September 14, 1982
Minutes of the regular council meeting held in the city municipal
building September 14, 1982.
Present: Mayor John O. Cotant, Jr., Council members Becky A. Hopkins,
Dwain A. Kinghorn, Thomas S. Nield, LeRoy S. Quick, Attorney B.
Lynn Winmill, Public Works Director Steven M. Smart and City Clerk
Vera C. Armstrong.
APPROVAL OF MINUTES: Mayor Cotant asked for additions or corrections
to council meeting minutes of Augsut 24, August 31, and September
1, 1982.
Councilwoman Hopkins asked that the second paragraph, page lO1,
August 24 minutes, have words "in January"added at end of paragraph
for clarification.
Councilman Nield asked for wording in line three of same paragraph
on page lO1, to be changed by deleting words "lies upon" and adding
after word liability "may lay with" ...
Councilman Nield moved to approve minutes of August 24 as written
with the two above requested changes. Councilwoman Hopkins seconded
motion. All councilmembers voted in favor of motion.
Councilman Kinghorn moved to approve minutes of August 31 and
September 1 as written. Councilwoman Hopkins seconded motion.
Vote was unanimous in favor of motion.
LIQUOR CATERING PERMIT - After reviewing, Councilwoman Hopkins moved
to approve the liquor catering permit for the Oasis Bar, 304 North
Main, Pocatello, Idaho, to cater a wedding reception function
to be held at the E1 Cielito on Octover 9 from 7:00 p.m. to 10:00
p.m. All councilmembers voted in favor of motion.
BUSINESS LICENSE - Arthur N. Pollinger, California Stereo Liquidators,
has applied for a business license to hold a liquidation sale
at Oxbow Inn on October 2, 1982. Police Department have approved
the issuance of the license.
Councilman Nield moved to approve the business license to Arthur
N. Pollinger, California Stereo Liquidators. All councilmembers
voted in favor of motion.
ORDINANCE ENFORCEMENTS - Mary Bunce, 755 E. Chubbuck Rd., reported
to Mayor and Council that they have received several calls pertaining
to residents living in the Bunce Subdivision and operating businesses
in their homes~ e.g., breeding and selling dogs, painting cars
in attached wood framed garage and a pre-school nursery and
a day care center.
CLAIMS - Computer print-out claims to be paid in September and list
of handcheck claims to be paid in September presented to Mayor
and Council.

CLAIMS APPROVAL cont'd - Claims questioned were $10.04 claim to
Dan's Food Center for pop for firemen to take to fire and claim
for $50.00 to Roto-Rooter Sewer Service to clean sewer line at
George Shiozawa residence, After discussion, Mayor Cotant was
asked by council to advise Mr. Shiozawa to notify city when he
has sewer line problems.
Councilwoman Hopkins moved to approve the computer print-out claims
and hand check claims as presented with the exception of handcheck
claim to Dan's Food Center for pop for firemen to take to fire.
Councilman Nield seconded motion. Vote was unanimous in favor
of motion.

FINANCIAL STATEMENT FOR AUGUST presented to Mayor and Council.
HERITAGE WEST SUBDIVISION DEVELOPMENT AND ANNEXATION AGREEMENT. Attorney
Winmill gave a legal report of standing on the present development
and annexation agreement, Mr. Winmill to prepare a new agreement
with deeds of trust to the City of Chubbuck with new owners for
mayor and council consideration.
WATER, SANITATION AND SEWER RATE proposal was made by Public Works
Director Smart. Tentative agreement was to increase water minimum
rate to $5.00 with additional per 1,000 gallonage increased from
.30 per 1,000 to .35 per thousand. Sanitation rate to be increased
from $3.00 per month to $5.00 per month for residential and dumpster
pick up charge increased near the same percent. Sewer rate to
be increased $1.00 per month to a $9.00 charge. Attorney Winmill
instructed to draw up a new ordinance for consideration at next
council meeting.
GENERAL DISCUSSIONS
1. Building Inspector to do Fire inspections.
Councilman Kinghorn moved, Councilman Quick seconded, with full council
approval to adjourn meeting at 10:'55 p.m.
