COUNCIL MEETING MINUTES
February 27, 1979
Minutes of the regular council meeting of February 27, 1979.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn, LeRoy S. Quick and Earl L. Romriell, Attorney Donald L. Burnett, Jr.,
Engineer Steven M. Smart and City clerk Vera C. Armstrong.
Meeting called to order at 8:00 p.m. by Mayor Cotant.
Mayor Cotant asked for any corrections or additions to minutes of February 13.
There being none, Councilman Kinghorn moved to approve the council
minutes of February 13. Councilman Romriell seconded motion, voting
was unanimous in favor.
ACCEPTANCE OF STREETS IN CHATTERTON SUBDIVISION - Linda Hailstone, 747 Norcrest,
Chatterton Subdivision, was present and asked council if there is a reason
the city has not accepted the streets in the subdivision for maintenance.
Engineer Smart stated there is no construction reason that the city has
not accepted the streets.
Mayor Cotant informed Mrs. Hailstone that the city is working on official
acceptance of the streets in the Chatterton Subdivision, and any problems
should be worked out by the time a Veterans Administration loan could be
approved on the home they desire to sell.
S.F.M.C. LEASING COMPANY - Robert E. Edward, presented a proposed leasing
program that will work with municipal financing and within the legal
framework of state statutes.
Mr. Edward told mayor and council that the lease provides that the
city becomes owner at the end of the lease period, also offers a
prepayment clause, and a monthly factor of .0219.
Mayor Cotant thanked Mr. Edwards for his financing proposal.
EQUIPMENT BIDS - Bids received at last meeting were reviewed by mayor, council,
engineer and attorney. Engineer Smart reported on research he had done
concerning the bids on the equipment.
GARBAGE TRUCK WITH PACKER - Engineer Smart told council the commercial
haulers gave the only comparative information. All cities contacted
seemed to like the equipment they were using.
After thoroughly reviewing the bids~ Attorney Burnett informed council
the city could reject all bids if it is determined the city can acquire
the items more economically on the open market, or city can reject all
bids and advertise for new bids.
Councilman Quick moved to table the award of bid on garbage truck and
packer until next meeting, March 13, to allow time to explore the
open market. Councilman Romriell seconded motion, all councilmen voted
in favor.
BACKHOE BIDS were reviewed by mayor and council. It was determined by council,
attorney and engineer that one bid had inappropriate security, another bidder
had enteredfull~mounts where the net amounts should have been entered.
Councilman Romriell moved to reject all bids and call for new bids. Councilman
Fullmer seconded motion, with an unanimous vote in favor.

LAWNMOWER BIDS - Parks superintendent Larry Kohntopp reported on bids
received by city.
After consideration of all bids, Councilman Fullmer moved to award the
bid to Turf Equipment Company for a Toro 72 Model mower, as being the
lowest, most advantageous bid for city, the price $5,769.00. Councilman
Quick seconded motion, vote was unanimous in favor.
ORDINANCE rezoning certain property owned by Don Andra and lying on the
south side of East Linden Avenue, was read in full by Mayor Cotant.
Mayor and council discussed the impact of the rezone of this particular
parcel of property on the city comprehensive plan.

Attorney Burnett told council they may have some discretion a enacting
this ordinance this evening because of the impact on the city's compre-
hensive plan and the city's proposed future street plan. Attorney further
added that the council may rezone when the rezoning provides orderly
· transition for the city.
After a lengthy discussion concerning ways the city could inform the
residents of the comprehensive plan, Attorney Burnett said it would be
well'if the city could record descriptions of city projected streets,
however, it would be costly·
Councilman Quick said perhaps a grant would be available to do the
engineering for these descriptions.
Councilman Kinghorn and Councilman Quick said they thought the city
should invite Mr. Andra to the next council meeting to discuss his
proposed plans for his property.
After considerable discussion, the council passed over the matter with
no action.
RESOLUTION 1-79 - Supporting Amtrak Pioneer passenger train transportation runs was read in full by Mayor Cotant.
Councilman Kinghorn moved to adopt Resolution #1-79. Councilman Quick
seconded motion. Roll call vote; Fullmer, yes; Kinghorn, yes; Quick,
yes; Romriell, ues.
PLANNING AND ZONING COMMISSION APPOINTMENT - Mayor Cotant recommended Boyd
Neider and Victor Herbert as members of the Planning and Zoning Commission.
Councilman Romriell recommended Dean Wood as a possible member of Planning
and Zoning Commission· Councilman Fullmer recommended the names of
Gary Dixon and Jack Nielsen as possible members of P & Z board, however, 7vc,d~

Councilman Romriell moved to appoint Boyd Neider and Dean Wood as members
of the Planning and Zoning Commission. Councilman Fullmer seconded motion,
All councilmen voted in favor.
CUTTER RACING WELCOME SIGN - Mayor Cotant questioned council and Attorney
Burnett concerning the city providing a welcome sign for the world cutter
racing to be held at the Bannock County Fairgrounds in March. Attorney
Burnett advised council that any expenditure for such sign would be an
inappropriate use of public funds.
Councilman Romriell suggested the city give special recognition to the city
police for commendable service when so deserved·
