Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn~ Earl L. Romriell and Clerk Vera C. Armstrong. Councilman Wayne Taylor excused. Meeting called to order at 5:00 p.m. Purpose of meeting is to consider approval of applications for fireworks permits. City has received four applications; one from Chubbuck Jaycees, location to be the parking lot south of animal clinic, one application from Wayne's Foodtown, 5027 Yellowstone, and two applications from Keith Matthews, locations to be at Parrish Company parking lot and Cinema Theatres parking lot. In reviewing applications, it was determined that the Chubbuck Jaycees would need to detail on insurance certificate that City of Chubbuck is named as an additional insured only for the insured selling of safe and sane fireworks for operation involved. Lenny Purrington of Wayne's Foodtown requested requirement to sell fireworks from a temporary fireworks stand be waived. He has the fireworks already purchased and asked that he be allowed to sell out of the grocery store as he has done in the past for this year. Mr. Purrington has stated on his permit that fireworks shall be displayed at the front foyer of the store on a table three feet from the check- stand. A checker will be at the checkstand during all business hours. Fire extinguishers shall be provided near the display and no smoking signs will be posted. Dennis Matthews will need to submit the proper insurance for the Cinema Theatre parking lot location. Councilman Romriell moved to waive requirement of the selling of safe and sane fireworks from a temporary stand to Wayne's Foodtown and allow them to sell from inside the store for this year only. This location waiver is being granted be- cause Mr. Purrington has formerly purchased supplies and of the short notice of ordinance adoption, however, Wayne's Foodtown must comply with ordinance in every other respect except location of the stand. Councilman Fullmer seconded motion with all councilmen in favor. Councilman Kinghorn made motion that council approve permit application of Dennis Matthews at the Parrish Furniture parking lot and of Dennis Matthews permit at Starlite Cinema parking lot subject to submitting proper insurance to city for the Starlite Cinema location. Also to approve permit application of Chubbuck Jaycees subject to detailing insurance certificate naming the city of Chubbuck as an additional insured only for the insured selling of safe and sane fireworks for operation involved. Councilman Romriell seconded motion with all councilmen voting in favor. WATER TANK - Mayor and council discussed withholding payment of last claim from F. W. Kahley of 12,450.00 until such time city is assured the present leak is properly repaired. Decision was to hold the last claim of F. W. Kahley until further action by council.
