Minutes of the regular council meeting held in the city municipal building
May 22, 1979.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr.,
Engineer Steven M. Smart, City Clerk Vera C. Armstrong. Mayor Cotant being
present from 8:30 p.m. until meeting adjourned.
Meeting called to order at 8:07 p.m. by President of the Council Dwain A. Kinghorn.
President of Council Kinghorn asked for corrections or additions to minutes of
May 8 council meeting.
Councilman Romriell moved to accept minutes of May 8, 1979 as written. Councilman
Fullmer seconded motion with all councilmen approving.
AUDIT REPORT - Ray L. Carter of Ken V. Carter & Company presented the audit
report for fiscal year 1978 which covers the period from October 1, 1977
thru September 30, 1978. Mr. Carter reported that the city is in a sound
financial condition.
LIFE SAFETY CODE AND UNIFORM FIRE CODE - The advantages and disadvantages of
having adopted these two doces were discussed by the mayor and council.
Councilman Kinghorn told council he had reviewed the codes and that he
felt there were some valuable requirments in the fire code and possibly
the life safety code the should consider keeping.
Engineer Smart told mayor ~nd council that he feels that the building
inspector and himself needs to further study these codes and make
recommendations.
ORDINANCE # 201 - Amending Ordinance #60 to provide for placement and use of
dumpsters; further amending to provide that all properties subscribe to
service. Ordinance read in full by Mayor Cotant.
Councilman Fullmer questioned wording in Section 1, 3A, that owners or
occupants shall furnish dumpsters, as the city presently furnishes them.
Councilman Fullmer moved to amend the ordinance at second line in Section 1
under 3A "Dumpsters" to substitute the word "utilize" for the words "furnish
and keep". Councilman Romriell seconded motion. Roll call vote: Fullmer, yes;
Kinghorn, yes; Quick, yes; Romriell, yes.
Councilman Romriell moved to dispense with the rule of reading ordinance
on three separate days. Councilman Kinghorn seconded motion. Roll call
vote: Fullmer, yes; Kinghorn, yes; Quick, yes; Romriell, yes.
Councilman Quick moved to adopt Ordinance #201 as amended. Councilman
Fullmer seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes;
Quick, yes; Romriell, yes.
AIR QUALITY PUBLIC HEARING - Councilman Romriell attended a recent hearing
on the non-attainment status of the air quality in the Chubbuck and
Pocatello area. Councilman Romriell urged the mayor and councilmen to
write their comments to Dawn Stratham, Custodial of Records, Department of
Health and Welfare, State House, Boise, Idaho 83720, by the June 14 deadline.

Councilman Kinghorn moved to approve the claims as presented. Councilman Quick
seconded motion, all councilmen voted in favor.
Mayor Cotant informed council of a North Bannock County fire protection
meeting Wednesday evening, May 23, at 7:00 p.m,
CASE BACKHOE PURCHASE - The city has accepted the bid of G. K. Machinery to
furnish a J.I. Case Model 680 G loader/backhoe. The backhoe was delivered
April 9~ 1979. The city has discovered problems which substantially impair
the value of the equipment, Attorney Burnett wrote to ~-K Machinery
informing them if these problems are not remedied by May 24, 1979, the
city will be unable to close the financing transaction, and moreover, that
if the problems are not remedied within 15 days following the date of his
letter, the city will revoke its acceptance of the bid and of the equipment
and pursue the remedies available to it under the Uniform Commercial Code.
Attorney Burnett informed council the Uniform Commercial Code would require
the city identify something important that machine must be able to do in
order to serve the usual purpose that a backhoe has to serve, that this
machine just won't do.
Attorney Don Burnett told council he thought they ought to give consideration
to bring a third party in to field test the machine and see if it will do the
standard things that a backhoe is supposed to do,
GENERAL DISCUSSIONS:
1. Mayor Cotant said the city had been requested to post the parks that
alcoholic beverages are not allowed. The ball park at Victor and Teton
is owned by the School District and city will check with them on posting
that park.
2. Mayor Cotant told council a report had been made of rocks in the
easement between West Chubbuck Road and Victor and had requested the city
remove them. In the spirit of clean-up the city felt they could haul
them away.
3. Ball diamonds need worked up for season. Need restrooms at the ball
parks.
4. Water line to Pine Ridge Mall. Mayor Cotant and Engineer Smart talked
to Pocatello representatives concerning the furnishing of water for
fire protection to the mall, Pocatello charges $60.00 a year for a
ten inch fire line.
5. Electrical and Plumbing inspections within the City of Chubbuck. Mayor
Cotant and Engineer Smart has proposed contracting with Pocatello City for
electrical and plumbing inspections for a one year trial period.
6. Moving of restroom at Bicentennial Park. Mayor and Council voiced
objection to the moving of the restroom.
7. Thermal Energy - Councilman Romriell asked if Engineer Smart could
check into receiving federal aid for research of using thermal energy
in the area. Engineer Smart told council that Forsgren, Perkins & Associates
have made a study into this and they could perhaps make a report to city.

8. Purchase Orders - The purchase order for jackets for the fire department
has not been received by the clerk as yet so that payment can be made
to Blocks.
9. DENNY JONES CASE - Mayor Cotant said there are many junk cars parked outside
the fenced area for the junk cars. Attorney Burnett said he is working
on this case.
10. Photo finishing at city level. Councilman Kinghorn informed council the
police desires to have a dark room and needs to order some equipment.
They plan for Officer Sandusky to do the photo finishing and to use a
basement room of his home.
11. Councilman Kinghorn presented several items needed by police department
e.g., emblems, cool vests, ammunition and bullet proof vests.
12. Councilman Kinghorn also suggested acquiring some fire fighting equipment
for the police cars.
Councilman Kinghorn moved, Fullmer seconded with full council approval to
adjourn the meeting at 11:30 p.m.
