Minutes of the regular council meeting held in the city municipal building
October 23, 1979.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A
Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr.,
Engineer Steven M. Smart, and City Clerk Vera C. Armstrong.
Mayor Cotant called the meeting to order at 8:00 p.m.
Mayor Cotant asked for corrections or additions to minutes of October 9, 1979.
There being no corrections, Councilman Kinghorn moved to approve minutes of
'October 9 as written. Councilman Quick seconded with all councilmen
approving motion.
SIGN REQUIREMENTS - Darrell Smith, Port-a-Sign Co., attended the meeting to
discuss the city's regulation of portable flashing signs. Mr. Smith told
council he was concerned that the city had adopted an ordinance recently
which disallowed the use of flashing light signs, and requested the
opportunity to meet with the council for reconsideration of the ordinance
and possible revision of the ordinance.
Mayor Cotant suggested that Mr. Smith meet with Engineer Smart and
work out a rough copy of some proposed workable revisions that the city
could consider.
ADVERTISEMENT FOR BIDS - The city has advertised for bids on traffic counters.
Bids were submitted by the following:
Leopold & Stevens Inc., Four counters @1132.5Q = $~,530.00 Road tube @.35 per ft. 35.00
Streeter Amet Measuring Systems
Four counters @ll50.O0 $4,600.00
Road tube-50 ft 16.85
The bids were taken under advisement and not awarded this evening.
REQUEST OF NAIVER OF CITY MUNICIPAL GARBAGE COLLECTION SERVICE - William Hicks,
Vice President of operation for The Bon, has submitted written request
for waiver of Ordinance #201, which requires the services of the city
municipal garbage collection, stating they will be using a compacted
container up to 42 yard capacity and the city does not have equipment to
handle same.
Mac Allen representing the J. C. Penney Company has also submitted a
written application for waiver of Ordinance #201, which requires the
services of the city municipal garbage collection, their letter states
they will be generating a volume of trash that will necessitate the use
of a trash compactor larger than that which can be handled by the city's
collection truck.
After considerable discussion, Councilman Romriell moved that the requests
for waiver of the subscription requirement be approved upon condition that
the waiver will extend only until such time as the city gives notice that
it is able to provide the service, and secondly that the waiver extend only
to the subscription requirements and that all other requirements of Ord; #201
and Ordinance #60 remain enforceable. Councilman Quick seconded motion.
All councilmen voted in favor.

REQUEST OF WAIVER OF CITY MUNICIPAL GARBAGE COLLECTION SERVICE -
Mayor and council requested that letters be sent notifying the above
two companies of the condition of waiver of the subscription notice.
Councilman Romri611 moved to reconsider the waiver of sanitation service
granted to Rodney Parrish for Parr~hStore on August 14, 1979. Councilman
Kinghorn seconded motion. All councilmen voted in favor.
Councilman Romriell made motion that city council decide and that a
letter be sent to Rodney Parrish for the Parrish Company Store that their
waiver be modified and be subject to the same provisions as The Bon and
the J. C. Penney Stores, that the waiver will extend only until such
time as the city gives notice that it is able to provide the service, and
that the waiver extend only to the subscription requirement and that all
requirements of Ordinance #201 and Ordinance #60 remain enforceable.
Councilman Quick seconded motion, all councilmen voted in favor.
Councilman Fullmer requested a letter be sent to Mr. Rodney Parrish detailing
the reasons~for the action taken by the council.
GENERAL DISCUSSIONS:
1. Improvements to Fire Station discussed.
2. Meet the Candidate open forum planned for October 20, 1979, at
the city municipal building.
3. ~ Liability of city concerning volunteer and bystanders fighting
fires.
~ Workmen's compensation coverage for trainees and volunteers helping
at fires. Councilman Fullmer read letters from Kruse Insurance
and State Insurance Mayor Cotant to send letters to Fire Chief
and other employees concerning this.
CITY IMPACT AND NORTHERN BANNOCK COUNTY FIRE DISTRICT SERVICE FUNDING
Attorney Burnett advised mayor and council they need to meet with the
county commissioners on the following items.
a) City impact area
b) Commission does not plan to turn fire truck over to the North Bannock
County Fire District, therefor, City of Chubbuck will not be receiving
the truck.
c) City has no contract or guarantee that county will fund the fire
protection service of the Northern Bannock County Fire District for
the current contract period with the Northern Bannock County Fire
District.
Councilman Quick moved that council authorize the mayor to terminate fire
protection service to the Northern Bannock County Fire District unless there
is a meeting with the commissioners and the assurance of funding for this
service prior to November 2, 1979. Councilman Fullmer seconded motion,
with all councilmen voting in favor.
PRODUCTION DWELLING COURT REQUIREMENTS - Councilman Kinghorn presented the
results of the Land Use and Land Development Commission workshop on
requirement of production dwelling courts. Attorney Burnett was requested
to prepare a draft amendatory ordinance on these requirements for further
study.
Councilman Kinghorn moved, Romriell seconded, with full council approval to
adjourn meeting at 11:30 p.m. until 5:00 p.m., Thursday, October 25~ 1979.
