COUNCIL MEETING MINUTES
September 9, 1980
Minutes of the regular council meeting held in the city municipal building
September 9, 1980.
Present: Mayor JOhn O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain
A. Kinghorn, LeRoy S. Quick, Earl L. Rc~riell, Attorney Donald L. Burnett
attended the meeting frc~ 8:40 p.m. until adjournment, Engineer Steven
Smart, end Secretary Myrna L. Crapo.
Meeting called to order at 8:00 p.m. by Mayor Cotant.
Mayor Cotant asked for corrections or additions to minutes of August 12,
August 19, and September 2.
There being no corrections, Councilman Quick moved to approve minutes as
written for August 12, August 19, and September 2. Councilman Kinghorn
seconded motion, with an unanimous vote in favor.
C~TER/NG PERMIT - Bill Kalivas of the Press Box for a baptism at the E1 Celito,
was discussed by the council.
Councilman Kinghorn moved to approve the liquor catering permit for Bill
Kalivas of the Press Box.
Councilw~nan Hopkins seconded motion, with all voting in favor.
D~LAGE CLA/~ -frc~ Larry Mercer caused by the fire depar~ent while fighting
a fire at 962 Stone.
The Mayor read Mr. Mercer letter describing the damage that was done and
estimating the cost of restoring his lawn at $150.00 to $200.00.
Engineer Smart informed the council that he had seen the damage and that he
questioned the amount that it would take to fix it.
After a discussion of the matter, the council agreed to turn the claim over
to the insurance cc~pany.
PUBLIC HEARING - Reverend William P. Carroll for a conditional use permit to
construct St. Paul Catholic Church at 820 W. Chubbuck Road, Chubbuck, Idaho.
Property is presently zoned General Residential (R-2)
Mayor Cotant read the Land Use minutes concerning their recc~endations on
this proposal.
Reverend Carroll answered questions concerning the black topping requirement.
Pete Anderson, architect, told the city council that they were still working
on an agre~nent with lowest bidder, and hoped that the building would be
started soon.
Councilman Rc~reill moved to approve the conditional use permit to construct
St. Paul's Catholic Church at 820 W. Chubbuck R~ad with the stipulation's
that were put on th~n by the Land Use Cu~,~ssion.

Councilwoman Hopkins seconded motion, vote was unamious in favor.
PUBLIC HEARING - a proposal by John E. Murray and Charlie Frasure for a
condition~ use permit to construct a roller skating rink in the 100 block off
the proposed West Ward Drive. Property is presently zoned General Cc~nercial
(C-2).
Engineer Smart offered ccr~nents on the parking requirements. The ordinance
required 256 spaces and they have provided only 137 spaces.
The Mayor reviewed the Land Use Cu~,~ssion cu~ents on the public hearing
that they held.
The council discussed the developing of the parking spaces. John Murray
informed the council that he felt that they vx~uld not have any use for the
additional spaces. A great deal of their business would be walk in or on
bikes.
Engineer S~art informed the council that they ~uld need a design review
permit before the Land Use Ccn~mission's next meeting. He suggested that the
council consider a partial design review at this meeting. Since they want
to start by the end of this month, the council needs to be partially
satisfied as to the design review permit so they can start now and be issued
a building permit, and complete the design review permit when they can
apply properly.
John Murray and Charlie Frasure discussed with the city council the landscaping.
They indicated that they would pat sc~e greenery out towards Yellowstone and
leave the three trees in back by the building.
Councilman Romriell moved to approve the conditional use permit for a roller
skating rink in the 100 block off the proposed West Ward Drive subject to
review May 1, 1982. It will be reviewed and a decision made at that time
by the city council to see if additional parking will be required, and if
the parking is not needed it will not be required with the 137 parking lots
provided. They will go through their design review.
Councilman Kinghorn seconded motion, all councilm~mbers voted in favor.
ORDINANCE REGULATING SIGNS within the city was brought up for consideration.
Councilman Kinghorn passed out some proposals that he and Engineer S~art
had ~Drked up to go along with the Uniform Sign Cede and explained the
reason for th~n.
Engineer Smart went through the r~ations with the city council. They
were discussed by the council. The Mayor suggested that the council take
the recu~endations hc~e and ~rk on th~n, and bring back their ccr~nents in
ORDINANCE ON CROSS CONTROL - was brought up for consideration. Engineer Smart
explained to the council that he was not ready for the cross control ordinance
and suggested it be put on the agenda for two weeks frc~ tonight.
CI2k]2z~ to be paid in September presented to Mayor and Council
Claims reviewed by mayor and council, Councilman Kinghorn rmpved to approve
all claims. Councilw~3n Hopkins seconded motion, all councilmembers voted
in favor.

Mayor Cotant was excused at 10:40 p.m. because of illness. Councilman Kinghorn,
President of the Council, took over as acting chairman.
GENERAL DISCUSSION:
1) Bids for shop building
2) Welch's property change
3) Draftsman finishing drafting of streets & utilities
4) Bannock Paving seal coating in kind for diesel fuel
5) New telephone system
Councilman Romriell moved, Councilman Quick seconded with full council approval
for meeting to adjourn at 11:20 p.m.
