July 13, 1982
Minutes of the regular city council meeting held in the city municipal
building July 13, 1982.
Present: Mayor John O. Cotant, Jr., Councilmembers Dwain A. Kinghorn,
Thomas S. Nield, LeRoy S. Quick, Attorney B.Lynn Winmill, Public
Works Director Steven M. Smart, and City Clerk Vera C. Armstrong.
Councilwoman Becky A. Hopkins excused.
Meeting called to order at 7:35 p.m. by Mayor Cotant.
Invocation offered by Bishop Larry Beall, 35th Ward, Chubbuck Stake.
APPROVAL OF MINUTES: Mayor Cotant asked for corrections or additions
to council meeting minutes of June 29.
Councilman Quick moved, Councilman Kinghorn seconded motion that
council meeting minutes of June 29 be approved as written. Vote
was unanimous in favor of motion.
LITTLETREE INN - LIQUOR CATERING PERMIT - Barry Duncan, manager
of Littletree Inn was present and voiced his concerns about not
being able to obtain liquor catering permits on Sunday. He said
it would increase his business if he were allowed to cater parties
on Sunday with liquor catering, and perhaps a Sunday Brunch.
Mr. Duncan also said he would like to lobby for the service of
beer and wine on Sundays with meals.
Mayor Cotant told Mr. Duncan the city was concerned of the problems
that arise from drinking, problems it causes the city police
department.
Mayor Cotant told Mr. Duncan the council would consider his request.
NORTH BANNOCK COUNTY FIRE DISTRIST - John Whitaker, Fire Commissioner
was present by request of Mayor.
Mayor Cotant told Commissioner Whitaker the city would like to
have the privilege of billing insurance companies for fire runs.
Commissioner John Whitaker said the individual would need to
be billed and then the individual that had the fire would need
to turn the claim into their insurance company. Mayor Cotant
asked that Attorney Winmill research the impact on rates or impact
of insurability with this type of billing.
Commissioner Whitaker told Mayor and Council they would like
to share in the increased revenue if this is workable.
PROPOSED STREET BETWEEN EVANS LANE AND BURNSIDE - Vic Herbert asked
if City had any idea when the proposed street which is in the
comprehensive plan might be consumated.
Mr. Herbert was told the city's ~comprehensive plan designates
a proposed street from Burnside north to Evans, but until some-
one plans development in the area the city probably would not
request that the street be developed.
A lengthy discussion followed and Mr. Herbert thanked the council
for their time and consideration.
CLAIMS ~ Council and mayor reviewed computer print-out of claims
and list of handcheck claims attached to agenda.
Councilman Nield moved to approve the computer print-out claims
and handcheck claims as presented. Councilman Quick seconded
motion. All councilmembers voted in favor of motion.
Councilman Quick moved to approve the issuance of checks to umpires
for tournament at completion of Bronco Tournament, also pay Girl's
Softball umpires at end of season, and pay $115.00 deposit refund
to Kenneth Hansen, after their mo~ing from 144 Hiway Avenue.
Councilman Nield seconded motion. Vote was unanimous in favor
of motion.
Councilman Nield moved to approve the AIC Conference claims at
$95.00 gas per car, less registeration for spouses if not paid,
and less additional charge for spouse motel costs. Councilman
Quick seconded motion, with all councilmembers voting in favor
of motion.
GENERAL DISCUSSIONS:
1. Chubbuck Days Celebration. Councilman Nield reported he
has asked Randy Spencer to be Chairman of the event. A
meeting has been scheduled for Thursday evening, July 15,
7:00 p.m.

Public Works Director Smart showed the area of city impact
zoning comparison of city and county, and informed mayor
and councilmembers of county hearing, July 27.
Councilman Kinghorn moved, Councilman Nield seconded to adjourn
meeting at 11:00 p.m.
