HomeMy WebLinkAbout01 14 1975 CMCOUNCIL MEETING MINL~ES Jauuary 14, 1975 147 Minutes of the regular meeting of the mayor and council held in the city municipal building January 14, 1975. Present: Mayor John O. Cotant, Councilmen Dwain Kinghorn, Jack Menard, Earl Romrlell and Wayne Taylor. Attorney Don Burnett and Clerk Yera Armstrong. Councilman Menard moved the recessed January 2 meeting be adjourned. Councilman Romriell seconded with an unanimous vote in favor Meeting called to order at 8:05 p.m. by Mayor Cotant. Mayor Cotant asked if there were any corrections or additions to minutes. There beiug none Cbuncilman Kinghorn moved and Councilman Romriell seconded motion the minutes of December, January 2 and addition to November 12 minutes be approved. SUB DIVISION PLAT- Mark Bunce presented a pre-application on a proposed subdivision planned for the north side of East Chubbuck Rd in the 800 block. Mayor and Council reviewed the plan and approved for the mayor to sign the general layout of the pre-application plat. MEETING FOLLOW UP - Counc~dman Kinghorn asked if any additional action had been taken on services of utility construction to the proposed Portneuf District Bibrary building. No further agreements have been discussed,. Attorney Burnett requested the council work on agreement on utility construction service provided by the city with the Library Board. ORDINANCE #1~l - Governing wrecked, abandoned and inoperable vehicles read by title only by Mayor Cotant. This ordinance was read in full December 10. Section 8 has been amended aud Mayor Cotant read Section 8 in full. Councilman Menard moved the council dispense with the rule of reading on three separate days. Councilman Taylor seconded. Roll call Vote; Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. Councilman Kinghorn moved Ordinance #141 as read be adopted. Councilman Romriell seconded motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriall, yes; Taylor, yes. INTERIM APPROPRIATION Ordinance #140 was read in full by Mayor Cotant. Councilman Taylor moved to dispense with the rule of reading on three separate days. Council- man Romriell seconded motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. Councilman Menard moved the council adopt the Interim Appropriation Ordinance #140. Councilman Taylor seconded motion. Roll call vote: Kinghorn, yes; Menard, yes; Romriell, yes; Taylor, yes. DISANNEXATION ORDINANCE - Don Burnett informed council he is awaiting information so he can prepare ordinance disannexing the Motheral property and ordinance requiring building permit on trailer homes placed on residential property. ORDINANCE #1~2 Amending Ordinance ~78 providing for increased ready to serve charges relating to municipal water service within the city and outside the city limits was read in full by Mayor Cotant. Mayor and Council reviewed Ordinance //78 and decided to table this ordinance and amendment until council studies and reviews SOUTHWESTERN IDAHO DISTRICT HFALTR - have requested an increase from Chubbuck for county health services from an amount of $1,7~0.00 to $2,255.00. Mayor and Council will consider this in the 1975 budget. BANNOCK HL~ANE SOCIETY - Attorney Burnett informed Mayor and Council he had received a couple sample agreements of humane societies providing animal control service to cities and will provide the council with copies. SAWER DEPOSIT - Attorney Burnett informed council a letter has been received from HUD approving refund of $30.00 sewer deposit after credit has been established. Mayor and Council instructed Attorney Burnett to amend ordinance for adoption. 1~9 COUNCIL MEETING MINUTES · Ja~.uary 1~, 1975 SEW~I~ HOOK UPS - Attorney Burnet~uestioned council as to their desires on taking legal action against residents that have not hooked u~ to sewer. Mayor smd Council requested Attorney Burnett draft a letter for the city to send to these residents asking them to notify the city of their intentions on installation of their sewer service line. ANTENNA - Councilman Romriell asked Attorney Burnett to research the city ordinances and find out if large antenna installed on Jerry Tydeman's home is legal. Mayor and Council also discussed the fact that Mr. Tydeman is running a business from ~ his home. COMPLAINT AGAINST DENNY JONENS - Denny Jones was present to discuss the complaint fJ~ed against him. Mayor and council discussed Denny's business and the zone required for his wrecker business. Fencing of his storage area was discussed. Attorney Bnrnett recommended the city require the land use of Denny's property be changed to comply with the Chubbuck zoning ordinance. Mayor Cotant requested Mr. Jones make a sincere effort to clean up his property and possibly find property elsewhere to store these vehicles and meet with council in thirty (30) days again. SUNSHINE INITIATIVE AMENDMENT - Mayor and Council requested Attorney Burnett acquire necessary forms so they can do the necessary corresponding with legis- latures on proposed bills for the upcoming session. FINANCIAL STATENENT PRESENTED to Mayor and Council. CLAIMS FOR JANUARY presented to Mayor and Council. Councilman Romriell moved the bills be paid. Councilman Kinghorn seconded motion with all councilmen voting in favor. Mayor Cotant reported he had talked to Engineer Perkins about claims and complaints filed with city. Engineer Perkins suggested a city representative and the engineer review these claims with the claimants and come to a determination on which claims had not been satisfied by Oregon Construction so some action can be taken care of on them. POLICHMEN IN POCAT~.T,O - Councilman Kinghorn questioned the Chubbuck policemen being in Pocatello and also traveling back and forth so often. After a short discussion the mayor and cotmcil made plans to meet with police department at 5:30 p.m. Thursday. Meeting recessed at 11:20 p.m. John O. Co'ant, Jr., ~r Vera C. COMPLANNT AGAINST DENNY JONES - The reason the city has been lenient is because Mr. Jones had made promises to council that he would do something about his situation. (REWORDING OF ATTORNEY BURNETT'S RECOMMENDATION) Attorney Burnett recommended the existing land use of Denny's 0il be discontinued as to any conflicting use and any future land use comply with the city zoning.
