November 20, 1979
Minutes of the adjourned city council meeting of November 13th held in
the city municipal building November 20, 1979.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr.,
Engineer Steven M. Smart and City Clerk Vera C. Armstrong. Councilman
Fullmer attended meeting from approximately 8:30 p.m. to adjournment.
Meeting called to order at 7:15 p.m. by Mayor Cotant.
POLICE REPORT - Chief Arnold Stone and Animal Control Officer Jane Bird
gave a report to the council on their ordinance enforcement progress.
Attorney advised Officer Bird and Chief Stone in regards to the issuance
of tickets.

Chief Stone discussed~the purchase of a copy machine, ammunition, purchase
of a new car, also the possibility of purchase of a new car or a different
car for the detective.
Attorney proposed the possibility of the city police officers representing
themselves in court cases when the individuals were also not represented
by counsel.
TRAFFIC COUNTERS - Engineer Smart reviewed the traffic counters bid at a
previous meeting with the mayor and council. The two bids received were
from Leopold Stevens Inc. and Streeter Amet Measuring Systems.
Councilman Romriell made motion to accept the Leopold & Stevens Inc. bid
as being the lowest responsible bid and to be in the best interest of the
city. Councilman Quick seconded motion and all councilmen voted in'favor.
COMPUTER CONTRACT DOWN PAYMENT - A down payment of $ 5,225.55 has been
requested from Computer Systems Dynamics to put the city computer on
order.
Councilman Quick moved to approve the clai~m of $5,225.55 to Computer Systems
Dynamics for a down payment on the purchase contract of the computer.
Councilman Kinghorn seconded motion with an unanimous vote in favor.
NORTHERN BANNOCK COUNTY FIRE PROTECTION DISTRICT - Attorney Burnett made
a report as to the county funding the Northern Bannock County Fire
Protection District.
Attorney Burnett reminded the council that the city has not received a
resolution from the County Commissioners on appropriating the $30,000
to cover the first year contract for fire protection services of the
Northern Bannock County Fire District. That the fire district may
not be considered an unprotected area and therefore cannot be funded
by the county. An Attorney General's opinion has been requested as to
whether the county can fund this coverage as an unprotected district.
CITY SHOP BUILDING BID - Mayor and council discussed awarding bids for
a shop building. The council have been considering the purchase of
property adjoining city and are not certain that it is wise to build
a shop building if the city is not able to acquire the additional
property.
Attorney Burnett advised mayor and council that bids that have been
modified should not be accepted, that city should either accept bids as
presented the night the bids were opened or reject all bids and make
a determination that the item can be obtained more economically on the
open market.
CITY SHOP BUILDING - cont'd - Councilman Fullmer noted that the city 211
did not receive any bids other than metal buildi'ngs and wondered if
that was not because of the time element allowed to prepare the bids
and questioned if it would not be in the best interest of the city to
reject all bids.
Councilman Quick moved to reject all bids on the shop building. Councilman
Fullmer seconded motion. All councilmen voted in favor of motion.
Councilman Romriell and Fullmer both voiced opinion that city should
take sufficient amount of time in asking for bids to give all builders
the opportunity to bid. Mayor and other councilmen agreed.
HERITAGE WEST SUBDIVISION - Vic Watson with J.U.B. Engineers, Developers
Sam Briscoe and Howard Gibson and Attorney Lowell Hawkes were present.
The Heritage West Subdivision is proposed to be located adjacent to
the Alturus Park Subdivision on the western boundary of the city.
Mr. Watson informed council they have proceeded with plans for a street
to the north and plan to move the well location closer to Chubbuck Road
and what remains to be resolved is the park property and participation
in the well.
A long discussion followed with an approximate $49,000 suggested for
participation in the well and various amounts considered for cash in
lieu of park.
Mayor Cotant suggested this matter be tabled until November 27, and all
councilmen and the gentlemen representing the American Heritage Builders,
Inc. agreed.
REISSUANCE OF BEER, WINE AND LIQUOR LICENSES - Mayor and council discussed
approving the reissuance of licenses of beer, wine and liquor license
holders in the city.
Councilman Kinghorn moved to approve the reissuance of beer, wine and
liquor licenses which have been previou~y approved. Councilman Fullmer
seconded motion with an unanimous vote in favor.
Councilman Quick moved, Kinghorn seconded with full council approval
that meeting adjourn at 12.20 ~.m.
