Present: Mayor John O. Cotant, Jr., Councilmen Dwain Kinghorn, Jack Menard, Earl Romriell, Wayne Taylor, Attorney Don Barnett and Clerk Vera Armstrong Councilman Kinghorn moved the recessed meeting of February 11 be adjourned. Councilman Taylor seconded with an u~animous vote in favor. Mayor Cotant called meeting to order at 8:05 p.m. Mayor Cotant asked for corrections or additions to February 11 minutes, there being none they were approved as written. PARADISE ACRES - Northwest Development Company represented by Dean Lloyd, Jim Carley and Engineer Doug Jensen presented the Paradise Acres final plat and because of county zoning requirements which they would prefer not to meet requested annexation of the area platted to the City of Chubbuck? After discussing steps of annexation it was determined; after city receives from Northwest Development Company a letter requesting annexation of proposed subdivision area reserved for commercial area being zoned C-1 (neighborhood commercial) and balance of subdivision being zoned Residential - 2, the city would hold a public hearing on the zoning request March 18 and council will have attorney prepare legal work so the annexation ordinance could be adopted at the council meeting public hearing also on March 18. Further final plat discussions - Engineer Jensen informed mayor and council a pumping station for the proposed sewer utility will need to be installed. Northwest Development was informed by council the station would need to be . undergret~nd. The participation on the new pump for Well #3 was discussed. Mr. Lloyd said that in his original proposal they had agreed to a maximum participation of $15,000.00 and wo~uld like to keep their expenses to that amount. Councilman Menard suggested the city participate 10~ cf costs. Mayor, council and Mr. Lloyd agreed to 90~ participation by developer and 10~ by the city. Dean Lloyd requests the pump be put in as soon as possible because of trend of increased Mayor and council discussed procedures for installation of pump this year. It was decided the cost of well to developer would be estimated revenue and the complete cost of well pump installation could be a budgeted item in the water- works budget. The bids will be prepared and installation planned as soon as possible. Attorney Barnett suggested the developer attend the bid opening and present the city with a check for 90~ of costs at time bid is accepted. Mr. Lloyd stated they would agree to this and would prefer to review bids along with council since they are paying 90~ of costs. LOW SPOT ON PARRISH DRIVE - Councilman Menard asked Engineer Jensen what the solution to this iow spot is. Mr. Jensen said he understood the city planned to install a dry well at this point. Council agreed this would be necessary. SEWER SERVICE LIN~S TO PAP~LISH LOTS - Mayor and council discussed the service lines installed to vacant lots belonging to Parrishes that had not been ordered through city and have not been paid for. SEWER SERVICE LINE TO PARRISH COMPANY STORE - Councilman Menard reported to council he felt the proper way for the sewer line to be installed to the Parrish Company Furniture Store is behind the store and hook onto the service line installed to property line on Parrish Drive by Oregon Construction. Attorney Barnett told council if the engineering and city determines this the best possible location for installation of service line he sees no reason for non compliance. City Clerk was requested to send certified letter, return receipt requested, notifying the Parrish Company Store representative the delinquent sewer charge public hearing will be re-scheduled for March fi at 9:00 p.m. SEWER PROJECT - Closing of the sewer project discussed by mayor, council and engineer. The city has not received final grant money from E.P.A. and HUD. This has been an extreme hardship on contractor and his suppliers and sub- contractor~. Federal EPA has had clearance from State EPA approval for approximately two weeks. City feels bonding company will assess someone for the blame of Oregon not recei¥img final payment sooner. Engineer Jensen informed council State and EPA states grant conditions specify they have one year to inspect and pay grant money, however, he has not been able to find this printed in the copy of conditions he has. Mayor Cotant asked Engineer Jensen what the city could do to get this moving. Council suggested contacting US Senators. Mayor Cotant suggested the city contact HUD in Portland for some suggestions. Engineer Jensen stated the city could hurt themselves by improper handling of situation. Engineer Jensen suggested city contact bonding company and verify contractors statement of when he could expect final payment. This has been postponed numerous times because of spections, etc. and Mr. Gadd was informed he could expect payment by March 1st and now this date cannot be met. Councilman Menard suggested amending the zoning ordinance so ~ annexations can be made to city according to state statu~e. SEWER BOND RETIRtMENT AND OPERATION AND MAINTENANCE RESERVE FUND - City clerk was instructed to open these accounts with the Idaho First National Bank~ PU~IC HEARING CONCERNING ROUSING AND COMMUNITY DEVELOPM~NT PROGRAM - Mayor and council directed city clerk to publish public hearing notice that this hearing will be held in conjunction with regular council meeting March ll, 1975. Attorney Burnett presented council a form letter to be sent to owner of property not connected to city sewer line. This ~etter was read in full by Mayor Cotant. City clerk was instructed to send letter and questionnaire form requesting information on intentions o£ sewer line installation to all owners of property not connected to city sewer line. C~PLAIN~ FOR INJUNCTIVE RELIEF AGAINST M.R. Metcalfe presented to MaYOR~.Cotant for his signature by Attorney Burnett. DENNY'S 0IL CC~°LAINT - CounciLman Romriell questioned what report the city had received from Denny Jones on cleaning up wrecked cars at his place of business No report has been received and Attorney Burnett was instructed to proceed with legal action. POLICE RESERVE OFFICERS - Attorney Burnett read numerous actions the city could be liable for in respect to the reserve officers and also made a report of coverage the city has in regard to insurance coverage. STANDARDS FOR MOBILE R~MES - Attorney Burnett presented booklets to mayor and council on standards for mobile homes for their study.
