HomeMy WebLinkAbout03 18 1975 CM COUNO~ MEETING MINUTES 175 March 18, 1975 Miuutes of March 11 recessed meeting of Mayor aud Council held in the City Municipal Building March 18, 1975. Present: Mayor John Cotant, Councilmen Dwain Kinghorn, Jack Menard and Earl Romriell. Attorney Don B~nett and Clerk Vera Armstrong. Councilman Romriell excused until 9:00 p.m. Meeting called to order at 8:05 p.m. by Mayor Cotant. Purpose of the meeting other than regular business was to hold a public hearing on annexation of the Paradise Acres proposed subdivision. SANITATION - Edna~ Bayliss, 150 W. Linden asked council to enforce ordinance re- quiring residents to place lids on their garbage cans. Mayor and council told Mrs. Bayliss they would talk to the sanitation picl~up employee and ask him to tag cans without lids. A general discussion followed on city clean up. Rodney Parrish requested Myrtle's dumpster be placed on north side of Myrtle's Cafe instead of on Diversified Investment property. WATER DEVELOPMENT PROGRAM - General discussion was held on the present Chubbuck water system and improvements desired by the city, which mainly consists of enlarged storage tank and larger transmission line from storage tanks down to the residential areas of the city. Mayor and Council talked with Dan and Kent Kunz concerning an easement for a water line from Whitaker Road west to line up with Hiway Avenue. Mayor and Council said this could be planned out and whatever would be best for Mr. Kunzs' future development could work out for the city also. Councilman Romriell suggested some time for city to study the future plans in area. ~IC HEARING ON ANNEXATION OF PARADISE ACRES - Mayor Cotant read the notice of public hearing on this annexation. City clerk read Planning and Zoning commission minutes on public hearing held at 7:00 p.m. this evening in regards to zoning of Paradise Acres development. Planning and Zoning have recommended the reserved area be zoned Agricultural Transitional and the balance of the proposed subdivision be zoned Residential 2 (two). Councilman Romirell stated he felt the area reserved for commercial should be zoned C-1 (neighborhood) at ~the present time. A lenghthy discussion followed with a suggestion from Attorney Burnett to amend zoning ordinance so multiple housing would be a 6onditional use instead of an allowed use in the C-1 zone. Councilman Romriell moved the Attorney prepare an annexation ordinance to annex Paradise Acres subdivision. Councilman Menard seconded motion with an unanimous vote in favor. Councilman Menard moved the council zone Parcel A which is area reserved along Siphon Road for future development be zoned Agricultural Transitional and Parcel B which is the balance of the Paradise Acres Subdivision be zoned Residential -2 (two). Councilman Kinghorn seconded motion. Roll call vote: Kinghorn, yes; Me~ard, yes Romriell, no. ORDINANCE ~1~5 - Annexing and Zoning Paradise Acres was read in full by Mayor Cotant and Attorney Burn~tt as the first reading. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes. SL~MONS AGAINST MICHAEL METCALFE for operating a business in a residential zone. Mr. Metcalfe questioned council on what constitutes a business. Councilman Kinghorn said he felt exchange o£ goods for profit would be a business and Councilman Menard stated he felt the sale of or conveying of merchandise for profit would be a business. Mr. Metcalfe told council he was not d~ing business from his home but from Stevens Stationers at 159 South Main Street. Most of his orders are picked up C.O.D. at the Post Office and Mr. Metcal£e delivers merchandise to the party ordering. After some discussion Councilman Menard moved Attorney Burnett draw up a stipulation and if Mr. Metcalfe will sign, the case can be dismissed. Coucilman Romriell seconded motion with ell councilmen voting in favor. CIRCLE IN ~RAI~,ER PARK - Glen Kinlock stated children from Circle In Trailer Park area~are trespassing on his property. Mr. Kinlock requested council require the six foot screenings,fence be constructed and also requested the sidewalks be installed on Lish Street which Mr. Frasure said he would do. Mayor Cotant told Mr. Kinlock the city would invite Mr. Frasure to council meeting to discuss this with him. 175 Councilman Menard moved the meeting be recessed at 11:~5 p.m. ~John O.
