Minutes of the regular city council meeting held in the city municipal
building September 25, 1979.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr.,
Engineer Steven M. Smart, City Clerk Vera C. Armstrong.
Meeting called to order at 8:02 p.m.
Mayor Cotant asked for any corrections or additions to minutes of September 7
and September ll, 1979.
After reviewing, Councilman Kinghorn moved to approve minutes of September 7
and ll as written. Councilman Romriell seconded motion, with all councilmen
approving motion.
COMPUTER BIDS : Burroughs Corporation: B-800 Computer system hardware total
bid=S37,645.20; Total system software-S9,677.00. Burroughs B-80 computer
system=S20,637.00 hardware with a trade-in credit of $2100 for city machine,
bid did not include price of terminals or software.
NCR CORPORATION: NCR 1-8231 total hardware=S39,379.05; Total software
bid=S12,105.00.
IDAHO SUPREME POTATOES, INC~ A 13.7 mg disk storage for the IBM Series
computer=$7~750.O0
SUPERIOR INFORMATION SYSTEMS: Total software bid for IBM Series 1 =$15,500.00
COMPUTER SYSTEMS DYNAMICS: CSD 100 computer system total hardware=$29,771.O0;
Total software bid:$6~900.O0.
IBM: Series 1 Mini-computer total hardware:S33,113.00, software not bid.
Mayor Cotant thanked all companies for bidding and told them the city would
be making appointments for on-site demonstrations of machines bid.~
CURB, GUTTER AND SIDEWALK INSTALLATION.- Terry Briscoe, 4849 Whitaker Road, asked
if city would install curb and gutter if he and his neighbors installed
sidewalks.
Councilman Romrielt explained to Mr. Briscoe the city has purchased some
curb and gutter forms and the city would like to cooperate to some extent.
Councilman Romriell suggested city furnish forms, resident to pay deposit
when forms are used, and further said city may be able to cut grade with
grader, that city should have city employee or a responsible person inspect
to be sure grade of curb, gutter and sidewalk is installed proper with
residents responsible for payment of this persons time in making the inspection.
Attorney Burnett reminded city that there is an ordinance which requires a
surety bond for construction work done in city streets. *CORRECTION

Councilman Fullmer said if an employee of the city was involved a}!/~}l/~}~'~t~ ~
would hesitate bonding.
Councilman Fullmer suggested that with the city supervising in the interest
of the city, it may be possible to waive the bond requirement.
A long discussion followed on implementing a plan whereby the city could be
of assistance in this type of construction. Council discussed the need for
control of improvements made in this manner. Mayor and council agreed that
some type of agreement form should be prepared to guarantee the understanding
of participation on behalf of resident and city.

CURB, GUTTER & SIDEWALK - cont'd - Council were in agreement for Attorney Burnett to work up an amended ordinance to allow the waiver of surety bond.
Attorney Burnett said city could require the prepayment of inspection fees and
hold the city harmless, and use inspection fees to gain the service of an
inspector. Attorney Burnett added that Engineer Smart needs to come up
with an inspection fee schedule.
Mayor and council told Mr. Briscoe the city will prepare agreements and
amendments to further the possibility of city participating in the curb,
gutter and sidewalk improvements.
UNIFORM FIRE CODE - Fire Chief Denny Jones met with the Pocatello Fire Chief
and they are re-writing their code and considering changing most language
from shall to may in the code.
A lengthy discussion followed as to what requirements are needed in regards
to Life Safety Code and Uniform Fire Code.

Attorney Burnett said it would be meaningful to /q/~b/~ the ordinances to a
scope that the city has the ability to enforce. He added that a blanket
change from shall to may leaves discretionary decisions without any criteria
to guide such decisions. Attorney Burnett suggested the city have Chief
Denny Jones and Building INspector Dan Stuart outline the major subjects in
the code books and decide 1) does the city need within the next five or
six years and 2) can we enforce same.
Councilman Quick moved to table the third reading of the repeal of the Life
Safety Code and Uniform Fire Code until the second regular meeting in
November. Councilman Kinghorn seconded motion. Voting was unanimous in
favor of motion.
RESOLUTION CONSIDERATION - U.S.-91 Improvements from Chapel Street to 1-86.
Mayor and council discussed the city's participation in the improvement
of this project. The participation is tentatively set at a cost of one-third
to Pocatello City, one-third to Chubbuck City and one-third to Idaho
Department of Transportation. Mayor Cotant and Engineer Smart to follow
up on this item.
DAMAGE CLAIM - Mrs. Leon Tirrell has refused to accept the check of $9.50 to
pay for an inspection of her car as a result of driving into an open manhole
the city crews were working at. The reason she refused the check was because
of the following disqualifier typed on check "settlement of all claims per-
taining to any damage of 1979 Datsun, which was driven into an open manhole
of city on August 14, 1979." Mrs. Tirrell said she would accept the check
so Denny's Tune-Up could be paid if the disqualifier wording was removed.
Attorney Burnett advised council that the language on check is proper and
if the matter had been submitted to the insurance company they would have
required a similar release. Attorney Burnett added, if the city as a matter
of policy, given the low amount that is involved here and the minimal risk
that any further claims will be made, wants to make the payment without the
release the council may do so.
Councilman Fullmer moved to approve to pay Mrs. Tirrell the check of $9.50 without
any disqualifier on check. Councilman Romriell seconded motion. All
councilmen voted in favor of motion.

LIABILITY OF CITY IN REGARDS TO VOLUNTEER FIRE SERVICES - A discussion
was held concerning fire coverage in county areas.
Fire Chief Denny Jones suggested the city send letters to areas outside
the fire districts notifying them the city will not provide any fire
protection if this is the city decision.
Attorney Burnett advised city not to answer fire calls outside the fire
districts which the city has contract agreements with.
Mayor Cotant asked Attorney Burnett if he would form a letter to be
sent to these areas outside the fire districts.
TRANSFER OF FUNDS - Councilman Romriell mov~dto approve the following fund
transfers:
1) $12,065.53 from Sewer Construction Fund to close account - to be
transferred to Sewer Revenue Fund in the Waterworks Fund.
2) $22,700.48 from Waterworks Fund (Waterworks, Sanitation, Sewer) to
reimburse General Fund for payment of property for the public
utility yard.
3) $20,000.00 from General Fund to open Capital Improvements Fund for
the Yellowstone widening project.
4) $20,000.00 from General Fund Federal Revenue Sharing Funds to Waterworks Fund
- $10,000.00 to Waterworks and $10,000.00 to Sanitation.
Councilman Fullmer seconded motion. All councilmen voted in favor.
CLAIM - Councilman Fullmer moved to approve claim of $18,370.35 to Bannock
Paving Company for paving of Bicentennial Park project, scopes and
bicycle path on East Chubbuck Road. Councilman Kinghorn seconded motion.
All councilmen voted in favor.
GENERAL DISCUSSIONS: 1) Street Plan in Comprehensive Plan.
2) City development.
3) Time Limit on Variances.
4) New Garbage truck delivery.
QRANT - TRAFFIC COUNTERS - City has applied for a grant for traffic counters.
Engineer Smart asked council for approval to accept grant and advertise
for bids on the counters. Council approved.
IDAHO DEPARTMENT OF HIGHWAYS - SURPLUS SALES - Engineer Smart requested to attend
the auction, he is interested in a tilt type trailer and other items that city
might be able to use. Council approved.
AMERICAN PUBLIC WORKS ASSOCIATION -Engineer Steven Smart asked for permission to join this association and to attend a workshop. Council approved.
WORKSHOP AND MEETING - Council decided to hold a workshop on salaries Thursday at
5:00 p.m. and to meet with the Land Use and Land Development Commission and
Attorney Burnett on Tuesday, October 2 at 7:00 p.m. to acquire a better
understanding of the newly adopted ordinances.
Councilman Romriell moved, Councilman Quick seconded, with full council approval
to adjourn at 12:10 a.m.
