COUNCIL MEETING MINUTES
March 1, 1977
Minutes of the February 22 recessed meeting held in the city municipal building
March l, 1977.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Earl L. Romriell
and Wayne G. Taylor. Councilman Dwain A. Kinghorn excused. Attorney Don Burnett,
Engineer John Alder and Clerk Vera Armstrong also present.
Meeting called to order at 6:30 p.m. by Mayor Cotant.
WIDENING OF EVANS LANE OR CURB CUT TO DALEE-O-DRZVE IN - Mr. Dale Orth was present
and told council he had requested a curb cut just north of Evans Lane from the
Idaho State Highway Department and had been informed the crub cut had been
refused by the city of Chubbu~. Mr. Orth stated he needs access to his drive in
business and asked what city is going to do about putting street in on Evans
Lane.
Mayor Cotant asked Mr. Orth if he would not benefit as much from Evans Lane
being widened as from a curb cut from Yellowstone being approved. Mr. Orth
stated he probably would benefit about the same.
Mayor Cotant questioned Mr. Orth as to his feelings of giving 20 ft. for the
street to be widened on Evans Lane. Mayor stated it probably would not be
necessary at this time to curb the street to the east. Mayor Cotant told
Mr, Orth the city was not in any position to pay for property to build streets,
that property owners abutting street usually provided necessary property for
street.
Mr. Orth said he saw no advantage to him giving the 20 ft. for the street and
paying to have it paved and curbed later, a curb cut would give him private
access. Mayor Cotantsai~Mr. Orth's situation was no different from anyone
else in city as this same circumstance of improving streets at later time
could apply to anyone in the city.
Mr. Orth asked about a Local Improvement District. Mr. Orth was informed the
cost of street improvements would be borne entirely by bordering property owners.
Attorney Burnett added comment the city could condemn the property but he
could not say what the value might be. Condemnation could cost more for
attorneys than Mr. Orth would receive. The city comprehensive plan shows
street to go thru and the city must also determine now the curb cut for the
highway widening project.
Meeting adjourned at 7:10 p.m. with no further comments or action being/~¥aken.
