to council, Jerry O'Neal, Environmental Services Division, had contacted him and asked the city have the ~ city engineer outline waterline project anticipated and have the city ask for ~ waiver on grounds no significant engineering required on work contemplated. S~ER RATE ADJUSTMENT - Attorney Burnett read memorandum to council on Mr. Shiozawas' request for sewer rate adjustment. Attorney Burnett read resolution he has prepared requesting HUD approve sewer rate ordinance to allow outside city sewer rates to be the same as inside city limit rates when the party has provided ~ an easement for sewer construction. Council will study this. STATE HIGHWAY PROJECT - Mayor Cotant read letter from Darrell Manning,director of State of Idaho Transportation, reporting on the highway project through Chubbuck. Mayor Cotant said he wo~ld write Mr. Manning encouraging project to be considered as soon as possible.
