February 8, 1977
Minutes of the regular council meeting held in the city municipal building
February 8, 1977.
Present: Mayor JOhn O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, Earl L. Romriell and Wayne G. Taylor. Attorney Don Burnett,
Engineer John Alder and Clerk Vera Armstrong.
Meeting called to order at 8:02 p.m.
Mayor Cotant asked for any corrections or additions to council minutes of
January 25, There being none, Councilman Fullmer moved and Councilman
Romriell seconded that the minutes of January 25 be approved as written.
Voting was unanimous in favor of motion.
BID OPENING - BORING AND PIPE TO GO UNDER 1-15 - Mayor and council opened the
following bids in regards to the boring and installation of pipe under
Interstate -15.

After review of bids by Engineer Alder and Attorney Burnett, Mr. Burnett
advised bids could be accepted as stated in motion following.
Councilman Kinghorn moved the bid of $6,100.00 from H-K Constractors, Inc.
be accepted as the apparent lowest responsible bid and that acceptance of
bid notice be given by engineer after satisfaction by appropriate contact
that it is a responsible bid, and in the event the bid is determined not
to be a responsible bid all other bids will be under further consideration.

LACEY PARK SUBDIVISION ~ Roy Lacey presc~ted his preliminary plat. The ~/~rcorrectio~/
subdivision is located just west of Hawthorne Road on the former ~6W~/Lester
~[~ ~op$~..The plat. consists of 33 lots and 10.3 acres.

water and sewer lines be placed 15 ft. from edge of street leaving 20 ft,
between the lines when installed.
Councilman Romriell moved to approve the Lacey Park Preliminary Subdivision
plat. Councilman Kinghorn seconded motion. The voting was unanimous in
favor of motion.
BUNCE PHASE III PRELIMINARY PLAT - Mark Bunce and John Alder presented their
Phase III preliminary plat. Mr. Bunce is replatting the northerly
5.53 acres of the presently platted and recorded Phase II Subdivision.
Mr. Bunce and Mr. Alder have proposed deeding approximately 4.5 acres
for a park on property they plan to develop south of Chubbuck Road in
exchange for the park proposed in Bunce Subdivision Phase II and any
future park requirement in their planned subdivision.
Attorney Burnett advised that mayor and council will need to adopt
an ordinance for trade or exchange of property, publish ordinance and
provide for a 60 day waiting period to receive objections. After further
discussion Attorney Burnett declared the city could go ahead

with the vacation of that certain protion of Bunce Phase II as
replatted in Phase III since the city has not accepted dedication of park
at this time the area could be vacated and replatted.
Mr. Bunce stated they would deed the approximately 4.5 park acreage to
the city and provide an access right-of-way to same concurrently with
the approval fo Bunce Subdivision Phase III final plat. Attorney Burnett
said he would assist in the legal preparations.
Councilman Fullmer moved to approve the preliminary plat on the Bunce
Subdivision Phase III. Councilman Kinghorn seconded motion with all
councilmen voting in favor.
FIRE DEPARTMENT COMMUNICATIONS - Chief Denny Jones presented a communications
package'for the purchase of a pager system which would greatly improve
the fire call system of the fire department. Chief Jones has received
two cost estimates for the equipment, one from Motorola Company and one
from General Electric. The package contains 25 pagers, two base units
and a transmitter.
Mayor Cotant stated that he and Chief Jones favored a local supplier
because of the local service available after purchase.
Attorney Don Burnett advised the city to bid the purchase, and told
Chief Jones if he would submit the specifications to him he would
write up the bid.
BUNCE SUBDIVISION PHASE II VACATION - Mr. Mark Bunce has submitted a letter
of request to the city to vacate a portion of the Bunce Subdivision Phase II.
This portion is the northern 5.53 acres and includes the proposed park area.
This was reviewed quite thoroughly earlier in the meeting.
Councilman Romriell moved the city proceed with legal proceedings to
vacate the portion of Bunce Subdivision Phase II as requested. Councilman
Fullmer seconded motion and voting was unanimous in favor.
FUTURE ANNEXATIONS - Mayor Cotant asked if city should let it be known
that the city desires not to proceed with any annexations or zoning until
the comprehensive plan is adopted. Attorney Burnett agreed and said this
could be done by city council action.
Councilman Kinghorn moved the city approve a resolution of intent to hold
on any annexations or zoning proceedings because the city is involved in
the process of adopting a comprehensive land use plan and the city
desires to make no amendments or annexations until the comprehensive plan
is adopted. Councilman Romriell seconded motion. All councilmen voted
in favor of motion.
