Minutes of the October 25th recessed meeting held in the city municipal
building October 27, 1977.
Present: Mayor JOhn O. Cotant, Jr., Councilmen Dwain A. Kinghorn, Earl
L. Romriell, Wayne G. Taylor, Engineer John Alder, Attorney Don
Burnett and Clerk Vera Armstrong, Councilman Boyd Fullmer excused.
Meeting called to order at 7:55 p.m. by Mayor Cotant.
LOCAL IMPROVEMENT DISTRICT #1, IMPROVEMENTS ON WEST BURNSIDE - The
developers, Reliance Investment Inc., and Interstate Group Inc. have
agreed to provide assurance to city of interim financing and a guarantee
that a bid will be tendered when the bonds are sold.
The city has received letters from Valley Bank signed by S. Rick Meikle,
Assistant Vice President and Assistant Manager, offering to provide
interim financing in the amount of $90,000 on the West Burnside L.I.D.
project. Valley Bank have also written a letter to city guaranteeing that
they will tender a bid on the West Burnside L.I.D. #1 bonds when they
are placed on market.
An agreement among property owners designating financial responsibility
in regards to the West Burnside L.I.D. has also been signed by all of the
property owners and is on file at city office.
ORDINANCE #184 - Creating and describing "Local Improvement District #1
for Chubbuck, Idaho", providing for certain improvements on West
Burnside Avenue, assessment of costs, providing for assessment roll,
providing for improvement bond as prescribed by subsequent ordinance,
pursuant to law~ providing for plans and specifications for construction
and calling for bids as provided by Chapter 17, Title 50, Idaho Code and
providing for when this ordinance shall become effective, was read in full
by Mayor Cotant and Attorney Don Burnett.
Because the agreement among the land owners has been signed by all land
owners and will be signed by the city, the conditional protest filed
by Parrish Realty will be withdrawn because of the conditions being
satisfied.
Councilman Kinghorn moved to dispense with rule of readilng ordinance on
three separate days. Councilman Taylor seconded motion. Roll call
vote: Kinghorn, yes; Romriell, yes; Taylor, yes.
Councilman Taylor moved to adopt Ordinance #184 creating and describing
"Local Improvement District #1 for Chubbuck, Idaho". Councilman
Romriell seconded motion. Roll call vote: Kinghorn, yes; Romriell, yes;
Taylor, yes.
AWARD OF BIDS ON L.I.D. PROJECT. The advertisement calling for bids has been
published in the official newspaper for the city and bid opening has been
scheduled for this evening.
The following bids were received within the proper time and were opened
by Mayor Cotant; Bannock Paving, $75,704.86; Joe Campbell Construction
Company, $85,287.47; Bengal Construction Company, $82,095.00; Empire
Cosntruction Company, $74,758.51
Bid bonds were checked by Attorney Don Burnett and found to be in order.

AWARD OF BIDS ON L.I.D. PROJECT cont'd - Attorney Burnett said he saw
no reason why the Engineer could not review the bids and determine the
lowest responsible bidder, inform the contractor he is the apparent
low bidder and the contractor could prepare to proceed with construction
as the bid can be awarded as soon as ordinance is published.
Engineer Steve Smart, Forsgren, Perkins, & Associates reviewed the bids.
Mr. Smart noted Empire Construction had entered an extended figure in the
unit price column. Attorney Burnett remarked this technicality should
create no legal problem.
Mr. Smart also noted Bengal Construction's bid did not have the corporation
stamp, and Campbell Construction Company did not submit an addendum.
City must award the bid by resolution after publication of ordinance
and it was determined by council and mayor the meeting could be recessed
until Tuesday, November 1 at 5:00 p.m.
Councilman Taylor moved the meeting be recessed until 5:00 p.m. Tuesday,
November 1st. Councilman Kinghorn seconded motion and all councilmen
were in favor.
