HomeMy WebLinkAbout04 22 1980 CMCOUNCIL MEETING MINUTES 65 April 22, 1980 Minutes of the regular council meeting held in the city municipal building April 22, 1980. Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A. Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Engineer Steven, and City Clerk Vera C. Armstrong. Meeting called to order at 8:00 p.m. by Mayor Cotant. Mayor Cotant asked for corrections or additions to minutes of April 8 and April 15, 1980. There being no corrections, Councilman Kinghorn moved to approve minutes as written for April 8 and April 15. Councilman Romriell seconded motion, with an unanimous vote in favor. BID OPENING - An advertisement for bids has been published with sealed bids requested for water pipe and miscellaneous fittings and accessories. Bids were received from the following: Waterworks Supplies ITT Grinnell Company Water & Waste Water Equipment W. R. White & Co. Norman Supply Pacific States-Waterworks Equipment Co. $ 49,250.00 48,799.74 50~312.15 52,679.00 49,239.55 48,362.30 After review of bids by Engineer Smart, Councilman Romriell made motion to declare Pacific States to be the apparent lowest responsible bidder and authorizing Mayor Cotant to enter into a contract with Pacific States on confirmation of the engineer that all materials correspond with the specifications. Councilwoman Hopkins seconded motion. All councilmembers voted in favor. BEE HIVES ON PROPERTY - Mr. Ferron Harker, 5309 Hawthorne, has been invited to council meeting to discuss the possible nuisance of bee hives on his property. Attorney Burnett informed council that the Law Enforcement Department had contacted him as a result of calls from neighboring residents that were concerned about the placement of the hives in the area. Mr. Harker was present and told council his hives are on the back of his property, he has seven hives which are approximately 150 feet from the nearest other residence and he plans no expansion of the number of hives. It was the consensus of the mayor and council to render no objection to the placement of the hives until such time as some incident or event leads the city to conclude tolthe contrary. Attorney Burnett told council that the criminal code prohibits a nuisance and if the bee hives prove to be a nuisance it would need to be abated, that the complaintants should be notified that the c~ty finds no proof a nuisance exists at this time. VOLUNTEER FIREMAN'S ATTENDANCE AT THE STATE FIRE SCHOOL - Several firemen were present and voiced their interest in attending the fire school at Moscow on June 18, 19 and 20. Mayor and council discussed what dollar amount to approve for expense reimbursement. 67 Councilman Romriell moved to approve $350.00 per man reimbursement costs to attend the State Fire School at Moscow,Idaho, June 18, 19 and 20, with approval of no more than 10 men to attend. Councilman Quick seconded motion, all councilmembers voted in favor. FIRE CHIEF AND ASSISTANT FIRE CHIEF APPOINTMENTS - Mayor Cotant told council that at the fire meeting Wednesday, April 16, an advisory ballot was taken for Fire Chief. The fire department's choice was Bart Parrish. Mayor Cotant said he would like to appoint Bart Parrish as Chubbuck Fire Chief. Councilman Kinghorn moved to ratify the mayor's appointment of Bart Parrish as Fire Chief. Councilman Romriell seconded motion, with an unanimous vote in favor. Mayor Cotant told council Dee Howell was selected as Assistant Fire Chief and he would like to appoint Dee Howell as Assistant Fire Chief. Councilman Romriell moved to ratify the appointment of Dee Howell as Assistant Fire Chief. Councilwoman Hopkins seconded motion. All councilmembers voted in favor. Mayor Cotant informed council that Denny Jones and Eldon Muir were elected Battalion Chiefs and John Roeder and Cary Campbell were elected Lieutenants. TRAINING OFFICER SALARY - Earl Cluff has been called as a training officer. A training officer has not been functioning since 1975 and was paid $20.00 per month at that time. A suggested salary for this job is $50.00 per month. Councilman Quick moved to set compensation for training officer at $50.00 per month and to be retroactive to January 1, 1980. Councilman Kinghorn seconded, voting was unanimous in favor. ORDINANCE AMENDING NO. 185, making indecent exposure a misdemeanor and making it unlawful to draw write indecent, profane or offensive words or pictures on public premises, etc., was read in full by Mayor Cotant and accepted as the second reading. ORDINANCE PROHIBITING PARKING in the traveled portion of a roadway and against traffic was read in full by Mayor Cotant and accepted as the second reading. ORDINANCE AMENDING ORD. NO. 179, by repealing Section 2 (d) thereof in its entirety was read in full by Mayor Cotant and accepted as the second reading. RESOLUTION 3-80 to approve filing an application for the development of Mary's Park and authorizing Mayor Cotant to execute the application. Mayor and Council decided to meet at Mary's Park at 4:15 p.m. Wednesday, April 23 and study the park location for development possibilities before taking action on resolution. 69 MUNICIPAL IMPROVEMENTS AND ADVISORY BOARD - Attorney Burnett suggested the city activate the Municipal Improvements and Advisory Board to make a study of park development. Councilman Quick moved to deem all positions on the Municipal Improvements and Advisory Board vacant and authorize Mayor Cotant to make appointments subject to ratification of council. Councilwoman Hopkins seconded motion, all councilmembers voted in favor. ORDINANCE AMENDING No. 148, providing for additional requirements regarding design and reinforcement of walls and additional means of emergency egress from basements. Several contractors were present. Mr. Labrum, Devco, told council the costs, a little at a time has escalated and increased costs of homes tremendously. He added that the egress requirement would increase costs approximately $300.00 per home. After a lengthy discussion as to a solution of providing adequate building requirements concerning rebar'and to provide adequate safety for egress in basements, Councilman Romriell moved to direct Attorney Burnett to amend the proposed ordinance with the following amendments; that the rebar requirement be 4 bars of 1/2" steel in full walls, with no vertical rebar except in monolithic pour, half walls will require 2 bars of 1/2" steel. Egress requirement for basements will be the placement of one 30" x 20" window in the opposite area of stairway. Councilman Quick seconded motion. Roll call vote: Hopkins, no; Kinghorn, yes; Quick, yes; Romriell, yes. PUBLIC HEARINGS - Land Use and Land Development Hearings. Hearings declared open by Mayor Cotant. Mayor Cotant asked if anyone cares to address the items on the public hearings. Fence requirements were briefly discussed. Councilwoman Hopkins moved to continue the public hearings until 7:00 p.m. April 29th. Councilman Kinghorn seconded motion with all councilmembers approving. GENERAL DISCUSSIONS 1. Irrigation ditch north of Stuart Park and by the Library. 2. Cleaning of rocks along sewer easement on the George Shiozawa property. 3. Denny Jones conditional use permit denial. 4. Post Office in Chubbuck. 5. Swimming pool funding. INSURANCE CLAIM for workmans compensation coverage presented to mayor and council, Councilman Quick moved to approve claim of $1,436.09 to the State Insurance Fund. Councilwoman Hopkins seconded motion with councilmembers voting in favor, TRANSFER OF FUNDS - City Clerk informed council the need to make two fund transfers. Councilman Kinghorn moved to transfer $10,000 from 434.90 Waterworks Other Government Administration to 434.1 Waterworks Salaries & Administration, also transfer $300.00 from 434.90 Waterworks Other Government Administration to 434.6 Waterworks Customer Account. Councilman Quick seconded motion~ voting was unanimous in favor. Councilwoman Hopkins moved, Quick seconded with full council approval to adjourn meeting at 11:20 p.m. VeraC.
