COUNCIL MEETING MINUTES
February 12, 1980
Minutes of the regular council meeting held in the city municipal building
February 12, 1980.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A.
Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr.,
Engineer Steven M. Smart, and City Clerk Vera C. Armstrong.
Meeting called to order by Mayor Cotant at 8:00 p.m.
Mayor Cotant asked for any correction or additions to minutes of January 22
and January 29.
There being none, Councilman Romriell moved to approve minutes as written of
the January 22 and January 29 meetings. Councilman Kinghorn seconded motion
with an unanimous vote in favor of motion.
WATER ADJUSTMENT REQUEST - Mr. and Mrs. William Brown, 4619 Targhee has
requested a water charge adjustment. After continuous high meter readings,
the city checked Mr. Brown's meter and found it was registering 14 gallons
when only 10 gallons had actually gone thru the meter. The city replaced
the meter September 20, 1980. Councilman Kinghorn and Mayor Cotant approved
an adjustment of 1/3 of water charges from November of 1978 to October, 1979.
Mr. Brown rejected the adjustment of $56.60 and has requested to meet with
the council.
Mr. and Mrs. William Brown were present to discuss the reason for their
request for adjustment. Mr. Brown told council the meter stopped in August
of 1972, and the Chubbuck water meter employee worked on the meter. Mr.
Brown told council he felt the meter had malfunctioned since that time and
asked city for an adjustment back to August of 1972. Mr. Brown pres~ni~ec!~ graph
depicting his water usage since he had moved into the home in 1971.
Mayor Cotant suggested waiting to see how the consumption for next summer
compares with the past years consumption.
Mr. Brown asked if a meter could start registering over on its own. Mr.
Brown also asked if the city waits one year, what does the meter need to
show to determine whether the meter read over from 1972 or just during
1979.
Mayor Cotant said he felt the comparison should be made to the usage during
1978.
Councilman Kinghorn suggested making the adjustment for 1979 and then
checking the consumption for the 1980 season against prior years.
Councilman Romriell said he felt the city should decide upon the adjustment
now and not put the Browns on report for water used next summer. After
further discussion, the mayor, council and Mr. and Mrs. Brown agreed that
an adjustment would be made on the actual overread of 14 gallons to the
10 gallons usage since the meter stopped in August and September, 1972.
HERITAGE WEST NO. lA Subdivision final plat was presented by Vic Watson,
engineer with J.U.B. Engineers and Sam Briscoe with American Heritage
Builders, Inc. Gary Gibson and Tom Birch representing the American
Heritage Builders, Inc. were also present.
Mayor and Council reviewed the final plat. Engineer Smart has reviewed
the final plat and recommends approval.
Councilman Romriell moved that based on the engineer's findings on the
proposed final plat, which conforms to the previously approved preliminary
plat for the entire development, to approve the final plat of Heritage
West No. 1 Subdivision. Councilman Quick seconded motion. Roll call
vote: Hopkins, yes; Kinghorn, no; Quick, yes; Romriell, yes.

Councilman Kinghorn expressed his concern of approving a final plat only
on phase 1 of entire proposed development of Heritage West and annexing
the full 49 acres to be developed.
Attorney Burnett read from the Land Development Ordinance, Section 2-3,
D-3, page 7, that approval of the preliminary plat is valid for a period
of six (6) months and may be renewed once for a similar period upon
written request to the council.
SEWER DAMAGE CLAIM - Robert Nielson, 203 Hiway Avenue has presented a claim
to the city in the amount of $1,287.77 for repairs to his home caused by
water damage caused from a sewage back-up on January 22, 1980. Council-
woman Hopkins moved that the matter of approval on claim be tabled until
council gets report from insurance adjuster. Councilman Kinghorn seconded
motion with all councilmembers voting in favor.
GENERAL DISCUSSIONS
1. Moving of trees from Breneman property to Mary's Park; still checking
out costs.
2. Mayor informed council that he is meeting with fire department next
week and presenting a personnel policy to the department, that the
volunteers will be electing new officers and invited council to attend
the meeting if they so desire.
3. Mayor informed council the city is rebuilding one of the ford deisel
trucks with a water tank for the fire department. Mayor told council
there is a truck available for purchase to replace the truck going
into the fire department. It is a 1973 Chevrolet C-60 with a hoist,
metal flat bed and dump. Mayor Cotant said the purchase price is
$4,800.00 and city could use this truck to good advantage.
Councilman Romreill moved to authorize the mayor to enter into a contract
for the purchase of the 1973 Chevrolet C-60 two ton truck with hoist, flat
bed and dump from Dale's Auto (Recycle Contractors) for the purchase price
of $4,800.00. Councilman Kinghorn seconded motion with all council members
voting in favor.
PROPOSED ORDINANCE ON WATER SYSTEM CROSS CONNECTIONS - Mayor Cotant read
Ordinance by title only as the first reading.
FINANCING OF COMPUTER AND TERMINALS - Mayor and council discussed financing
approval for the purchase of computer. Engineer Smart has received the
lowest quote from Idaho Bank & Trust Company, Chubbuck branch.

FINANCING OF COMPUTER AND TERMINALS CONTINUED -
Councilman Quick moved to authorize Mayor Cotant to enter into a
lease pruchase finance contract with Idaho Bank & Trust Company with
the understanding that the contract impose no obligation beyond one
year at a time, interest at 6½%. Councilwoman Hopkins seconded motion
with all councilmembers voting in favor.
LITIGATION CONCERNING ENCROACHMENT OF HAWTHORNE AND SIPHON ROAD CANALS.
Attorney Burnett informed council he felt the city should submit a claim
to the proper federal agency in an amount that it would take to alleviate
the problem of the canal encroachment on Hawthorne and Siphon Road.
Councilman Romriell moved to authorize the mayor to make a claim against
the Department of Interior or other appropriate federal agency for damages
in such amount as the city engineer would recommend as adequate to correct
the problem of canal encroachment on the prescriptive rights-of-way along
Hawthorne Road and Siphon Road. Councilman Quick seconded motion, all
councilmembers voted in favor.
FINANCIAL STATEMENT for the month of January presented to mayor and council.
CLAIMS TO BE PAID IN JANUARY presented to mayor and council.
After a thorough review, Councilman Romriell moved to approve the claims
as submitted, and also approve seminar fee of $25.00 for Engineer Smart
to attend the seminar on concrete in Idaho Falls. Councilman Kinghorn
seconded motion. All councilmembers voted in favor.
Councilman Romriell moved to adjourn meeting until February 19, 1980.
