COUNCIL MEETING MINUTES
January 28`h, 2003
Minutes of a regular meeting held at the Chubbuck City Council Chambers, January 28`h, 2003.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Charles Piquet, II.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular
Meeting Minutes of January 14"', 2003.
Councilman Kearns moved to approved Regular Meeting Minutes of January 14`h, 2003
as read, Councilman Gunter seconded. All council members voted in favor of motion.
PUBLIC HEARING - An application by the City of Chubbuck, 5160 Yellowstone Ave,
Chubbuck, Idaho 83202 for an annexation and change of Land Use District to Limited
Residential, (R -2). Property is located at 10613 N. Hiline Road.
Mayor Cotant declared the public hearing open.
PWD Smart stated the property is totally surrounded by the City, the Chubbuck
Development Authority is looking to add the area into the urban renewal area.
Mayor Cotant closed the public hearing.
Councilman Gunter moved to approve the application by the City of Chubbuck for
annexation and change of Land Use District to Limited Residential, (R -2) on property
located at 10613 N. Hiline Road, Councilman Kearns seconded. All council members
voted in favor of motion.
ORDINANCE - Annexing certain lands to be included within the boundaries and jurisdictional
limits of the City of Chubbuck, Idaho; specifying the zoning classification which shall be
applied to said lands newly annexed to the City of Chubbuck. The Wilson property on
Hiline Road.
Attorney Holmes read ordinance by title for the first reading.
Council tabled the ordinance until the February 11`h, 2003 Council Meeting.

MASSAGE STUDIO APPLICATION - Cathy E. Baker, 440 Washington, Pocatello, Idaho has
applied for a massage studio business license to operate at Cottonwood Cove, 1052 W.
Quinn Road and Donna's Hair Professionals at 265 E. Chubbuck Road.
Cathy Baker stated she will not be working for Donna's Hair Professionals.
Councilman Kearns moved to grant Cathy E. Baker a massage studio business license to
operate at Cottonwood Cove, 1052 W. Quinn Road, Councilman Gunter seconded. All
council members voted in favor of motion.
PROCLAMATION - "GIRLS AND WOMEN IN SPORTS DAY" - Mayor Cotant read the
"Girls and Women in Sports Day" proclamation in full.
Mayor Cotant proclaimed February 9`'', 2003 as "Girls and Women in Sports Day" in the
City of Chubbuck and called upon the citizens of the City of Chubbuck to recognize the
important role women's athletics play in the development of young women throughout
the City.
PROPOSED REMODEL /ADDITION OF CHUBBUCK CITY HALL - City Clerk Ron Conlin
stated the funding could be borrowed from the following funds, but would have to be
repaid in a 10 or 15 year payment schedule. CC Conlin said the original payment of the
addition/remodel will be paid from different sewer funds that have accumulated with the
largest amount being borrowed from the Sewer Lawsuit Fund, ( approx.$492,000.), the
balance would be interest earnings that have accumulated on required sewer funds the
City has.
Mayor Cotant suggested a portion of the City's growth every year be earmarked for
repayment of the loan to the Sewer Department.
Councilman Gunter stated he is not against the addition/remodel of City Hall, but would
like to see more specifics on how the sewer funds are going to be paid back, including
the amounts each department will have to reimburse the sewer fund. Councilman Gunter
felt the Department Heads should be advised how it will impact Department budgets each
year.
Discussion about possible deceases in sales tax revenue sharing.
After discussion, Council directed Staff to come up with specific costs and advise
Department Heads how much each department will have to pay toward the reimburse to
General Fund.

CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Gunter moved to approve computer print -out claims as presented,
Councilman England seconded. All council members voted in favor of motion.
GENERAL DISCUSSION - 1) Lamar and Russ Armstrong were present to discuss costs on what
it would take to install a water system in their proposed subdivision on West Chubbuck
Road. Russ Armstrong stated the preliminary costs for sewer system, waterline and
pavement and asphalt is $202,765. Water supply system is $78,135 of the $202,765.
Discussion about how Fire Code applies to this subdivision. FC Eric King stated he will
have to see a site plan to apply the Fire Code requirements to this subdivision. Mr.
Armstrong stated at this time they could put in five acre lots, drill a well, and install
septic tanks. Discussion about facility planning study that is progress. Discussion about
City participation in cost of waterline, if there is an advantage to the City. Discussion
about use of a development agreement to get funds that are expended, reimbursed.
Attorney Holmes expressed concern about why the City would consider extending the
waterline a mile from City Limits, outside of Urban Service Boundary.
Lamar and Russ Armstrong said they will go to the Land Use and Development
Commission's discussion on Comprehensive Plan Urban Service Boundary, February 4ffi,
2003.
At 9:19 p.m, Councilman England moved, Councilman Quick seconded, with full council
approval to adjourn meeting.
