PUBLIC HEARINGS
September 5, 1978
Minutes of the special council meeting held in the city municipal building
September 5, 1978.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, LeRoy S. Quick and Earl L. Romriell. Attorney Donald L. Burnett,Jr.,
Engineer Steven M. Samrt and City Clerk Vera C. Armstrong.
Meeting called to order by Mayor Cotant at 8:00 o'clock p.m.
The special public hearing meeting being held for two purposes; 1) Public
hearing on the Assessment Roll for Chubbuck Local Improvement District
No. 1 and; 2) Public Hea~ihg on the 1979 Fiscal year City Budget,
including adoption of the annual appropriation ordinance, fiscal year
budget and resolution setting the amount to be levied against all the
taxable property of the said city to pay estimated expenses for fiscal
year 1979.
PUBLIC HEARING ON THE ASSESSMENT ROLL FOR CHUBBUCK LOCAL IMPROVEMENT DISTRICT No.l:
Mayor Cotant read the Notice of Public Hearing and the Engineer's Report and
Assessment Roll in full.
Mr. Corman C. Geisler appeared at hearing on behalf of Reliance Investment Inc.
Mr. Geisler made an observation to the effect that there is a title dispute over
a narrow strip of property adjoining Parrish Realty property that Mr. Geisler's
title records indicate that Reliance Investment Inc. is the owner of
the property in the dispute and that there is no objection to the assessment
roll as set forth by the engineer.
None of the other property owners appeared during the hearing.
Mayor Cotant asked if there is an objection from anyone in the audience in
this public hearing to the assessment set forth in the assessment roll
prepared by the engineer.
There being none, Mayor Cotant read Ordinance #192, Confirming the
Assessment Roll for Local Improvement District #1, Chubbuck, Idaho in
its entirety.
Councilman Quick moved to dispense with rule of reading ordinance on three
separate days. Councilman Fullmer seconded motion. Roll call vote:
Fullmer, yes; Kinghorn, yes; Quick, yes; Romriell, yes.
Councilman Kinghorn moved to adopt Ordinance #192, Confirming the Assessment
Roll. Councilman Romriell seconded motion. Roll call vote: Fullmer, yes;
Kinghorn, yes; Quick, yes; Romriell, yes.
Councilman Quick made motion that city council finds there have been no
objections voiced during the hearing and to enter the assessment as set
forth in the assessment roll. Councilman Kinghorn seconded~mo~ion and
voting was unanimous in favor.
Councilman Fullmer made a motion that the city clerk provide notice to the
land owners that the city clerk transmit the assessment roll to the
county recorder as provided by the ordinance and that the city clerk in
her dual capacity as treasurer also give notice to all interested parties,
including the publication, of sale of bonds for Local Improvement District
No. 1, consistent with the provisions of just enacted Ordinance #192, ~
sealed bids to be opened at 8:00 o'clock p.m., Tuesday, October ~ 1978.
Councilman Quick seconded motion with all councilmen voting in favor.

PUBLIC HEARING ON FISCAL 1979 BUDGET - Mayor Cotant read the Notice
of pub]ic hearing in full, the 1979 fiscal estimated revenue and the
1979 fiscal budget as proposed. The budget was reviewed in its entirety.
RESOLUTION 8 - 78 ~ Resolving that there be levied against all taxable
property of said city, the amounts necessary to pay the estimated expenses
of said city, was read in full by Mayor Cotant.
Councilman Kinghorn moved to approve Resolution 8-78, setting the tax
levy. Councilman Quick seconded motion. Roll call vote: Fullmer, yes;
Kinghorn~ yes; Quick, yes; Romrie11, yes.
ORDINANCE #191 - Annual Appropriations for fiscal year 1979 read in full
by Mayor Cotant.
Councilman Romriell moved to dispense with rule of reading ordinance on
three separate days. Councilman Fullmer seconded motion. Roll call
vote: Fullmer, yes; Kinghorn, yes; Quick, yes; Romreill, yes.
Councilman Quick moved to adopt Ordinance #191, the Annual Appropriation
Ordinance for fiscal year 1979. Councilman Romriell seconded motion.
Roll call vote: Fullmer, yes; Kinghorn, yes; Quick, yes; Romriell, yes.
Public hearings adjourned at 11:30 p.m.
