Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, Earl L. Romriell, Attorney Donald L. B~rnett, Jr., Engineer Steven M. Smart and Deputy Clerk Dorothy L. Ward. Mayor Cotant called the meeting to order at 3:00 p.m. Mayor Cotant asked for any corrections or additions to minutes of December 12, 1978 council meeting. There being none, Councilman Kinghorn moved to approve the minutes of December 12, 1978, as written. Councilman Fullmer seconded motion and all councilmen voted in favor. CLAIMS TO BE PAID IN JANUARY presented to Mayor and Council. Councilman Romriell said Janitorial claim should be added as additional claim. Councilman Kinghorn moved to approve the claims with the exception of Dan's Market and Philip Romriell's Janitorial Councilman Fullmer seconded motion, all councilmen voted in favor. Councilman Fullmer moved to approve the claim of Phillip Romriell for Janitorial services. Councilmen Kinghorn seconded the motion. Fullmer, yes, Kinghorn, yes. Councilman Romriell abstained. REZONING REQUEST -FOUR WAY HOLDING - DON ANDRA, Planning and~Zoning Commission recommends approval of the requested zone change for this property on the south east'~corne~of~' -Yellowstone and East Linden Avenue. Councilman Kinghorn pointed out to the Council the area in question. Attorney Burnett informed council change would not be in conflict With~tbe Comprehensive Plan and the Land Use Ordinance. Attorney Burnett informed the Council and Mr. Andra a public hearing will have to be held according to the Local Planning Act; with a 15 day published notice to be given. Hr. Andra was told he would be on agenda February 13, 1979. DEPARTMENTAL ASSIGNMENTS FOR 1979. Mayor Cotant said he had suggested Councilmen remain over the same departments they had held in 197~. All Councilmen were re-appointed to same departments. COUNCILMAN ROMRIELL MOVED TO APPOINT COUNCILMAN KINGHORN AS PRESIDENT of Council for 1979. Councilman Fullmer seconded the motion and all council men voted in favor. LICENSING AND PERMIT ORDINANCE REVIEW - Attorney Burnett reviewed ordinance with councilmen. ORDINANCE # 194 - ANNEXING CERTAIN LANDS KNOWN AS "DELL ROAD AREA". Hayor Cotant said he would like to have all councilmen present before adopting this ordinance. Item tabled. EQUIPMENT BIDS - Engineer Smart explained his reasoning for the purchase of backhoe loader to replace a 1970 Massey Ferguson Model 70 backhoe/loader. He said with costs escalating and the possibility of a new water line to be installed on Hawthorne Road in the spring, he said he felt the cost would be justified. EQUIPMENT BIDS 3 Engineer Smart said the Garbage Packer in service at the present time is costing the city a lot of money for maintenance; over the past several months they have had a considerable amount of problems with both trucks. Engineer Smart said they had so many complaints on the rotary mower they had used they had gone to a flail type; but this was not as effective as it should be. With the new mower they would be able to mow and do trimming. Mayor Cotant and the Councilmen told Engineer Smart to bid for a backhoe loader, garbage packer and mower. GREG ROMRIELL,4544 Yellowstone, presented a correction notice on his building he is constructing, given him by Dan Stuart, Building Inspector. 1. Any exterior wall 5' or closer to property lines shall have no exterior opening. South wall of building and basement. Table 5a Page 56 U.B.C. to close to property line. 2. Exterior corner bracing needs nailed 6" O.C. at edge. Earl Romriell stepped down from council as he is personally involved in this matter. Greg Romriell said his plans had been approved in July, 1978. Engineer Smart said on the Plot Plan the building showed well within the property lines. ~ Earl Romriell said a new Plot Plan was not submitted - just the one presented five years ago and the building inspector knew where the property line was. Attorney Burnett said the Building Inspector Dan Stuart had provided written notice as provided in the U.B.C. now a Board of Appeals could hear the complaint. He said the Council could appoint a Board of Appeals and their decision would be final. He said he would be reluctant to appoint a board without a quoram; but the Mayor and Council could constitute the board with the building inspector as an ex officio member with a meeting held within a week. He said the builder could proceed at his own risk as construction had not been red tagged. The Appeals Board could serve ad hoc or at pleasure of Council; but should require action by quoram of board. Mayor Cotant suggested the Council act as Appleals Board. Councilman Fullmer moved to appoint City Council and Building Inspector to constitute the board~ if any Councilman feels they should be disqualified, Mayor Cotant to serve as board member. Councilman Kinghorn seconded the motion. All Councilmen ~oted in favor. Dwight Romriell asked for an inspection on the remainder of building so they could proceed with construction. GENERAL DISCUSSIONS: 1. Sale of City property and the building of a new City Office complex. 2. Bicentennial Park Grant Review. 3. Intermountain Gas putting a gas line to Motel 6 across the new street on West Burnside.
