Minutes of the regular council meeting held in the city municipal building
April 12, 1977.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, Wayne G. Taylor. Attorney Don Burnett, Engineer John Alder
and Clerk Vera Armstrong. Councilman Earl L. Romriell excused.
Meeting called to order at 8:04 p.m. by Mayor Cotant.
Mayor Cotant asked for any corrections or additions to minutes of March 22.
Attorney Burnett proposed that minutes be corrected on page 187 in sub-paragraph
(1) of Councilman Fullmer's motion. Attorney Burnett requested the first five
words be deleted so that sub- paragraph (1) start with "The requirement ...... ."
Councilman Fullmer moved to approve minutes with the above change Attorney Burnett
proposed. Councilman Taylor seconded motion with all councilmen approving.
HEARING ON NUISANCE DOGS - Mrs. John Stoor, 227 Stuart, was present in regard to
public nuisance hearing on their dog.
Mrs. Stoor said they had got their dog impounded and had paid to get it
released March 28, however, a ticket dated March 24 was not delovered until
March 29th. Mrs. Stoor also stated the dog had been picked up in their yard.
Chief Stone read a list of several complaint tickets against the Stoors because
of their dog running at large over the past several years. The Stoors have
appeared at court and paid the fine on most of these tickets.
Mrs. Stoor said she felt all dog owners should be treated the same and she
has seen the dog catcher pass other dogs up.
Harvey Adams, animal control officer, told of how many times he has seen
the dog running loose in the neighborhood and the day he impounded the dog
he did follow the dog home and pick him up in the Stoor's yard.
Mayor Cotant told Mrs. Stoor the city has a responsibility to control the
dogs running at large, however, the city understands their love for their
pet, but the ordinance does need to be complied with.
Councilman Fullmer asked Mrs. Stoor what they plan to do to control the
dog so he won't further be a nuisance. She answered they had bought a
new chain and would try to keep him home.
Chief Stone said he understood the purpose of the hearing was to allow the
city to pick up the dog and dispose of it if declared a nuisance.
Attorney Burnett asked if dog was impounded at this time. Chief Stone said
that it was his understanding the hearing could be held without holding the
dog, the dog was not impounded.
Attorney Burnett stated he felt the city was not procedurely in a position
to destroy the dog at this time. Attorney Burnett advised Mrs. Stoor she
must care for her dog according to the ordinance or her dog will be short-
lived. No further discussion or action taken.
AZTEC PARK SUBDIVISION FINAL PLAT- Robert Thompson, engineer of Northwest
Development represented presentation of the Aztec Park Subdivision final plat.
Engineer Alder said the construction drawings have not been completed and
he would propose the plat not be signed until the construction drawings are
submitted and checked by him.

AZTEC PARK SUBDIVISION FINAL PLAT cont'd - Engineer John Alder suggested an
agreement be negotiated that pump be installed in lieu of park area
requirement at Aztec Park Acres Subdivision. Mayor and council approved
to acquire a negotiated agreement prior to signing of plat.
Councilman Taylor moved the Aztec Park Subdivision final plat be accepted
subject to the conditions recommended by the engineer and that all drawings
be submitted and approved prior to final acceptance and signing of plat
by Mayor Cotant. Councilman Kinghorn seconded motion and all councilmen
voted in favor.
COLONIAL LIFE AND ACCIDENT - James Brun presented the updated Colonial accident
plan carried on volunteer firemen and explained that increased benefits does
not have a $25.00 deductible. The older plan with the $6.50 premium is no
longer available and the new volunteer fire members have the updated coverage
while the long term members has the older plan and coverage.
Councilman Kinghorn moved the city accept the updated plan for all volunteer
firemen. Councilman Fullmer seconded motion~ voting was unanimous in favor.
POLICE STATION FEASIBILITY STUDY - Clarence Smith was present representing Smith,
Meier Associates. Mr. Smith stated they would be glad to do the study on the
contingency if it becomes funded they do the architectural work.
Mr. Smith stated federal funds may be available soon for local public works
projects and they would be prepared to write a feasibility study on speculation
that they do the architectural if project can be funded.
Mayor Cotant thanked Mr. Smith for bringing this proposal to the attention
of city and they would consider same,
BICENTENNIAL PARK - Larry Grindle, 5775 Eden, was present questioning plans for the development of the park in Paradise Acres,
Mayor Cotant told Mr. Grindle the project is scheduled for two years
construction and the project has been approved for a 50-50 matching grant
from Bureau of Outdoor Recreation thru Zdaho State Parks & Recreation.
Mr. Grindle asked if the city has an ordinance against litterings if so,
the developers at Paradise Acres let their containers and materials blow
around.
PARK PROPERTY ACCESS DEDICATION - Mark Bunce referred to the dedication of
park area to the city of Chubbuck. Mr. Bunce questioned the requirement
in the decication of right-of-way easement of having to complete the
street or easement to the park area at the city's request,
Mayor Cotant said the city should be able to change the dedication of
access easement to read that street be developed when surrounding property
is developed and subdivided. Attorney Burnett stated the dedication could
be changed to read that street be developed at time platted property adjoining
park area be improved and developed. Council in agreement to make this
change.
ORDINANCE # 178 - Providing for dedication of park land and for payment of fees
in lieu therof was read in full by Mayor Cotant by title only as first
reading.
ATTORNEY DON BURNETT informed mayor and council he had prepared a complaint
for Injunctive Relief and Damages against Arthur McOmber, owner of
New Colonial Motel, because of his not hooking up to sewer and failing to
pay sewer fees as required by ordinance.

FINANCIAL STATEMENT presented to Mayor and Council.
CLAIMS TO BE PAID IN APRIL presented to Mayor and Council.
Councilman Taylor moved to approve the claims. Councilman Kinghorn seconded
motion and all councilman voted in favor.
OTHER BUSINESS:
1. What can city do to have burned trailer moved from lot on Chickadee
Drive in Mobile Manor, After some discussion Mayor Cotant suggested
city contact State Department and inquire about removing debris of
burned-out trailer.
2. Comprehensive Plan to be adopted, schedule of adoption discussed.
3.Urban Transportation Study - to be completed in eighteen months
and to be projected over a 20 year period.
4. Water Storage and Pump Controls - valves to be sensed for pumps on
Well #2 and Well #3 so they will be turned on and off via telephone
lines. Engineer Alder has bid and has ordered same.
5. Sewer alarms to be checked, questioning of a grinder to be installed
in sewer line, extra pump for sewer. Scheduled maintenance on sewer
and water pumps.
