Minutes of the adjourned meeting of March 25, held in the municipal building
April 1, 1980.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A.
Kinghorn, LeRoy S. Quick, Earl L. Romri~ell, Engineer Steven M. Smart, Attorney
Donald L. Burnett, Jr., City Clerk Vera C. Armstrong.
Meeting called to order at 8:08 p.m. by Mayor Cotant.
PUBLIC HEARING ON LAND USE HEARING AMENDMENTS. - Mayor Cotant declared the
public hearing open. Items #1, 5, and 6 have not had action taken by
council as yet. The first hearing on these amendments was held February 19
and have been continued since.
MOBILE HOME DEVELOPMENT - Councilman H6pkins made a proposal that the
ordinance amendment limit mobile home occupancy to 25% of housing in city
with no mobile units allowed outside courts.
Attorney Burnett told council he felt city could impose reasonable controls
on trailer development by percentage of residential occupancy.
Councilman Kinghorn voiced his opinion that the city cannot eliminate
development of mobile homes entirely, but is convinced that the city
must set standards that will cause the development to be aesthetically
attractive when developed.
Mayor Cotant said he felt the city needs to recognize there is a need for
mobile home development, and at the present those in the house buying
market cannot affort to get into conventional housing.
Councilman Romriell asked if city could set out zoning areas for mobile
homes, which would then be providing for mobile home development and this
could control development in other certain areas.
Attorney Burnett told council that setting guideline for impact on
residential housing stock by mobile homes does have merit and could be
considered as one of the c~iteria for evaluating applications. Other
criteria could be 1) setting standards for mobile homes to be on
foundation, being a certain width, etc., so as not to create an adverse
impact on the neighborhood 2) also provide geographically areas for
courts.
Attorney Burnett suggested that he provide an amendatory ordinance
according to the recommendations of the Land Use Commission and Council
input for review.
Mayor Cotant asked Engineer Smart to inquire as to the fire underwriters
rating on distances between mobile homes and also residential dwellings.
Mayor Cotant asked Councilman Quick and Romriell to study and make
recommendations as to geographical areas that would possibly be suitable
for mobile home development.
Councilman Kinghorn moved to continue the Land Use Ordinance Public
hearing until April 15, at 8:00 p.m. Councilman Hopkins seconded motion
with an unanimous vote in favor.
INSPECTION FEES - Following the land use hearing a discussion was held on
subdivision development inspection fees. John Alder made a report on
the schedule of charges in regard to inspections on subdivisions and
said he felt the charges were out of line and about twice what they
should be for general inspection and control. However, he added, the
charges depend on if the city is only requiring the inspections to be
sure work is done to their satisfaction or if city intends to be the
only inspector.
Del Bunce asked if city would certify to F.H.A., HUD and other agencies
financing homes, that construction was done to city standards? Engineer
Smart said he did not think it was the intention of city that the
inspections by the developer's engineer be eliminated.

PURSUANT TO A CALL of the mayor to the city council of a special meeting,
notice having been given to all the members, and all of them having
waived prior notice, that the subject of the meeting is a matter of
impending litigation or probable litigation within the meaning of
Idaho Code Section 67-2345 and the meeting could be in executive session.
Councilman Romriell moved the council go into executive session, Councilman
Quick seconded motion. Voting was unanimous in favor of motion.
In executive session the council discussed the city's potential involvement
in the case of Newbold versus Henderson with the city attorney and mayor.
Councilwoman Hopkins moved, Romriell seconded, with full council approval
to adjourn meeting at 12:00 midnight.
