August 24, 1982
Minutes of the regular council meeting held in the city municipal building
August 24, 1982.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A.
Kinghorn, Thomas S. Nield, Attorney B. Lynn Winmill, Public Works Director
Steven M. Samrt, and City Clerk Vera C. Armstrong. Councilman LeRoy S. Quick excused.
MEETING called to order at 7:35 p.m. by Mayor Cotant.
Mayor Cotant asked for corrections or additions to minutes of July 27,
July 29, August 3, August 10, and August 17.
Councilwoman Hopkins moved to approve minutes of July 27 meeting.
Councilman Nield seconded motion with an unanimous vote in favor of
motion.
Councilman Kinghorn moved to adopt minutes of July 29 meeting. Councilman
Nield seconded motion. All councilmembers voted in favor of motion.
Councilman Nield moved to approve minutes of August 3 meeting. Councilman
Kinghornseconded motion, vote was unanimous in favor of motion.
Councilman Kinghorn moved to approve minutes of August l0 meeting.
Councilwoman Hopkins seconded motion. All councilmembers voted in
favor of motion.
Councilman Kinghorn moved to approve minutes of Auqust 17 meetinq.
Councilwoman Hopkins seconded motion, vote was unanimous in favor
of motion.
CHUBBUCK DAYS REPORT
Randy Spencer, Chairman of Chubbuck Days, gave a full report of their
plans for Chubbuck Days. Mayor and Councilmembers thanked Mr. Spencer
for his effort and time spent in organizing the activities.
PUBLIC HEARING - Mr. Terry Goodwin, 4702 S. Afton, owns a pit bull dog
that has bitten a young girl that also lives on South Afton. The
dog was impounded because it was determined by police to be a nuisance
dog.
Mr. Goodwin's attorney, John Souza, has made a written appeal to the
council for this hearing.
Chief Stone informed Mayor and Council of the particulars of the incident
and said the dog is presently impounded at a Chubbuck veterinary clinic.
Mr. Goodwin said his dog had never bothered or bit any person before.
He asked that the dog be returned to him so he could give her to some
friends in McCammon.
Mrs. Edna- Bayliss, 150 W. Linden, reported this dog has also bit
Mr. Cantu's boy and that this dog had been very agressive and vicious
towards her and her husbands oarents and that they are unable to Go
out into their own yard.
HEARING CONTINUED - Terry Goodwin's dog -
Attorney Winmill reported this dog has been reported as biting a lady
in Pocatello and asked Mr. Moldenhauer to make a report to council.

Mr. Jim Moldenhauer said a complaint was made in January that this
same dog had bitten a person. Mr. Moldenhauer said th~ doqh~s been

well behaved while in the pound, but the:llablll.tv~uonl~C~,~bbuck
if this dog is released to someone in McCammon and the question is,
will this dog become aggressive again. Mr. Moldenhauer said he
has seen the dog very aggressive at the time a sixty four year old
woman was bit by this same dog. in January

Officer Jim Phel~sgave a full report of the incident the night Mr.
Goodwin's dog bit the young girl and the dog was impounded.
Mayor Cotant told Mr. Goodwin that a decision like this is difficult
to make. That Mr. Goodwin has a great exposure of responsibility
and that the city also has a great exposure of responsibility by allowing
dog to go free. Mayor Cotant added that the council has the obligation
of protection to the citizens of the community.
Councilwoman Hopkins moved to carry out the provisions of the animal
control ordinance and have the animal put to sleep. Councilman Nield
seconded motion. Roll call vote: Hopkins, yes; Kinghorn, yes; Nield,
yes.
SUMMARY ON HEALTH INSURANCE RATES AND BENEFITS FROM AIC. Councilman
Nield gave a comparison report on Blue Cross and Washington National
medical coverage.
Ron Porter of Blue Cross, was present and provided information as
pertains to medical coverage.
Concensus of council of mayor and council was to stay with Blue Cross
Medical policy at present.
CITY BUILDING DESIGN - Pete Anderson and Tom Myers presented drawings
showing proposed future expansion for city municipal building.
FINANCIAL STATEMENT for July presented to Mayor and Council.
CLAIMS - Councilman Nield moved to approve a $10.00 claim to Chamber
of Commerce for Steve to attend an Unemployment seminar, and a $105.00
claim to Frank Brown for plowing 7 acres of school property. Councilwoman
Hopkins seconded motion. All councilmembers voted in favor of motion.
Councilman Nield moved, Councilwoman Hopkins seconded, with full council
approval that meeting adjourn at 11:40 p.m.
