HomeMy WebLinkAbout06 28 1977 CM COUNCIL MEETING MINUTES Juhe 28, 1977 229 Minutes of the regular council meeting held in the city municipal building June 28, 1977. Present: John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, Earl L. Romriell, Wayne G. Taylor, Engineer John Alder and Clerk Vera C. Armstrong. Attorney Don Burnett excused. Meeting called to order at 8:00 p.m. Mayor Cotant asked for any corrections or additions to minutes of June 14, 16, and June 22nd meetings. Councilman Romriell noted the motion and second to waive requirement of reading Ordinance #179 on page 223 states both were made by Councilman Kinghorn. City clerk checked written minutes, motion was made by Councilman Fullmer. Councilman Romriell moved to accept minutes as written with correction noted. Councilman Fullmer seconded motion with all councilmen in favor. ZONING AND VALUATION OF CITY PROPERTIES - Mayor Cotant noted two adjoining properties in city, both acreages used for pasture, having a valuation differential of several hundred dollars. Council felt this should be researched and discussed with Bannock County Assesor, Ralph Lacey. ANNEXATION OF DELL ROAD AREA - west of Hawthorne Road to sewer easement and from Siphon Road to Stuart lateral on the south. Mayor ~ske~£ounc.il ~area~should be annexed prior to census taken in September. Councilman Kinghorn said he felt city should have the public hearing and be prepared to pass ordinance annexing area. FIRE SCHOOL AT IDAHO FALLS - Dee Howell reported several firemen had attended the Fire School at Idaho Falls June 22, 23 and 24th. Mr. Howell informed council it was an excellent school and they had received first and second place trophies on the two man team hose competition and first place trophy in the four man team hose competition. Mr. Howell said it was a first for the same department to win three out of the four trophies awarded. Dee Howell, Butch Howell and Charlie Dickman presented the trophies to the city until such time as they get a trophy case completed. TCD Investment - City Clerk informed mayor and council of intended investment of $6,700 from Sewer Revenue Bond Reserve Fund and $3,400 from Water Revenue Bond Reserve Fund into Time Certificates of deposit. COMPENSATED TIME FOR EMPLOYEES - Mayor and council discussed adopting a different policy for employees being called to work on emergency work and also in regards to overtime being worked by policemen. WATER STORAGE TANK AND WELL PRESSURE within city - Engineer Alder reported the one and half million gallon storage tank was empty now for repairs and the city's water well supply is just barely supplying the city's needs. Engineer Alder suggested and told of his plans to install the new pump at Well #3 during the week of July 11 to July 16 which will improve the city water supply. The storage tank also could be available for use between July 15 and July 30. Mayor and council approved of plans and suggested the city notify the residents of city of plans to install pump and ask for their cooperation in refraining from watering as much as possible during the time involved in installation of Well #3 pump. BRIARWOOD MOBILE HOME PARK - Max Parrish asked when the Hendersons were going to install the fence around the trailer court. Mr. Parrish also asked if Whitaker Road was to be a dedicated street and had been built to specifications. 231 BRIARWOOD MOBILE HOME PARK - cont'd - Mr. Parrish asked if inspections could be made so the $1,000 bonds being held by city could be released. Mr. Parrish said they had corrected the development conditions for which bonds were being held, concrete cross drains, etc. Mayor Cotant asked Engineer Alder to check out if some inspections need to be made in regard to Mobile Manor 1st Addition and 2nd Addition so the bonds being held of Land Investments by city could be released. YELLOWSTONE HIGHWAY BUSINESSMEN MEETING - Mayor Cotant made a plea of business men present to make a sincere effort to make the main street thru Chubbuck a more desirable, cleaner and attractive street. Mr. Purrington of Wayne's Foodtown asked if some signs could be fastened on garbage containers to inform the general public the containers they pay for are for private use only. Mr. Barney told city the storm sewer is not working at intersection of Yellowstone and Chubbuck Road since the main sewer was installed. Also, a storm sewer along Yellowstone Highway at the Mobile HOme Trailer Sales, 4455 Yellowstone has settled several feet and is dangerous to cars and trailers. Chessley Moore, 5012 Yellowstone, owner of Coach Craft said his water meter lid is constantly being knocked off and hit by trailers driving in his driveway, thus causing damage to trailers. Mayor Cotant mentioned there are several parking problems along Yellowstone, especially backing out onto Yellowstone. Councilman Fullmer suggested Mr. Renfrow contact areas that need help and perhaps Mr. Renfrow could organize a clean-up group. UNIFORM BUILDING CODE ADVISORY ACT - Dan Stuart, building inspector informed council the city could choose from the following in regards to approving and enforcing building codes. Bui ding 1. City can opt to remain under Uniform lode Advisory Act and would need to enforce codes as is, with no opportunities to amend with lesser requirements. 2. City con continue with our city ordinances as adopted and amend ordinances if so desired. 3. City don't need to adopt any building or fire codes. Dan Stuart, building inspector recommended keeping the codes as we now have adopted with the opportunity to amend these ordinances if so desired. Councilman Romriell moved the city opt not to comply with the Idaho Uniform BuildinQ Code Advisory act. Councilman Kinghorn seocnded motion. All councilmen voted in favor of motion. HEIGHTS SUBDIVISION - HAMILTON AND VOELLER ENGINEERS - Frank Leibrock and Tim Shurtliff represented the engineering firm of Hamilton and Voeller. Mr. Leibrock said Hamilton & Voeller would guarantee if the water line that has been installed within one foot of curb fails they will pay expense of replacing curb if the city would agree for the line not to be moved, or as an alternate, they would deposit a certain amount of money in a trust fund to repair curb if line should fail. Mr. Leibrock said he felt that moving the line could be inclined to cause leakage more so than leaving it undisturbed. Engineer Alder said he is concerned about opening up a situation of accepting an offer of money instead of requiring work be done right and that if city accepts inferior development conditions the contractors and engineers will continue to do sloppy work. 233 HEIGHTS SUBDIVISION - HAMILTON & VOELLER - cont'd - Engineer Alder stated if a break occurs city would no doubt loose curb and sidewalk. Frank Leibrock said approximately 400 ft. of water pipe lies within a foot of the curb. Mr. Leibrock again said money could be placed in escrow for city's use at their leisure or paid to the city in one lump sum at present. Engineer Alder again mentioned the problem with approving not moving line, which could encourage other developers to handle future problems the same way. Engineer Alder stated his decision was for the line to be moved and Hamilton & Voeller engineers have requested to make a plea to council to not move line. Mayor Cotant asked feeling of council. Councilmen Taylor, Kinghorn and Fullmer said they would support the city engineer in his request. Mayor Cotant informed Mr. Leibrock and Mr. Shurtliff the majority of council supports the engineer and line will need to be moved. GLEN PERRY SEWER EASEMENT - Mayor Cotant told council Mr. Perry has requested city pay him the cost of installation of sewer service line in lieu of city installing the line. Mayor told council that Mr. Perry's cess pool was on the east side of his house, sewer line is on the west side. Mr. Perry feels he would prefer to install line from main street when it is extended along HOmestead Lane. Councilman Taylor said city has agreed to make the service and city should settle the obligation at this time. Mayor Cotant will discuss this again with Mr. Perry. GENERAL DISCUSSIONS 1. Employee compensation for extra time worked. 2. Storm drainage in relation to Yellowstone Highway project. 3. Storm drywells in Country Acres - One new drywell had been installed and one has been repaired in the Country Acres Subdivision. 4. Inspection needed on Whitaker Rd and West Street. Council requested city inform Hendersons by letter they are required to request inspections on Whitaker and West Street during construction so city will have record of construction for later acceptance of street as city dedicated street. Mayor Cotant said he thought Attorney Burnett is working on a new trailer ordinance. 5. Fence requirement and rear yard requirements in zoning ordinance might need to be amended. HAWTHORNE TERRACE APARTMENTS - Clyde Barney asked if city would continue the paving from Hawthorne Road to curb at Hawthorne Terrace.
