COUNCIL MEETING MINUTES
November l, 1977
Minutes of the recessed meeting of October 27 held in the city municipal
building November 1~ 1977.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, Earl L. Romriell, Wayne G. Taylor, Attorney Don Burnett~ and
Clerk Vera Armstrong. Engineer John Alder excused.
Meeting called to order at 5:10 p.m. by Mayor Cotant.
AWARD OF BID ON "LOCAL IMPROVEMENT DISTRICT #1 for CHUBBUCK, IDAHO."
Engineer Steve Smart, Forsgren, Perkins and Associates stated that in
going over the bid proposal of Empire Construction Company there appears
to be a technical error in the hand written unit price of asphalt street
construction.
Attorney Burnett informed council the contract provides that the owner has
the right to waive any discrepancies that occur.
Wayne Taylor, co-owner of Empire Construction informed Engineer Steve
Smart, Klane Forsgren, Attorney Don Burnett, Mayor Cotant and Councilmen
that rather than have the council decide whether or not to waive the
irregularity, Empire Construcion would prefer to withdraw the bid. Mr.
Taylor added, if irregularities were waived and the result challenged it
would result in a delay of the work to be done.
Engineer Steve Smart of Forsgren, Perkins and Associates then recommended
the city accept the next lowest bid from Bannock Paving Company Inc.
RESOLUTION 14-77 - determining Bannock Paving Co., Inc. to be the lowest
responsible bidder was read in full by Mayor Cotant.
Councilman Romriell moved to adopt Resolution #14-77. Councilman Fullmer
seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell,
yes. Councilman Taylor abstained from voting.
There being no further business the meetin~ was adjourned at 5:35 p.m.
